02-25-1991 CC MIN e e e MEETING OF THE ELK RIVER CITY COUNCIL HELD AT THE ELK RIVER PUBLIC LIBRARY MONDAY, FEBRUARY 25, 1991 MEMBERS PRESENT: Councilmembers Dietz, Kropuenske, Schuldt and Holmgren MEMBERS ABSENT: Mayor Tralle (Out of town on vacation) STAFF PRESENT: Pat Klaers, City Administrator; Stephen Rohlf, Building and Zoning Administrator; Janelle Szklarski, Zoning Assistant; Sandra Thackeray, City Clerk; Mick Stoffers, Librarian 1. Call Meetinl to Order Pursuant to due call and notice thereof, the meeting of the Elk River City Council was called to order by Vice Mayor Schuldt at 7:00 p.m. 2. Consider 2/25/91 Council Ale:pda Item 8.1 - Food Month Proclamation was added to the agenda. COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE 2/25/91 COUNCIL AGENDA. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. 3.1. Consider 2/13/91 City Council Minutes It was noted that the minutes should reflect the meeting date as Wednesday. It was also noted that a name was misspelled on pages 4 and 5 and the correct spelling is (Herrboldt). COUNCILMEMBER KROPUENSKE MOVED TO APPROVE THE 2/13/91 COUNCIL MINUTES AS AMENDED. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. 3.2. Consider 2/13/91 Council Minutes COUNCILMEMBER KROPUENSKE MOVED TO APPROVE THE 2/13/91 COUNCIL MINUTES. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. 4. Open Mike No one appeared for this item. 5.1. Con!iLder Transient Merchant License/8obertMadla!l...Q Vice Mayor Schuldt stated that Robert Madland is applying for a renewal of his transient merchant's license. Mr. Madland has had a transient merchant's license in Elk River for the past several years. City Clerk, Sandy Thackeray indicated that Mr. Madland is requesting to sell flowers on holidays and weekends on property owned by Martin Plaza and Beaudry Oil. City Council Minutes February 25, 1991 Page 2 . Vice Mayor Schuldt opened the public hearing. There being no one for or against the matter, Vice Mayor Schuldt closed the public hearing. COUNCILMEMBER KROPUENSKE MOVED TO APPROVE A TRANSIENT MERCHANT LICENSE FOR ROBERT MADLAND ALLOWING HIM TO SELL FLOWERS ON WEEKENDS AND HOLIDAYS IN THE CITY OF ELK RIVER. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. 5.2. Old City Hall Update The City Administrator reviewed the memo from Phil Hals regarding the demoli tion of Old City Hall. The City Council discussed the details regarding the process and timetable for the demolition of the old city hall. The City Administrator indicated that this project would receive further discussion at an April or May Council meeting. 5.3. Pay Estimate #1. Rip Rap Project COUNCILMEMBER DIETZ MOVED TO APPROVE PAY ESTIMATE #1 FOR THE RIP RAP PROJECT ALONG THE MISSISSIPPI RIVERBANK TO VEIT AND COMPANY, INC. IN THE AMOUNT OF $26,386.24. COUNCILMEMBER KROPUENSKE SECONDED THE MOTION. THE MOTION CARRIED 4-0. 5.4. Resolution Approving Notice oJ Publication for OrdLIL8JJce_..]1-2 e Vice Mayor Schuldt indicated that the Council recently approved an ordinance allowing a franchise agreement between Anoka and Elk River electric utili ties. He indicated that because of the length of the ordinance a summary would be published. COUNCILMEMBER KROPUENSKE MOVED TO ADOPT RESOLUTION 91-10 A RESOLUTION APPROVING NOTICE OF PUBLICATION OF ORDINANCE 91-2. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. 5.5. Set Public Hearin~ate to AmeniLLIY_EllUb"LJ_l.l.!lfL-1 COUNCILMEMBER KROPUENSKE MOVED TO SET APRIL 15, 1991, AS THE PUBLIC HEARING DATE TO CONSIDER AMENDMENTS TO TIF PLANS #1 AND #3. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. 6.1. Consider Floodplain Management Ordinance/Public Hearing Janelle Szklarski I Zoning Assistant, indicated that the City's Floodplain and Shoreland Ordinances must be amended as mandated by the Federal Emergency Management Agency and the Minnesota Department of Natural Resources. She indicated that the Zoning Department has drafted an ordinance which reflects the necessary requirements by the Federal Emergency Management Agency and the Minnesota Department of Natural Resources. e Vice Mayor Schuldt opened the public hearing. There being no one for or against the matter, Vice Mayor Schuldt closed the public hearing. City Council Minutes February 25, 1991 Page 3 e COUNCILMEMBER KROPUENSKE MOVED TO ADOPT ORDINANCE 91-4, AN ORDINANCE AMENDING SECTION 902, THE FLOODPLAIN MANAGEMENT ORDINANCE. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. 6.2.Planning Commission Update Stephen Rohlf, Building and Zoning Administrator, indicated that the Planning Commission has been discussing the regulation of cluster home developments and adult oriented land uses. He relayed the Planning Commissions thoughts on these two issues. 6.3. Easement VacatiQn Correction Iraj Ezati Janelle Szklarski stated that the Council previously granted an easement vacation for Iraj Ezati, however, there was a typographical error in the legal description at the time of recording. She indicated that a new resolution must be adopted and rerecorded with the correct legal description. COUNCILMEMBER KROPUENSKE MOVED TO ADOPT RESOLUTION 91-11, A RESOLUTION FOR VACATING A PORTION OF A DRAINAGE EASEMENT. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. 6.4. Qther e Stephen Rohlf indicated that the Elk River Landfill has invited the Ci ty Council and Planning Commission to tour the landfill facili ty. The Council concurred that they would tour the facility in the spring. 7.1. Librarv Board Annual Report Mick Stoffers presented the 1991 Library Annual Report to the City Council. Discussion took place regarding the need for an expansion to the library due to the limited space. The Council questioned the practical i ty of expanding when there is already a shortage in parking. It was suggested that the Library Board consider acquiring more property or to check into the parking needs and requirements prior to expanding. Discussion was also held regarding the funding of the expansion. The Council suggested that the Library Board seek contributions for the project. 7.2. Fire Departm~nt R~nQrt/R!Jss Ande.l'-B9n The Fire Department Report was not presented. 8.1. CAER Procla~ation e Vice Mayor Schuldt indicated that Elk River CAER is working together with Minnesota Food Share to raise money and food donations to stock food shelves in Minnesota during the month of March. Vice Mayor Schuldt signed a proclamation which will he gj ven to CAER proc laiming March as Minnesota Food Share Month. . e .
