03-13-1989 CC MIN MEETING OF THE ELK RIVER CITY COUNCIL HELD AT THE COMMUNITY ROOM MONDAY, MARCH 13, 1989 e Members Present: Vice Mayor, Gene Schuldt; Councilmembers, Kropuenske and Holmgren Members Absent: Mayor, Jim Tralle; Councilmember, Dobel Staff Present: City Administrator, Pat Klaers; City Engineer, Terry Maurer; Street Superintendent, Phil Hals; Building Zoning Administrator, Steve Rohlf and City Attorney, Tim Keane 1. Pursuant to due call and notice therof, the meeting of the Elk River City Council was called to order at 7:00 p.m. by Vice Mayor Schuldt. 2. Consider 3/13/89 City Council Agenda COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE 3/13/89 CITY COUNCIL AGENDA. COUNCILMEMBER KROPUENSKE SECONDED THE MOTION. THE MOTION CARRIED 3-0. 3. Consider 3/6/89 City Council Minutes COUNCILMEMBER KROPUENSKE MOVED TO APPROVE THE 3/6/89 CITY COUNCIL MINUTES. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 3-0. e 4. Public Mike Robert Bischoff presented the Council with a letter regarding the Elk River Community Theater. He explained that the Elk River Community Theater has been honored to host the Minnesota Association of Community Theaters Festival '89. one act play competition on April 7. 8. & 9. He stated he is looking for representatives of the City to help usher and assist the audience during this event and requested the Council to assist. The Council indicated they would get back to Mr. Bischoff within a week with their answer. e 5.1 Knollwood Improvements/P.H. 5.2 Tyler Street Improvements/P.H. Terry Maurer. City Engineer. indicated that a feasibility study for Tyler Street was presented to the City Council in April. 1985. He indicated that the project did not proceed because of the extensive right-of-way acquisition needed to construct the project. Mr. Maurer explained that the public hearing tonight was to receive public input on the proposed projects and to determine whether the City Council should order the preparation of plans and.specifications for Tyler Street improvements and Kno11wood improvements. He stated that a public hearing had been held for improvements in the Knollwood area in July. 1986. however. there were objections raised by residents in the area stating that the overlay was not necessary. The Council did not order the project at that time. Mr. Maurer explained that as the Council has authorized a feasibility study for Tyler Street improvements. they have also determined that the Knollwood area should be reanalyzed. He stated that the streets are badly worn and deteriorating and that it is not economical to continue patching these streets. Mr. Maurer also noted that by combining the two projects, the City would be able to get a better price from the contractors. e e e Page 2 City of Elk River City Council Minutes March 13. 1989 The City Engineer explained that the City is proposing a 9 ton design urban section with concrete curb and gutter on the south segment and a 1~ inch bituminous overlay on the north segment of Tyler Street. He indicated that the construction of the south segment between County Road 13 and 197th Avenue would be eligible for MSA funding as this part of the street is being constructed to MSA standards. He noted that the total estimated proj ect cost. for Tyler Street is $447.300 and stated that MSA Funds would contribute $280.000 to the project. He stated that the City is proposing that platted single family lots would be considered one unit and further that one unit would be charged $1500 for the street construction. Mr. Maurer stated that the properties along the south segment of Tyler Street are agricultural or large rural lots and the City is recommending that the assessments for these areas be based on a unit basis and that 300 feet of frontage would be equivalent to one unit. Mr. Maurer explained that the proposed improvements for Knollwood consist of a 1~ inch bituminous overlay of the existing streets within the Knollwood area. He stated that the estimated construction cost is $86.200 and that the assessments would be charged on a per unit basis with an estimated cost of $1.150 per unit. Mr. Maurer then proceeded to go over the project schedule for both Knollwood and Tyler projects. Vice Mayor Schuldt opened the public hearing at this time. Jean Mord - 10906 202nd Avenue - questioned how long of a guarantee the citizens would have on the overlay in Knollwood as the overlay is only going to be 1~ inches thick. Mr. Lindquist 10643 203rd Avenue - indicated that as far as he could tell there has been no maintenance on the roads in Knollwood and stated he is concerned about overlaying roads that are in poor condition instead of redoing the roads. Dale Jacobson - 19613 Ulysses - indicated that Ulysses between 195th and 197th Avenue had been overlayed approximately 8 to 10 years ago and does not feel the road is in bad shape or in need of another overlay. John Bakos - 19718 Tyler Street - indicated that he owns a corner lot on Tyler Street and questioned the City's policy on assessing corner lots. City Engineer indicated that he would receive only one assessment; the highest assessment of the two roads. Jan Willet - 19741 Ulysses - questioned why the City was assessing people who abut the streets when everybody uses the roads. She further questioned why the tax dollars do not take care of overlaying the roads. Wayne Kellar - 19612 Tyler Street - indicated there is a large ravine by his driveway and stated that much planning will have to be done in that area on Tyler Street when the road is improved. The City Engineer indicated that he will be working closely with Mr. Kellar if the project is ordered. Bill Weatherly 19885 Tyler Street questioned what the Engineer proposed to do with the storm water runoff. Page 3 City of Elk River City Council Minutes March 13. 