Request
Consider a request by William and Cheryl Freeburg to vacate a portion of right-of-way.
Location
The proposed easement vacation is located on the north side of Lot 2, Block 2 Elk River

Overview
The applicant is requesting that the City vacate a portion of a 60 foot wide service drive
right-of~way that is adjacent to their north property line. The service drive extends from
Industrial Boulevard to the east line of the applicant's property; it has not been constructed
across the front of their parcel. The applicant is planning to construct a building on the

property and would like to incorporate the vacated right-of-way as part of their
development. The proposed easement vacation will not affect access to the applicant's parcel
or adjacent parcels. This property and the adjacent property to the east will have access from
the portion of the service drive that has been constructed. If this easement vacation is
approved, the property will have 200 feet of frontage on County Road 1. However, there will
not be direct access from County Road 1 to the property.

Recommendation
Staff recommends that the City Council approve the attached Resolution No. OS-_
vacating a portion of the right-of-way of the Elk River Industrial Park service drive with the
following condition:
1. All comments of the City Engineer shall be addressed.

Dear Mr. Harlicker:
As requested, we have reviewed the proposed street right-of-way vacation request from Mr.
William Freeburg for the public right-of-way along the north frontage of Lot 2, Block 2, Elk
River Industrial Park. This is a plat that is over 30 years old and this particular piece of
public right-of-way has never been utilized for road purposes. Lot 1 and the adjoining Lot 2
have been in common ownership for some time. The owners are now proposing to sell off
Lot 2 to Mr. Freeburg. Mr. Freeburg is intending to place a small building on the lot with
the parking lot extending into the right-of-way area.
A review of the city utility systems indicates that there is a watermain loop running through
this street right-of-way. The applicant's drawing also shows two underground Qo/est
telephone cables, one of which is near the north side of the right-of-way and the other is
near the south side of the right-of-way. There may be other small utilities through this area
that we are unaware of. My suggestion would be to approve the vacation of the street right-
of-way conditioned upon this area being covered by a sirIlilar sized drainage and utility
easement. This would allow for the city watermain and other small utilities to remain in
place while allowing Mr. Freeburg to utilize this portion of the area for construction of
parking lot and landscaping, but no permanent building. If this recommendation is adopted,
one thing that Mr. Freeburg will need to be aware of is the amount of grading in this area so
that sufficient cover is maintained over the public watermain and other utilities in the area.

RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING STREET DRAINAGE AND UTILITY
EASEMENTS
Case No. EV 05-02
WHEREAS, the property owner abutting the street, drainage, and utility easement has
requested the City Council in a petition dated, February 18, 2005, to vacate
such easement according to law; and,
WHEREAS, a public hearing was held on March 21, 2005 before the City Council at the
Elk River City Hall on such petition after due published and posted notice
had been given as well as personal notice to affected property owners on
March 10, 2005 and all persons interested were given an opportunity to be
heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve such
petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the street, drainage, and utility easement described as follows is hereby
vacated:
