Action Requested
Approve,by motion, the Preliminary Plat of New Resources Addition with the condition for the
execution of a development/land swap agreement between the City of Elk River and New Resources,
LLC outlining timing and responsibilities of the land exchange, to the satisfaction of both parties.
Adopt,by resolution, the final plat for New Resources addition,with the following conditions:
1. Lot 2, Block 1, shall be updated and read as Outlot A.
2. Add a drainage and utility easement over all of Outlot A.
Approve,by motion, the Conditional Use Permit (CUP) for a truck storage,maintenance, and repair
facility with the following conditions:
1. The authorized CUP will not be recorded until the associated zone change and plat are recorded.
2. Building permits for the described work will not be issued until the CUP is recorded.
3. If the proposed work described in the application and CUP has not been substantially completed
within two years after the CUP's date of issuance the permit shall expire and become void.
4. The CUP shall expire if the authorized use ceases for more than six months.
5. The applicant must apply for and receive approval for all required permits before any
construction may begin.
6. Curbs at abandoned driveways on Proctor Road shall be replaced with concrete barrier-style
curbing.
7. The site will need to comply with Chapter 57 of the MN State Fire Code.
8. Staff approval of a lighting plan demonstrating compliance with City Code Sec. 30-937.

Background/Discussion
The proposed project plats seven existing parcels into one buildable lot, one outlot,right-of-way for the
future 6 '/z Street, and right-of-way along Proctor Road/CR 1. All existing structures within the plat
boundaries will be demolished and Beaudry Oil will construct a 7,216 square foot (88' x 82') one story
facility to operate Beaudry Oil& Propane. The facility will be used for minor repairs to the fleet (not
open to the public),which includes oil changes, replacing tires, changing brakes,minor service,light

The property is zoned I2 (Medium Industrial) where bus, truck and implement storage, maintenance and
repair facility, require a Conditional Use Permit (CUP).
A bus, truck and implement storage, maintenance and repair facility was approved on June 19, 2017, for
five of the parcels within the project area. The new facility is shifting 60 feet north to allow for the
construction of 6 ½ Street.
Analysis
Comprehensive Plan
The property has a land use designation of Mississippi Connections (Plan). The Plan states: Proctor and
Quinn Avenue area is a relatively small area with a variety of incompatible land uses including both residential and heavy
industrial. Highway 10 improvements will include Proctor Drive intersecting with Highway 10 via an overpass. This
overpass will extend to the north, over the railroad tracks. This long elevated road will create a unique opportunity for the
property in the area, altering visibility and access. Due to the area’s proximity to the train tracks and Highway 10 traffic,
the Plan suggests business park uses and employment centers.
Strategies of the Plan are:
1. Work with the development community to identify and explore market opportunities and the feasibility of redeveloping
the area as a whole.
2. Work with interested property owners in the development of a master plan prior to rezoning the parcels.
3. Establish opportunities to construct community directional signage and gateway signage along Proctor Avenue.
Staff and Beaudry Oil have been working together to create the current proposal, which improves the
long term development opportunity for the area. The southernmost five parcels will eventually lose
direct access to Proctor Avenue and the only access will be from the west via the 6th Street cul-de-sac.
Plat
The minimum size for buildable lots in the I-2 district is one acre, with a minimum lot width of 100 feet.
The proposed plat satisfies these requirements. Right-of-way is also being platted for County Road
1/Proctor and the future 6 ½ Street.
Transportation/Circulation
The site will be accessed via Quinn Avenue on the west side and the future 6 ½ Street, which is planned
for construction in late 2018. In the near future, Proctor Avenue will be upgraded to include a dedicated
right turn lane for westbound Highway 10. This will eliminate the access to 6th Street from Proctor
Avenue as 6th Street will be a cul-de-sac or removed entirely. The new east-west connection between
Proctor and Quinn Avenues will be the proposed 6 ½ Street.
Abandoned driveways on Proctor Road shall be replaced with concrete barrier style curbing.

