MEETING OF THE ELK RIVER CITY COUNCIL HELD AT THE ELK RIVER CITY HALL MONDAY, NOVEMBER 23, 1992 Members Present: Mayor Tralle, Councilmembers Dietz, Kropuenske, Schuldt and Holmgren Members Absent: None Staff Present: Pat Klaers, City Administrator; Sandra Thackeray, City Clerk; Russ Anderson, Fire Chief; Phil Hals, Street/Park Superintendent 1. Call Meeting to Order Pursuant to due call and notice thereof, the meeting of the Elk River City Council was called to order at 7:00 p.m. by Mayor Tralle. 2. Consider 11/23/92 City Council Agenda COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE 11/23/92 CITY COUNCIL AGENDA. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. 3. Consider 11/16/92 City Council Minutes COUNCILMEMBER KROPUENSKE MOVED TO APPROVE THE 11/16/92 CITY COUNCIL MINUTES. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. 3.2. Consider 11/16/92 Executive Session Council Minutes COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE 11/16/92 EXECUTIVE SESSION COUNCIL MINUTES. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. 4.1. Proclamation/Latin American Week Dr. Flannery stated that the City of Elk River has a sister City relationship with Nuevo Gualcho El Salvador and indicated that Elk River Rotary is requesting the City to proclaim a week to recognize and celebrate Latin cultures. COUNCILMEMBER SCHULDT MOVED TO ADOPT A PROCLAMATION PROCLAIMING THE WEEK OF NOVEMBER 30 THROUGH DECEMBER 6 AS A WEEK FOR THE CELEBRATION OF LATIN CULTURE. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0. 5. Arts Council Discussion Cliff Lundberg, Jane Thompson, and Dr. representing the Arts Council. Dr. David Flannery were present Flannery stated that the Arts . . . Elk River city Council Minutes November 23, 1992 Page 2 Council is still seeking support from the City Council. He indicated that the City's support is important to the organization. Jane Thompson provided the Council with the local sources of funding from 10/1/89 to 11/23/92. She indicated that the Arts Council deducted the rent donation from the Elk River Community Theater from the funds that have been raised leaving a total of $27,281.70. She stated these funds have been raised since 10/1/89 and stated that they are short about $2,700 to match the City's total donation of $30,000 during the last three years. Dr. Flannery stated that the Arts Council is very confident that in the next several months the entire $30,000 will be raised to match the City's contribution. Cliff Lundberg indicated that he did not understand rationale for disallowing the rent donation from Community Theater as a source of funding. The Council payment of rental fees did not correspond to its donations. the Council's the Elk River indicated that definition of Dr. Flannery requested that the Council release the $10,000 which has been allocated for 1992 with the understanding that additional funds will be raised by the Arts Council. COUNCILMEMBER DIETZ MOVED TO RELEASE $10,000 TO THE ARTS COUNCIL AND THAT THE $5,000 PROMISED FOR 1993 NOT BE RELEASED UNTIL THE ARTS COUNCIL HAS MATCHED THE $5,000 PLUS THE $2,700 WHICH THEY ARE SHORT FOR 1992. COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION CARRIED 5-0. 6. Emergency Preparedness Plan/Fire Chief Russ Anderson Fire Chief, Russ Anderson, presented the City Council with the Emergency Preparedness Plan for the City of Elk River. He reviewed the role and the function of the City Council in event of an emergency. Discussion was held regarding Elk River would assist in that meetings be held between of action which could include the City of Otsego and how the City of an emergency situation. It was suggested otsego and Elk River to formalize a plan Elk River's assistance. It was the consensus of the Council that no action Emergency Preparedness Plan at this time, but that when Council is in office that the plan be reviewed and Council. be taken on the the new City adopted by that 7. Snow Plowing POlicy/Street/Park Superintendent Phil Hals Phil Hals reviewed the City's 1992-93 Snow Plowing Policy and routes with the City Council. He noted that other than a sixth plow route being added, no other major changes have taken place in the last couple of years. Phil also reviewed the policies on damage to sod, mail boxes, and sprinkler systems. COUNCILMEMBER HOLMGREN MOVED TO ADOPT RESOLUTION 92-112, A RESOLUTION APPROVING THE 1992-93 CITY OF ELK RIVER SNOW AND ICE CONTROL POLICY AS . . . Elk River City Council Minutes November 23, 1992 Page 3 PRESENTED BY STREET/PARK DIETZ SECONDED THE MOTION. SUPERINTENDENT, PHIL HALS. THE MOTION CARRIED 5-0. COUNCILMEMBER Pat Klaers indicated that the Street Superintendent is considering the purchase of a vehicle located in Souix Falls. Previous attempts to purchase the vehicle that will be financed with 1993 Equipment Certificates have been unsuccessful. The City Administrator requested that the Council grant permission to the Street Superintendent to purchase a vehicle with the 1993 Equipment Certificates so that the Street Superintendent does not need to request City Council permission each time he considers purchasing this vehicle for 1993. COUNCILMEMBER KROPUENSKE MOVED TO APPROVE THE PURCHASE OF A VEHICLE FOR THE STREET DEPARTMENT WITH FUNDS FROM THE 1993 EQUIPMENT CERTIFICATES. