SR 03-21-2005 Item I 6.14. 13065 Orono Parkway Elk River, MN 55330 March 14, 2005 File: 824180]-0060 The Honorable Mayor and City Council City of Elk River 13065 Orono Parkway Elk River, MN 55330 RE: 2005 S1REET RECONSTRUCTION PROJECT Dear Council Members: In keeping with the schedule established in the feasibility study for the 2005 Street Reconstruction Project, we are recommending that the City Council adopt the following three resolutions at your meeting on March 21,2005. The first resolution approves the plans and specifications and orders the advertisement for bids. As discussed at the public hearing, it is our intention to bid the project in two separate contracts. The first contract would be for the sanitary sewer lining and the remaining street reconstruction, storm sewer and watermain work would be included in the second contract. Both of the bids would be received on Tuesday, April 12, 2005 so that they will be available forthe assessment hearing. The second resolution determines the cost to be assessed and orders the preparation of the assessment roll. The amount proposed to be assessed is $6,000 per residential equivalent unit. There are approximately 75 - 80 residential equivalent units contained within the project area. The final resolution determines the date of the assessment hearing which is scheduled for Monday, April 18, 2005. As indicated during the public hearing, staff will coordinate a "walk through" with the final set of plans through the affected neighborhoods prior to the assessment hearings. Such plans and specifications, a copy of which is attached hereto and incorporated herein by this reference, are hereby approved. 2. The City Administrator shall prepare and obtain the publication of an advertisement for bids for the making of the improvement pursuant to the attached plans and specifications. The advertisement shall be published once each week for three consecutive weeks, shall specify the work to be done, and shall state that the bids will be received by the City Administrator until 10:00 a.m. on Tuesday, April 12, 2005, at which time the bids will be publicly opened in the Council Chambers of the City Hall by the City Administrator and the Project Engineer and will then be tabulated for consideration by the City Council at a meeting thereof at 6:30 p.m. on Monday April 18, 2005 in the City Council Chambers at City Hall. No bids will be considered unless sealed and ftled with the City Administrator and accompanied by a cash deposit, cashier's check, bid bond, or certified check payable to the City Administrator in the amount of 5% of the amount of such bid. Schmidt, City Clerk S:\EngineerImprovProj\200S Improvement Projects\Pavement Rehab 200S\Resolutions\App plans&specs-order ad for bids.doc RESOLUTION 05- A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION DETERMINING ASSESSED COST OF IMPROVEMENT AND ORDERING PREPARATION OF PROPOSED ASSESSMENT ROLL IN THE MATTER OF STREET RECONSTRUCTION IMPROVEMENT OF 2005 WHEREAS costs have been determined for the 2005 Street Reconstruction improvement consisting of a contract price of $1,443,920, and expenses incurred or to be incurred by the City in the making of the improvement in the amount of $548,690.00, for a total cost of the improvement of $1,992,620.00. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. Based upon the City Assessment Policies, it is determined that the portion of this improvement to be paid by the City and not assessed to benefited properties is $1,506,620.00. 2. The portion of the cost to be assessed against benefited properties pursuant to the Elk River City Assessment Policies shall be $486,000.00. 3. The assessments shall be payable in equal annual installments and shall extend over a period of 7 to 10 years, the first of the installments to be payable on or before the first Monday in January, 2006, with interest at the rate of 5.75% per annum from the date of the adoption of the assessment resolution. 4. The City Administrator with the assistance of the Project Engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece, or parcel of land, without regard to cash valuation, as provided by law, and shall have available at the City Administrator's office a copy of the proposed assessment roll for public inspection. 5. Upon completion of the proposed assessment roll, the City Administrator shall notify the Council and schedule a public hearing upon the proposed assessment, causing notice of the hearing by publication and mail to be made at least two weeks prior to the hearing. Schmidt, City Clerk S:\EngineerImprovProj\200S Improvement Projects\Pavement Rehab 200S\Resolutions\Determ cost-order assessm roll. doc RESOLUTION 05- A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION ESTABLISHING THE DATE FOR THE ASSESSMENT HEARING FOR THE STREET RECONSTRUCTION IMPROVEMENT OF 20.05 WHEREAS, by a resolution passed by the Council on March 21, 2005, the City Clerk was directed to prepare a proposed assessment roll of the cost of the 2005 Street Reconstruction Improvement; and WHEREAS, the Clerk has notified the Council that such proposed assessment roll will be completed and ftled in the Clerk's office for public inspection by the appropriate time. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. A hearing shall be held on the 18th day of April 2005, 2005, in the City Hall at 6:30 p.m. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment.. 2. The City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and shall state in the notice the total cost of the improvement. The City Clerk shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than tWo prior to the hearings. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City of Elk River, except that no interest shall be charged in the entire assessment is paid within 30 days from the adoption of the assessment. The owner of any property may at any time thereafter pay to the City of Elk River the entire amount of the assessment remaining unpaid, with interest accrued to December 31 st of the year in which such payment is made. Such payment must be made before November 15th or interest will be charged through December 315t of the succeeding year. Passed and adopted this 21 st day of March 2005. Stephanie A.