Parking
The site will be providing 28 parking stalls for parking of trucks from the Beaudry Oil & Propane fleet.
There will also be 4 parking stall for employee and customer parking, which meets the ordnance
requirements.
The site will need to comply with Chapter 57 of the MN State Fire Code with the possibility of parking
tanked vehicles longer than allowed by code.
Grading/ Drainage
Stormwater treatment for the site will be directed to a new pond, which will be constructed on the outlot
north of the proposed truck maintenance facility.
Landscaping
Per the city ordinance, 31 trees are required with the development of the property. The submitted
landscape plan shows 30 trees. An updated landscape plan must be submitted. The CUP condition of a
compliant landscape plan will be removed if one is received prior to the City Council meeting.
Screening
Section 30-905 of the city code requires overhead doors be screened from view from the public right-of-
way, public facility, or residential district or use. The site and architectural plans show overhead doors
along the east side of the facility, facing Proctor Road. A six foot opaque fence must be installed to screen
the doors from view in the public-right-of-way.
Applicable Regulation
Plat
Approval of a plat may only be ordered if the following findings have been made, as outlined in Section
30-375:
(1) The proposed subdivision is consistent with the zoning regulations (article VI of this chapter) and conforms in
all respects with all requirements of this Code, including the zoning regulations and this article.
The property is zoned I2 and the proposed subdivision is consistent with the zoning
regulations outlined in the city code and approved plans.
(2) The proposed subdivision is consistent with all applicable general and specialized city, county, and regional
plans, including, but not limited to, the city's comprehensive development plan.
The proposed subdivision does not conflict with any city, county, or regional plans, including
the Comprehensive Plan.
(3) The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to
erosion and siltation, susceptibility to flooding, and drainage are suitable for the type and density of development
and uses contemplated.
The site is suitable for the proposed development.
(4) The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation,
erosion control and all other services, facilities and improvements otherwise required in this article.
The subdivision has adequate provision for all of these facilities.

(5) The proposed subdivision will not cause substantial environmental damage.

development. The area is within the municipal service area and existing facilities can
handle the additional capacity.
If denial of the plat should occur, it shall accompany recommendations or determinations by findings or a
report stating how the proposed use does not comply with the standards set forth in Section 30-375.
Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
1. Will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or
the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city.
The property is surrounded by Industrial and Commercially zoned properties, the same as the
subject property. The use will not endanger, injure or detrimentally affect the use and enjoyment of
other property in the immediate vicinity or the public health, safety, morals, comfort, convenience
or general welfare of the neighborhood or the city.
2. Will be consistent with the comprehensive plan.
With establishment of a master plan for the block, the project is consistent with the comprehensive

3. Will not impede the normal and orderly development and improvement of surrounding vacant property.
The proposed site plan and layout improves the long-term development opportunities for parcels
along Highway 10 by improving access and visibility.

Resolution 17-
A Resolution of the City of Elk River Granting Final Plat Approval for New
Resources Addition, Case No. P 17-23
WHEREAS, application has been made for final plat approval,pursuant to Section 30-374
of the Elk River City Code of Ordinances, of the property legally described on attached
Exhibit A and hereinafter referred to as "the Property"; and
WHEREAS, the proposed final plat complies with each of the conditions set forth by the
City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED
1. It is hereby determined by the City Council for the City of Elk River as follows:
A. The proposed subdivision is consistent with the Chapter of 30 of the City
Code of Ordinances and conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general and
specialized city, county, and regional plans including,but not limited to, the
City's Comprehensive Plan.
C. The physical characteristics of the site,including,but not limited to,
topography, soils,vegetation, susceptibility to erosion and siltation,
susceptibility to flooding, and drainage are suitable for the type and density
of development and uses contemplated.
D. The proposed subdivision makes adequate provision for water supply, storm
drainage, sewage transportation, erosion control and all other services,
facilities and improvements otherwise required herein.
E. The proposed subdivision will not cause substantial environmental
damage.
F. The proposed subdivision will not conflict with easements of record or with
easements established by judgment of a court.
G. The proposed subdivision will not have an undue or adverse impact on the
reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property, subject to the conditions set
forth in attached Exhibit NATUREJ
3. The officers of the City are hereby authorized to sign the final plat for the Property
and to issue a certified copy of this Resolution giving final approval of the plat.
4. The owner of the Property is authorized to record the final plat as required by law
and shall file proof of said recording with the City. No building permits will be
issued for the Property until the final plat is recorded.
5. This final plat approval shall expire two years from the date of this resolution if the
final plat is not recorded within that time.
