01-29-1990 CC MIN ~ MEETING OF THE ELK RIVER CITY COUNCIL HELD AT THE ELK RIVER CITY HALL MONDAY, JANUARY 29, 1990 MEMBERS PRESENT: Mayor Tralle, Councilmembers Schuldt, Holmgren, Dobel, and Kropuenske MEMBERS ABSENT: None STAFF PRESENT: Pat Klaers, City Administrator; Lori Johnson, Finance Director; Stephen Rohlf, Building and Zoning Administrator; Sandy Thackeray, City Clerk; Shannon McCambridge, Personnel Consultant 1. Call Meetin~ to Order Pursuant to due call and notice thereof, the meeting of the Elk River City Council was called to order by Mayor Tralle at 7:05 p.m. 2. THE MOTION CARRIED 5-0. 3. Con~ider 1/22!9_Q.-9JtL_.c_QJ.LlJ.~XL}fiJ}J!te~ Councilmember Schuldt stated that the second to the last paragraph on page 2 should have the following sentence added: "Councilmember Schuldt stated he would be in favor of allowing a model home for a six month period with no time extension granted after the 6 months expired." COUNCILMEMBER DOBEL MOVED TO APPROVE THE JANUARY 22, 1990, CITY COUNCIL MINUTES AS AMENDED. COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION CARRIED 5-0. 4. Open Mike No one appeared for this item. 5.1. pondi tional J.Jse Permits and Ligense .R~newals_-PY__N._SE-__l!:!Ld.__U.PA!fl!JbJJG BeariD~ Steve Rohlf, Building and Zoning Administrator, indicated that every two years NSP and UPA are required to renew their licenses and condi tional use permits with the Ci ty and that these licenses and conditional uses are up for renewal. Mr. Rohlf informed the Council that the Planning Commission and City Staff are both recommending that the City Council grant temporary extensions to the licenses and conditional use permits for both NSP and UPA. Page 2 until the end of April at which be completed and the results Mayor Tralle indicated that he had received complaints and concerns regarding odor and noise from the UPA plant. He stated that one individual felt that the odor may be coming from the City's Waste Water Treatment Plant instead of the RDF Plant. Mayor Tralle requested Staff to investigate this possibility and further requested that if the odor was coming from the City's WWTP, that something be done to eliminate the odor. Mayor Tralle opened the public hearing at this time. Mr. Glen Kass, Plant Superintendent of the RDF facility, stated that they would like to request that the Council consider that the condi tional use permit and license be changed to allow the hauling of residue on Sundays. He stated that right now the residue ends up sitting in the trucks over the weekends. Mr. Kaas further indicated that they have had complaints from Cargill Farms regarding debris. He stated that as soon as they receive a complaint they send someone out to clean it up and, in fact, they are considering hiring a company to clean up the area on a consistent basis. There being no further comments from the public, Mayor Tralle closed the public hearing. COUNCILMEMBER KROPUENSKE MOVED TO EXTEND THE CONDITIONAL USE PERMITS AND LICENSES FOR BOTH UPA AND NSP UNTIL APRIL 30, 1990. COUNCILMEMBER DOBEL SECONDED THE MOTION. THE MOTION CARRIED 5-0. The Council discussed the number of fire calls to the RDF Plant and also the intensity of the fires. Mr. Kaas indicated that a majority of the fires are just smoke or flames. Councilmember Holmgren raised the question regarding an explosion that took place at the RDF Plant. Mr. Kaas also informed the Council that an explosion involving aerosol cans did take place on 1/22/90 at the NSP Plant. Councilmember Schuldt indicated that the Council has received a complaint from Garbage haulers regarding the time they have to wait at the plant to dump their loads. Mr. Kaas indicated that there are certain times during the week that are more congested than others. Mayor Tralle thanked NSP and UPA for the update on the facilities and encouraged them to keep the City informed of the operations. 5.2. R~solution t~px.ove Te!!!.pQ.rary Expansion for Model Home Steve Rohlf, Building and Zoning Administrator, indicated that the Council addressed Mr. Terry Lee's request to allow a model home in the " City Council Minutes January 29, 1990 Page 3 Pinewood Subdivision at the January 22, 1990, Council Meeting. He further indicated that the Council authorized staff to draft a resolution allowing a model home by Terry Lee Realty and Homes on Lot 6, Block 1, Pinewood Subdivision, for a six month period. COUNCILMEMBER DOBEL MOVED TO ADOPT RESOLUTION 90-4, A RESOLUTION ALLOWING A MODEL HOME IN PINEWOOD SUBDIVISION FOR TERRY LEE REALTY AND HOMES. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0. 