1989 e -------------------------------------- Bill Harju lots. 10733 201st Circle - also questioned the policy on corner Mr. Max Maue - 19215 Tyler Street - stated that some of the larger land owners are being taxed for one parcel of land and are not allowed to subdivide their lots. He stated that it is unfair that the City assess these property owners for more than one unit. Howard Dolson - 19030 Twin Lakes Road - stated that if parcels can not be divided by the City then they should be assessed for only one parcel. He stated that he agreed with Mr. Maue. Dave Burrandt - 19118 Tyler Street - questioned whether the north end and south end of Tyler Street would be aligned. He further questioned the number of parcels he is proposed to be assessed for and also indicated that he would rather not see concrete curb and gutter in the area. Mr. Wally Fox 19508 Ulysses - indicated to Mr. Maurer that there is plastice under the pond in the area. Mr. Fox also questioned whether the speed limit would be reduced on Tyler Street as it will be an urban road. Mr. Keith Quammen 19823 Ulysses Street - questioned what the overall width of the street would be when it was completed. e Herb Clausen - Twin Lakes Road - questioned the number of units he would be assessed for. He stated that he did not feel the assessment was fair and stated that he would not give the City any land or right-of-way for the widening of Tyler Street. Kari Nielson - 19796 Tyler Street - questioned why the City was proposing curb and gutter for Tyler Street when there currently is no curb and gutter in that area. Mr. Mike Wirtz - 20020 Tyler Street - questioned when the City's policy went into effect requiring curb and gutter in plats. Mr. Dan Minch 10754 201st Circle - questioned what the interest rate would be on the assessment. Mary $1150 paying gutter. Eberley 20204 Smith Street - questioned the equity of charging for an overlay on Smith Street while Tyler Street residents were $1500 per unit and receiving a reconstructed street with curb and Mr. Don Heitland Tyler Street questioned what the speed limit requirement would be when Tyler Street was reconstructed. Mike Arnold - Smith Street - questioned whether there was any chance of Smith Street receiving curb and gutter. e Mr. Lindquist 203rd Avenue questioned what type of preventative maintenance the roads would receive once they were overlayed. e e e Page 4 City of Elk River City Council Minutes March 13. 1989 -------------------------------------- Mr. Ron Harrington 19728 Ulysses - questioned the section of Ulysses from 200th Avenue south. He indicated that this area had been overlayed not too long ago. He questioned staff as to whether they could research and find out when this area was overlayed. He stated he did not feel it was necessary to overlay the road at this time. Vice Mayor Gene Schuldt closed the public hearing at this time. City Attorney. Tim Keane. indicated that because the projects are City initiated a 4/5 vote by the Council would be required. Due to the fact that only three members of the Council were present. Mr. Keane advised that the Council close the public hearing and take no action on the projects at this time. COUNCILMBMBER KROPUENSKE MOVED TO KNOLLWOOD IMPROVEMENT PROJECT. MOTION. THE MOTION CARRIED 3-0. CLOSE THE PUBLIC HEARING FOR THE COUNCILMEMBER HOLMGREN SECONDED THE COUNCILMBMBER HOLMGREN STREET IMPROVEMENTS. MOTION CARRIED 3-0. MOVED TO CLOSE THE PUBLIC HEARING FOR THE TYLER COUNCILMEMBER KROPUENSKE SECONDED THE MOTION. THE Vice Mayor Gene Schuldt indicated that the Council would make a decision on these two projects at the March 20. 1989 City Council meeting to be held at the Elk River Public Library. He indicated however. that the public hearing was closed and no public input would be received at that meeting. 5.3 City Engineer Update The City Engineer indicated that he has appeared before the Elk River Utilities Commission regarding the western area sewer and water project. He indicated that he has requested the Utilities Commission to contribute funds towards the project. Mr. Maurer indicated that he has not received a reply from the Utilities Commission at this time. however. they were going to discuss it at their next meeting. Mr. Maurer updated the Council on the Main Street bridge. He indicated that he was working with the Historical Society regarding this matter and he further stated that it is their hope that the Main Street bridge will be taken off the Historical Society's list so it will not impede the western area sewer and water project. Mr. Maurer updated the Council on the Waco Street bridge north of Highway #10. He indicated he was working on a cost estimate for the replacement of this bridge. Mr. Maurer indicated to the Council that he has prepared an application on behalf of the City regarding riverbank erosion. Mr. Maurer stated that he has submitted copies of the feasibility study of the Highway 169 & 193rd utilities projects to the two property owners. He indicated that he has not had a response from the property owners at this time. e e e Page 5 City of Elk River City Council Minutes March 13. 