11-28-2017 PC MINMeeting of the Elk River Planning Commission Held at the Elk River City Hall Tuesday, November 28, 2017 Members Present: Chau Eric Johnson, Commissioners Jill Larson -Vito, Robert Rydberg, Alexander Feinstein, and Brad Thiel Members Absent: Commissioners Mark Konietzko and Mike Nichols Staff Present: Planning Manager Zack Carlton, Senior Planner Chris Leeseberg, Sr. Administrative Assistant/Recording Secretary Jennifer Green I. Call Meeting to Order Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission was called to order at 7:16 p.m. by Chair Johnson. 2. Consider November 28, 2017, Planning Commission Agenda Moved by Commissioner Thiel and seconded by Commissioner Feinstein to approve the November 28, 2017, Planning Commission agenda. Motion carried 5-0. 3. Consider September 26, 2017, Planning Commission Minutes Moved by Commissioner Larson -Vito and seconded by Commissioner Feinstein to approve the September 26, 2017, Planning Commission minutes. Motion carried 5-0. 4.1 Tiller Corporation — 12450 Ranch Rd. NW Conditional Use Permit for portable concrete plant, Case No. CU 17-34 Mr. Carlton requested this item be continued to the December 19, 2017, Planning Commission meeting to allow time for the applicant to meet with staff. Chair Johnson opened and requested to continue the public hearing to December 19, 2017. Moved by Commissioner Larson -Vito and seconded by Commissioner Thiel to continue the public hearing for the request by Tiller Corporation for a Conditional use Permit for portable concrete plant to the December 19, 2017, Planning Commission meeting. Motion carried 5-0. Planning Commission November 28, 2017 4.2 Ordinance Amendment — City of Elk River ■ Subdivisions across plat boundaries, Case No. OA 17-12 Mr. Carlton presented the staff report. Cotmnissioner Rydberg asked what cost savings are being generated with this process. Mr. Carlton stated a $100 fee and a $100 escrow would be required and noted the current procedure required a $275 fee and $1,000 escrow. Chair Johnson opened the public hearing. There being no one to speak, Chair Johnson closed the public hearing. Page 2 Moved by Commissioner Rydberg and seconded by Commissioner Thiel to recommend approval of the ordinance amendment establishing the platted exemption process under Section 230-352(c) as outlined in the staff report. Motion carried 5-0. 4.3 Ordinance Amendment — City of Elk River Remove Planning Commission work session from city ordinance, Case No. OA 17-14 Mr. Carlton presented the staff report. Chair Johnson opened the public hearing. There being no one present to speak, Chair Johnson closed the public hearing. Moved by Commissioner Thiel and seconded by Commissioner Feinstein to recommend approval of the ordinance amendment removing the Planning Commission workshop from city ordinance as outlined in the staff report. Motion carried 5-0. 4.4 Beaudry Oil/Truck Shop — 620, 634 Quinn Ave. & 623 & 633 Proctor Ave. • Preliminary Plat review of New Resources Addition, Case No. P 17-23 • Conditional Use Permit to establish a truck storage, maintenance, and repair facility, Case No. CU 17-36 Mr. Carlton presented the staff report. He indicated staff was recommending approval of these items. Chair Johnson opened the public hearing. There being no one to speak, Chair Johnson closed the public hearing. p0VIAf1 1 1 NAW Planning Commission Page 3 November 28, 2017 Commissioner Larson -Vito asked about the long term plans for the creation of another cul-de-sac and any concerns that may create. Mr. Carlton stated staff has been working with Sherburne County and MnDOT to review and improve the intersection performance at Proctor Avenue and Highway 10. He stated in order to add the right tum lane along southbound Proctor Ave, a cul-de-sac would have to be construct at the end of 6s' Street. Full access for the parcels along 6' street will be maintained, but access will only come from Quinn Avenue to the west. Commissioner Rydberg asked about the creation of a new street and the effect on the properties to the south and wondered if there were aesthetic problems being generated. Mr. Carlton stated that hadn't been discussed but the area is zoned commercial and is guided for long-term commercial uses. He indicated construction of the truck storage would take place late 2018 and county construction of a dedicated right tum lane would take place around 2020. Commissioner Thiel stated he felt the street would be minimally used due to it being guided for more commercial use. Moved by Commissioner Larson -Vito and seconded by Commissioner Feinstein to recommend approval of the Preliminary Plat of New Resources Addition as outlined in the staff report with the addition of the following condition: Execution of a development/land swap agreement between the City of Elk River and New Resources, LLC outlining timing and responsibilities of the land exchange, to the satisfaction of both parties. Motion carried 5-0. Moved by Commissioner Larson -Vito and seconded by Commissioner Thiel to approve the Conditional Use Permit for a truck storage, maintenance, and repair facility, with the following conditions: 1. The authorized Conditional Use Permit will not be recorded until the associated Zone Change and Plat have been recorded. 2. Building permits for the described work will not be issued until the Conditional Use Permit is recorded. 3. If the proposed work described in the application and Conditional Use Permit has not been substantially completed within two years after the Conditional Use Permits date of issuance, the permit shall expire and become void. E IEAAZURE Planning Commission November 28, 2017 Page 4 4. If the authorized use ceases for more than six months, the Conditional Use Permit shall expire. 5. The applicant must apply for and receive approval for all required permits before any construction may begin. 6. Curbs at abandoned driveways on Proctor Road shall be replaced with concrete barrier style curbing. 7. The site will need to comply with Chapter 57 of the MN State Fire Code. 8. Submittal of a lighting plan demonstrating compliance with Sec. 30- 937 of the city code. 9. Submittal of an updated landscaping plan demonstrating compliance with Sec. 30-934 of the city code. 10. Submittal of an updated site plan including the location of trash facilities and demonstrating screening sufficient to satisfy Sec. 30-905 of the city code. Motion carried 5-0. 5.1 General Business There was no general business. 6.1 City Council Liaison Update Councihnember Wagner stated she will work with staff to discuss her thoughts and potentials solutions regarding the Weimnann variance. 7.