5.3. Qther Steve Rohlf, Building and Zoning Administrator, indicated that he has received a complaint regarding the lack of lighting at the intersection of Tyler and County Road 13. After discussion by the Council, a motion was made to install a light at the corner of Tyler and County Road 13. COUNCILMEMBER HOLMGREN MOVED TO INSTALL A STREET LIGHT AT THE CORNER OF TYLER STREET AND COUNTY ROAD 13. COUNCILMEMBER KROPUENSKE SECONDED THE MOTION. THE MOTION CARRIED 5-0. Mayor Tralle requested that City Staff and Police Department Personnel be requested to report dark intersections in the City. The Council took a 5 minute recess at 7:55 p.m. 6. 1. R~yJew _PrQPos~.d.J.'~.rsonnel Q.r.d.ilH!:D.ge The City Administrator introduced Shannon McCambridge, the City's Personnel Consultant. Ms. McCambridge indicated she has been working with Staff in redrafting the City's Personnel Ordinance. She stated that she has divided the Ordinance into five sections: Administrative Organization; City Service; Employee Benefits; Personnel Policies; and Miscellaneous. The City Council and Staff proceeded to discuss the proposed Personnel Ordinance. The Ordinance was reviewed page by page. 'l'he ma,iori ty of the discussion revolved around the following topics: Gpmp Time The Council discussed the rate at which comp time could be accumulated. The Council agreed with the proposed ordinance that no more than 40 hours of comp time shall accumulate from year to year. VacatioT! The Council discussed the rate of accumulation for vacation and the rate of accrual. Councilmember Holmgren indicated that the proposed ordinance allowing the carryover of an equal amount to the total number of enti tIed vacation days from one year to the next was too lenient. It was suggested that 50% of the allowable accumulated ~ City Council Minutes January 29, 1990 Page 4 vacation be carried over from year to year. Lori Johnson stated that because of the way vacation time is earned, employees would be unable to take even a two week vacation in the first several months of each year because they would not have accumulated enough hours unless they were allowed to carryover sufficient vacation time from the previous year. After further discussion, the Council concurred with Ms. Johnson. SiQk Ti!De The use of sick time and the accumulation rate of sick time was discussed. Mayor Tralle indicated that the City's current policy of 12 accumulated sick days per year was too lenient. The Council discussed the use of sick time for caring for sick children and whether it would be better to use personal leave days for this type of occurrence. Discussion was also held regarding whether the City should allow for family emergency days. It was the consensus of the Council to have staff research this matter further and bring the matter back to the Council at a later date. It was the consensus of the City Council to allow Staff and consultant to further revjew the proposed personnel ordinance and to consider further options in sections of the ordinance and then return the item to the City Council at a future date. 7. Oth~r Business Mayor Tralle reviewed with the Council the Planning Commission Rules and Procedures. He indicated that he was unsure as to whether the Planning Commission had the authority to authorize the Rules and Procedures. He further indicated that the Planning Commission is an advisory board and that they should not be adopting their own rules and procedures, but that they should be recommending them to the Council for Council consideration. Mayor Tralle also commented on the work schedule which the Planning Commission has laid out for the Building and Zoning Department. He indicated that he is uncertain if this is the job of the Planning Commission. He stated that the Building and Zoning Department is not just responsible to the Planning Commission. He commented on the ambitiousness of the schedule and the fact that accomplishment of the schedule will require more money than has been budgeted and further that the City Council is responsible for the City Budget. After discussion by the Council regarding these items, it was the consensus that the Mayor will meet with the Planning Commission Chair in order to discuss these matters, and that if the need arises, the Chair will meet with the Council to clarify the Planning Commission's intentions. 9. Adjournment There being no further business, COUNCILMEMBER DOBEL MOVED TO ADJOURN THE MEETING OF THE ELK RIVER CITY COUNCIL. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0.
