Action Requested
Adopt,by motion, a resolution approving Final Plat of Raspberry Ridge with the following conditions:
1. Staff approval of a complete application for a subdivision exemption combining the 16 feet of
land between the subject parcel and the Pheasant Run subdivision with PID 75-113-3202.
2. The final plat of Raspberry Ridge must be recorded immediately after the subdivision exemption
noted in condition number one.
3. A Development Agreement must be signed by the city and developer prior to releasing the final
plat for recording.
4. A Letter of Credit shall be provided to the city in the amount of 100% of the costs of the public
improvements.
5. Upon completion of all improvements and acceptance by the city, a security or warranty in a form
acceptable to the city engineer must be secured.
6. Development Plan shall be approved by the city engineer prior to issuance of building permits.
7. Surface Water Management Fee shall be paid for three lots at the rate applicable at the time the
final plat is released for recording. (currently$116 per lot).
8. Park Dedication Fee shall be paid for three dwelling units at the rate applicable when the
subdivision is released for recording. The 2018 rate is $1,425.93 per lot.
9. A 30-foot wide trail easement shall be recorded along the entire north side of Lot 1, Block 1.
10. All comments in the Stormwater Coordinator memo dated December 6, 2017, shall be addressed.
11. Any item or condition found indicating the site is likely to yield information important to pre-
history or history shall immediately be reported to the city. Further, the city reserves the right to
stop work authorized in its approval until the site is appropriately investigated and work is
authorized.
The Parks and Recreation Commission recommended a 30-foot wide trail be recorded along the
entire north side of Lot 1, Block 1. Based on prior approvals by the City Council and agreements
with the county, trails may be located in the 50-foot county right-of-way. Staff recommends this
condition be removed by the City Council.
Background/Discussion
The subject property is generally south of 2091h Avenue NW and west of Hoover Street NW. The
applicant will be subdividing approximately 13.5 acres of property to create four residential lots.

The subject property is zoned Rla (Single Family Residential) with minimum required lot sizes of 2 t/2
acres. The lots range in size between 2.51 acres to 4.15 acres and they meet all dimensional requirements
for the R1 zoning district. Road right-of-way will also be platted for 208I Court,Johnson Street, and
209I Ave (County Road 33). Johnson Street will not be constructed at this time.
There is a strip of land approximately 16-feet wide separating the subject parcel from the Pheasant Run
subdivision directly to the east. The applicant will be applying for a Subdivision Exemption (property line
ad)ustment) to absorb this strip of land into the proposed plat. Subdivision Exemptions are reviewed and
approved by staff. The recording of the Subdivision Exemption and the plat will need to be completed
simultaneously.
Comprehensive Plan
The property is guided for residential land uses outside of the Urban Service Area (i.e. not currently
served by municipal sewer and water). The predominant land use in this area is single family detached
homes. The proposal is consistent with the Comprehensive Plan.
Environmental
The north portion of the subject parcel is within the Shoreland Management District and will be subject
to hardcover restrictions and setbacks from Eagle Lake when development is proposed. A wetland
delineation may also be required before any earth moving work is approved. There are potential wetlands
on the south site of the property based on aerial reviews only.
Parks and Recreation Commission
The Parks and Recreation Commission recommended park dedication be in the form of cash and a 30-
foot wide trail easement be placed along the entire north side of Lot 1. The current plat is smaller in
scale than what the Parks and Recreation Commission recommend but the change does not require them
to re-review the proposal.
Applicable Regulation
Approval of a plat may only be ordered if the following findings are made, as outlined in Section 30-375:

Pith all requirements of this Code, including the honing regulations and this article.
The property is zoned R1-a (residential) and the proposed subdivision is consistent with the zoning
regulations outlined in the city code and approved plans.
2. The proposed subdivision is consistent Pith all applicable general and specialised city, county, and regional plans, including
but not limited to, the city's comprehensive developmentplan.
The proposed subdivision does not conflict with any city, county, or regional plans,including the
Comprehensive Plan.
3. The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and
siltation, susceptibility to flooding and drainage are suitable for the type and density of development and uses contemplated.
The site is suitable for the existing and proposed residential structures.
4. The proposed subdivision makes adequate provision for Pater supply, storm drainage, smage transportation, erosion control
and all other services,facilities and improvements other�a ise required in this article.

In reviewing the above standards,it appears the proposal meets all required standards for approval.
If denial of the plat should occur,it shall accompany recommendations or determinations by findings or a
report stating how the proposed use does not comply with the standards set forth in Section 30-375.

Action Requested
Recommend, by motion, park dedication for the plat of Raspberry Ridge be paid at the rate applicable
when the subdivision is released for recording with the following condition:
1. A 30 foot trail easement along the entire north side of Lot 1 shall be recorded.
This will equate to approximately $4277.79 in park dedication fees for three parcels.
Background/Discussion
The subject property is generally south of 209th Avenue NW and west of Hoover Street NW. The
applicant will be subdividing approximately 56 acres of property to create four residential lots.
Parks and Recreation Master Plan
The Neighborhood Parks Service Area text in Chapter 5 of the master plan states, recreation facilities should
be developed when 300 or more households within cluster developments or on lots less than 2 acres are located within 1.5
miles of the park. The subject property does not meet this requirement. Therefore, staff recommends the
Parks and Recreation Commission recommend Park Dedication be in the form of cash.
Trail Connectivity, as indicated in the master plan, indicates “Other Future Trails” are desired along
209th Avenue along the north side of the property. Staff recommends a 30 foot trail easement be placed
along the entire north side of Lot 1.

WHEREAS, application has been made for final plat approval,pursuant to Section 30-391
of the Elk River City Code of Ordinances, of the property legally described on attached
Exhibit A and hereinafter referred to as "the Property"; and
WHEREAS, the proposed final plat complies with each of the conditions set forth by the
City Council in its approval of the plat of the Property;
NOW, THEREFORE, BE IT RESOLVED
1. It is hereby determined by the City Council for the City of Elk River as follows:
A. The proposed subdivision is consistent with the Chapter of 30 of the City
Code of Ordinances and conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general and
specialized city, county, and regional plans including,but not limited to, the

3. The officers of the City are hereby authorized, once the conditions set forth in
Exhibit B are met and complied with, to sign the final plat for the Property and to
issue a certified copy of this Resolution giving final approval of the plat.
4. The owner of the Property is authorized to record the final plat as required by law
and shall file proof of said recording with the City. No building permits will be
issued for the Property until the final plat is recorded.
5. This final plat approval shall expire two years from the date of this resolution if the
final plat is not recorded within that time.