1989 -------------------------------------- Mr. Maurer that they and MnDOT April 26. indicated that he has received a letter from MnDOT indicating are interested in another luncheon meeting with City Officials Officials. He indicated that they gave a tentative date of The Council consented to this date. 6. Consider Hiring of Police Officer The City Administrator. Pat K1aers. indicated that the Police Department has completed the hiring process for the vacant Police Officer position. He indicated that they are recommending Russell Johnson. a Police Officer from the City of Anoka. to be hired as a Police Officer for Elk River effective March 22 and further that he be hired at the top step of the Union pay scale. COUNCILMBMBER HOLMGREN MOVED TO HIRE RUSSELL JOHNSON AS A POLICE OFFICER FOR THE CITY OF ELK RIVER EFFECTIVE MARCH 22. 1989. AND THAT HE BE HIRED AT THE TOP STEP OF THE UNION PAY SCALE. COUNCILMEMBER KROPUENSKE SECONDED THE MOTION. THE MOTION CARRIED 3-0. 7. Gambling License Renewal - Eagles Vice Mayor Gene Schuldt indicated application to the Charitable Gambling gambling license. The Council took no that the Eagles have submitted an Control Board for renewal of their action to deny this request. 8. Building and Zoning Annual Report Building and Zoning Administrator. Stephen Rohlf. began his annual report by responding to questions from the City Council. A number of Council members had questions regarding the percent of multi-family homes in Elk River as compared to the total housing market. Reference was made to Figure 2 of the report that showed approximately 12% of the housing stock as Multi-family in 1984 and this figure dramatically changing to almost 22% in 1988. The Council was concerned over the significant increase of Multi-family homes in Elk River as compared to single family homes and the location of these multi-family homes. It was acknowledged that this increase may have been due to a "catch up" period where the City had an abnormally low percentage of multi-family homes in the housing stock in 1984. The Council requested that this item be added to the 4/8/89 Joint City Council/Planning Commission Workshop agenda in order to discuss possible ways of limiting the maximum percent of multi-family housing units within the total housing stock. Council also requested that the concept of phasing in the multi-family units in the future growth area of the City (PUD areas) be discussed in order to control the number and location of multi-family units in the future. In this regard the City Council also requested the working memo that would be sent to the Planning Commission in advance to requests coming before them for formal action. Additionally. the Council questioned the need for formal bylaws but concurred that some guidelines are needed for the general operation of the Planning Commission. e e e Page 6 City of Elk River City Council Minutes March 13, 1989 -------------------------------------- At this time the Building & Zoning Administrator highlighted the inventory of lots in Elk River. It was noted that in the most recent eighteen months or so the City has noticed a decrease in the inventory of lots. More housing permits have been pulled in the last eighteen months than lots created. This is especially true in the sewer and water district and the Building & Zoning Administrator noted that we may soon have a shortage of available lots in the sewer and water district. The Building & Zoning Administrator highlighted a number of points from his Annual Report. These points included the fact that 1988, although not a record year for total housing units constructed, was still a record year for the number of single family housing permits pulled at the Building Inspections Department. For the last three years the City has averaged over 300 total housing units constructed and for the last two Another point discussed by the Building & Zoning Administrator were the accomplishments of his Department and the quality work produced by his employees. Special recognition was given to Cliff Skogstad while working as the Assistant Building Official when the former Building Official resigned and Sharon Maue for handling the significant increase in workload generated by his department. Stephen also praised new employee Terry Zajac as fitting well into the organization and handling residential inspections in an efficient and professional manner. Stephen also thanked the City Council for the hiring of the Zoning Assistant, Steven Bjork, which allowed himself to concentrate on some of the larger issues relating to building and zoning. These issues which have required some of the Administrators time include the landfill issue and the recycling issues. The City Council complimented Stephen on his report and the well managed department that he runs for the City. The Council also acknowledged the significant increase in activity in this department and the good image which this department projects on behalf of the entire community. 9. City Administrator Update The City Administrator showed the City Council a proposed site plan for the Mork Clinic that is proposed for the intersection of Third Street and Holt Avenue. The City Administrator distributed a letter from the Minnesota Pollution Control Agency which commended the City Sewer Plant operation and indicated that it would be presenting a Certificate of Commendation to the City at its annual Wastewater Operations Seminar to be held from March 22 to 24, 1989. The City Administrator indicated that he had been informally approached by a member of the Sherburne County Board to ascertain the interest of the City in the County property directly north of the Fire Station on Jackson Avenue. The City Administrator was instructed to obtain additional information from the County Board on this piece of property and buildings. 10. Other Business No items were discussed at this time.