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0. The City Administrator indicated that he has been requested by the Street Department employees to consider some type of premium pay for snow plowing during non-regular hours. He indicated that Sherburne County has a plan which employees receive a bonus pay if they are called out to snow plow before 7:30 a.m. After discussion by the Council it was the consensus that it would be appropriate for the City of Elk River to follow the County's policy. COUNCILMEMBER KROPUENSKE MOVED TO INCORPORATE THE COUNTY'S BONUS PAY POLICY INTO THE CITY OF ELK RIVER'S SNOW PLOWING POLICY. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. Pat Klaers, City Administrator, indicated that the Street Department has recently created a new laborer's position. He further stated that this laborer will be one of the snow plow operators and requested that the Council consider paying the laborer an "out of classification" rate while operating the snow plow. Councilmember Schuldt indicated that when the individual was hired, it was noted that snow plowing would be one of the duties required. Mayor Tralle stated he felt it would be appropriate to pay the individual an out of classification pay during snow plowing operations. Councilmember Dietz indicated that he concurred with Councilmember Schuldt in that the employee was aware that snow plowing would be part of the position. Councilmember Holmgren indicated that this could become a more complex issue than just out of classification pay for one position. He suggested that more thought be given to the issue as to how it would affect other departments and employees in the City prior to making a decision. . . . Elk River City Council Minutes November 23, 1992 Page 4 COUNCILMEMBER KROPUENSKE MOVED TO PAY THE LABORER I POSITION AN EXTRA $1.25 PER HOUR DURING HEAVY EQUIPMENT OPERATION IN RELATION TO SNOW PLOWING ACTIVITIES AS ASSIGNED BY THE STREET SUPERINTENDENT. MAYOR TRALLE SECONDED THE MOTION. THE MOTION FAILED 2-2-1. Councilmember Schuldt and Dietz voted against the motion and Councilmember Holmgren abstained. 8.1. Consider Deferred Special Assessments The City Administrator indicated that five property owners have completed applications requesting deferral of their special assessments. The Council reviewed the applications. The Council questioned whether the City has received documentation proving that the property owners qualify for deferral. The City Administrator indicated that he would have to check with the Finance Director to see if this has been accomplished. The City Administrator recommended approval of the resolutions deferring the special assessments contingent upon documentation proving that the applicants are eligible for deferral. COUNCILMEMBER HOLMGREN MOVED TO ADOPT RESOLUTION APPROVING DEFERRED SPECIAL ASSESSMENTS FOR THE 1992 STREET PROJECT FOR EVA MURRAY. COUNCILMEMBER MOTION. THE MOTION CARRIED 5-0. 92-113, A RESOLUTION HOLT AVENUE AND 4TH DIETZ SECONDED THE COUNCILMEMBER HOLMGREN MOVED TO ADOPT RESOLUTION 92-114, APPROVING DEFERRED SPECIAL ASSESSMENTS FOR THE 1992 PROJECT FOR LUCILLE LLOYD. COUNCILMEMBER DIETZ SECONDED THE MOTION CARRIED 5-0. A RESOLUTION WESTERN AREA THE MOTION. COUNCILMEMBER HOLMGREN MOVED TO ADOPT RESOLUTION 92-115, A RESOLUTION APPROVING DEFERRED SPECIAL ASSESSMENTS FOR THE 1992 WESTERN AREA PROJECT FOR CALLIE PLAYLE. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. COUNCILMEMBER HOLMGREN MOVED TO ADOPT RESOLUTION 92-116, APPROVING DEFERRED SPECIAL ASSESSMENTS FOR THE 1992 PROJECT FOR DELPHIA BANDELIN. COUNCILMEMBER DIETZ MOTION. THE MOTION CARRIED 5-0. A RESOLUTION WESTERN AREA SECONDED THE COUNCILMEMBER SCHULDT MOVED TO ADOPT RESOLUTION APPROVING DEFERRED SPECIAL ASSESSMENTS FOR THE PROJECT FOR IRVIN MOLDENHAUER. COUNCILMEMBER MOTION. THE MOTION CARRIED 5-0. 92-117, A RESOLUTION 1992 WESTERN AREA DIETZ SECONDED THE 8.2. Consider Resolution Calling 1985 G.O. Improvement Bonds The City Refunding He stated $240,000. Other Business Mayor Tralle informed the Council that the Utilities Commission recently increased the WAC charge. He stated that there was a problem with this increase for the Westwood Area residents. He stated that the Utilities brought the motion back to the table and decided to grant an extension of four years to the Westwood residents before the increase would be charged in this neighborhood. 10.
