Call Meetin~ To Order Pursuant to due call and notice thereof, Vice Mayor Schuldt called the meeting to order at 7:00 p.m. 2. Consider 11/6/91 City Council Agenda COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE 11/6/91 CITY COUNCIL AGENDA. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. 3. Countv State Aid Highway II Assessment Public Hearing Terry Maurer, City Engineer, reviewed the project. He indicated that the proj ect consists of sani tary sewer, water, street and storm sewer. He stated that the assessment hearing is only for the sanitary sewer improvement because the School District has waived their rights to al'lh-~al Lhe remaining i mpr'ovp.ments. Tlw sHnl tary sewer is the only part of the project that is being assessed to property owners other than the School District. Terry Maurer reviewed the estimated project cost. He indicated that the estimated project cost comes to a total of $595,743.36, which includes 28% overhead, administration, engineering and legal fees. Terry Maurer indicated that the sewer improvement is being assessed at a ['ate of $1,596 per acre and that there are a total of 198.80 acres in the assessment area. He indicated that the City has received two assessment appeals; one from Bill Brady and another from John Oliver. Terry Maurer indicated that Mr. Oliver is objecting to the amount of acreage stated on his assessment notice. He stated that Mr. Oliver's computation shows that the parcel contains 5.42 acres, not 5.97 acres which is stated by the City. He further indicated that the acreage also includes a 66 foot easement and also that Mr. Oliver is objecting being assessed for the gross acreage because 1.21 acres is to be used for the roadway system constructed to access the school. Terry Maurer recommended that the City Council consider reducing the total aDJOllnt of acres for Mr. Oliver to 4.21 acres. City Council Minutes November 6, 1991 Page 2 . Vice Mayor Schuldt opened the public hearing. Mr. Brady questioned whether the Council would discuss his appeal. Mr. Brady indicated that he has no current plans to develop his property or to use sanitary sewer facilities which are being constructed. He questioned why the City was requiring him to pay an assessment to bring utilities to his property when he did not request it. Mr. Brady also indi cated that there are also other areas wi thin that sewer district that are not being required to hook up or pay assessments at this time. He stated he wanted to be treated the same as those areas and not be required to hook up to sewer until he requests it. The City Administrator explained that the other parcels of property are in a different situation as they will need a trunk line extended to thei I' property when they develop the property. He indicated that the Brady's property will not need a trunk line extension as this is the project being proposed at the present time. Vice Mayor Schuldt noted that both Brady and Oliver had submitted letters of appeal. Mr. Jim Nord, 19806 Elk Lake Road, requested that his assessment be based on a ten year term as opposed to a five year term. There being no further comments, Vice Mayor Schuldt closed the public hearing. . COUNCILMEMBER HOLMGREN MOVED TO ADOPT RESOLUTION 91-64, A RESOLUTION ADOPTING THE FINAL ASSESSMENT ROLL FOR COUNTY STATE AID HIGHWAY #1 ELEMENTARY SCHOOL PRO,JECT INCLUDING THE REDUCED ACREAGE OF 4.1 ACRES FOR THE OLIVER PROPERTY AND THAT THE ASSESSMENT TERM FOR ALL OF THE NORD PROPERTY RUN FOR TEN YEARS. COUNCILMEMBER KROPUENSKE SECONDED THE MOTION. THE MOTION CARRIED 4-0. Pat Klaers, City Administrator, reviewed the assessment appeal process. The Council recessed at 7:35 and reconvened at 7:45. 4. Zack .Johnson and Kevin Conley, EOS Architecture, were present to review the City Hall/Police Station Facility plans. Invited to hear this review was the Community Center Task Force, the Economic Development Authority, the Planning Commission, Utili ties Commission and Park and Recreation Commission. Zack Johnson gave a review of how the plans have evolved to this point. Zack Johnson indicated that Kevin Conley would be reviewing Phase I of the plan which includes the City Hall and Po Ii ce Station. He indicated that the overall plan would include the community center complex which was discllssed and proposed by the Communi ty Center Task Force. He stated that this project COll ld take place within a ten to fifteen year period. . Kevin Conley reviewed the site plan and the time frame for the project. He reviewed the site development for the future master plan. Kevin a] so reviewed the exterior views and floor plan of the City Hall/Pol ice Station faei Ii ties. Terry Maurer, City Engineer, reviewed the proposed improvements in that area which includes the realigning of Ol~onn Road, the extension of City utilities over Orono bridge and the . . . City Council Minutes November 6, 1991 Page 3 replacement of the dam bridge. Kevin Conley indicated that the total building project cost is $2,225,000. The Counci 1 then proceeded to answer questions from the public. The main discussion revolved around the homeowners questions regarding the plans. The homeowner questioned why the general publ ic has been un informed of the progress and had many questions regarding the reason for placing a police facility in a residential neighborhood. Also discussed was the extension of Orono Road and future north/south road extensions from Orono Road. The main concern was the amount of traffic that would be created by a north/south road ~xtension through their neighborhood. The City Administrator explained that the public will be invited to an informational hearing some time in the future. He further indicated that the City will be going through zoning processes which will include platting and conditional use permits. He stated that during these processes, public hearings would be held and those people located within 350 feet of the project would be notified in writing. 5.
