Request
The applicant is requesting that certain drainage, utility and sidewalk easements be vacated in
plats of Elk River Crossing and Elk River Business Park.

Background
As the Council is aware, the final plat of Elk River Crossing 6th Addition was approved at the
February 22, 2005 City Council meeting. This plat reconfigured Lot 1, Block 3 of Elk River
Crossing and Lot 1, Block 1 of Elk River Business Park into two new lots to accommodate
Maxsun Furniture and Tractor Supply. Five-foot drainage and utility easements are located
along the common boundary between the lots on the original plats and a 10-foot sidewalk
easement crosses Lot 1, Block 3 of Elk River Crossing.
Analysis
In order to allow construction of the Maxsun Furniture building, the sidewalk and its
easement need to be relocated to the new westerly property line and the easements along the
old common property line need to be vacated. New easements appropriate to the site will
be dedicated on the plat of Elk River Crossing 6th Addition. A separate sidewalk easement

will need to be recorded after the plat is filed for the relocated sidewalk along the west
property line.
The City Engineer has reviewed the legal descriptions of the easements and has determined
that they are correct.
Recommendation
Staff recommends that the City Council approve the request for the easement vacation with
the following condition:
I. THE APPLICANT SHALL GRANT AND RECORD A SIDEWALK
EASEMENT OVER LOT 2, BLOCK I, ELK RIVER CROSSING 6TH
ADDITION.

A RESOLUTION FOR VACATING DRAINAGE, UTILITY AND SIDEWALK
EASEMENTS
Case No. EV 05-03
WHEREAS, the property owner abutting the drainage, utility and sidewalk easements has
requested the City Council in a petition February 24, 2005 to vacate such
easements according to law; and,
WHEREAS, a public hearing was held on March 21, 2005, before the City Council at the
Elk River City Hall on such petition after due published and posted notice
had been given as well as personal notice to affected property owners on
March 11, 2005 and all persons interested were given an opportunity to be
heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve such
petItiOn.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the drainage, utility, and sidewalk easements described as follows are hereby
vacated:

TO RESOLUTION FOR VACATING DRAINAGE, UTILITY, AND SIDEWALK
EASEMENTS
Sidewalk/Trail Easement:
A 10 foot perpetual easement for trail purposes over, under and across Lot 1, Block 3, Elk
River Crossing, according to the recorded plat thereof, Sherburne County, Minnesota.
Commencing at the southeast corner of said Lot 1; thence North 89 degrees 45
minutes 06 seconds West, assumed bearing, a distance of 342.04 feet along the south
line of said Lot 1 to the point of beginning of the line to be described; thence North
o degrees 23 minutes 18 seconds West a distance of 194.57 feet to the northerly line
of said Lot 1.
The west line of said easement shall be prolonged or shortened to terminate on said north
and south lines of Lot 1.
Drainage and Utility Easements:
The 5.0 foot Drainage and Utility Easement adjoining the south line of line of Lot 1, Block
3, as dedicated in ELK RIVER CROSSING, Sherburne County, Minnesota, according to
the recorded plat thereof.
The 5.0 foot Drainage and Utility Easement along the north line of Lot 1, Block 1, as
dedicated in ELK RIVER BUSINES PARK, Sherburne County, Minnesota, according to
the recorded plat thereof, the north line of which is described as beginning at the northeast
corner of said Lot 1; thence west along the north line of said Lot 1 a distance of 498.84 feet
and said line there terminating.
The Drainage and Utility Easement across that part of Lot 1, Block 3, as dedicated in ELK
RIVER CROSSING, Sherburne County, Minnesota, according to the recorded plat thereof
which lies east of a line described as follows:
Commencing at the southeast corner of said Lot 1; thence on an assumed bearing of
North 89 degrees 45 minutes 06 seconds West along the south line of said Lot 1 a
distance of 342.04 feet to the point of beginning of the line to be described; thence
North 0 degrees 23 minutes 18 seconds West a distance of 194.57 feet to the north
line of said Lot 1 and said line there terminating.
