Request by City of Elk River to Amend Sections 30-1023, 30-
80 I, 30-938 and 30-2021.
Request
The City of Elk River is requesting ordinance amendments to these sections: Section 30-
1023: C-2 Office District; Section 30-801: Home Occupations; Section 30-938: Architectural
Standards; Section 30-2021: Lot Area and Width Standards.

Analysis
Section 30-1023: C-2 Office District
The C-2 zoning district allows single-family dwellings as a Conditional Use. The ordinance
indicates setbacks for Accessory Buildings in the C-2 district but Accessory Buildings are not
allowed. Staff is proposing to allow Accessory Buildings as a Conditional Use in the C-2
district.
Section 30-801: Home Occupations
As a result of the recent application for a hair salon as a home occupation and the concern
of chemicals on the shared septic system, staff is proposing that all Home Occupations
obtain written permission from the Home Owners Association, when one is present. This

will be required for both Permitted Home Occupations as well as Conditional Use Home
Occupations.
Requiring written permission for all Home Occupations will provide a mechanism to the
Home Owners Association that a dwelling in their association is running a business. It also
coordinates communication between the City, applicant and the Association.
Section 30-938: Architectural Standards
This is basically a "housecleaning" amendment as this section is referred back to by other
sections and is outdated. The proposed language now deals with building/roofing materials
for the C-l, C-2, C-3, 1-1 & 1-2 districts.
Section 30-2021: LotArea and Width Standards
The City has adopted a shoreland ordinance that regulates lot sizes, lot widths and lot areas
for properties adjacent to lakes, rivers and streams within the city limits. During its adoption
the lot width and area requirements for properties adjacent to natural environment lakes
were not included in the version that was adopted by the City. They are, however,
established by the State shoreland standards, which were created in 1989.
This correction was attempted in 2001, but the requirements did not get included in the
recodification of the ordinance.
Recommendation
Staff recommends that the Planning Commission recommend approval of the proposed
changes to Sections 30-1023, 30-801, 30-938 and 30-2021.
