05-11-1988 CC MIN - BOR MEETING OF THE BOARD OF REVIEW WEDNESDAY. MAY 11. 1988 HELD AT THE SHERBURNE COUNTY ADMINISTRATION BUILDING e Members Present: Mayor Gunkel. Councilmembers Tralle. Holmgren. and Schuldt Members Absent: Councilmember Dobel Also Present: Ty Bischoff. County Assessor; Jerry Kritzeck. Commercial and Industrial Appraiser; and John Cullen. Residential Appraiser Pursuant to due call and notice thereof. the meeting of the Elk River Board of Review was called to order by Mayor Gunkel at 7:00 p.m. Ty Bischoff explained that the City Council was present as the Board of Review and would be reviewing the 1988 assessments. Mr. Bischoff explained that State would give a tolerance of 90% of the market value of a home. He indicated that after a study completed by the County. the ratio for the assesed market value to the appraised value for homes assessed in the City of Elk River was 84% to 6% under the State allowance. Mr. Bischoff explained that due to the State only allowing a 10% margin in the assessed valuation, 6% was added to all residential assessments. thereby increasing the assessed value of all residential property by 6%. e At this time the following people addressed the Board of Review: 1) David Shappell - 9325 164th Lane - 117-000-134105 Mr. Shappell indicated that his property is located in an industrial zoned area. He indicated the property valuation is too high because of the area. He indicated that the industrial activity is not screened and the area is very unsightly. John Cullen indicated that the property has not been appraised since 1981 and stated that due to the environment of the area. the property should be looked at. COUNCILMEMBER TRALLE MOVED TO CONTINUE THE REVIEW OF THE ASSESSED PROPERTY VALUATION OF 9325 164TH LANE (117-000-134105) ON JUNE 6. 1988. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 4-0. 2) Dawn Perry - 19413 Lowell Avenue - 115-140-040010 Ms. Perry indicated she lived in Ridgewood East and questioned the reason her property value raised $2.000 last year and another $8.100 this year. Jerry Kritzeck indicated that there was a personal assessment done on properties in the Ridgewood East area in 1987. He indicated that the raise in the assessed valuation was due to this assessment and the 6% increase. e It was the consensus of the Board of Review to take no action to lower the property value of the property owned by Dawn Perry. The petitioner accepted the fact that no action was taken. Page 2 Board of Review Minutes May 11. 1988 e 3) Richard & Nancy Nelson - 19779 Polk Street - 115-514-030010 Mr. Nelson indicated that his property value raised from $56.200 to $62.200. He further indicated that he was paying a very high amount of taxes (approximately $1.800) and questioned the reason for this. Appraiser John Cullen indicated that since the $56.200 valuation was placed on the property. the property has been reappraised and a garage. fire place and cedar deck have been added. and also the 6% increase. He further indicated that the reason for the high dollar amount due in taxes is because the house has only a one-half homestead credit. It was the consensus of the Board of Review to take no action to lower the valuation of the property owned by Richard and Nancy Nelson. The petitioners accepted the fact that no action was taken. 4) Barbara Johnson - 11880 Highland Road - 115-140-050080 e Mr. Greg Johnson indicated that his property value was evaluated at $94.300. He stated his property value has risen considerably and felt it was not a fair evaluation since he is considered a buffer zone for duplex and multi family residential property. He stated he had an independent appraiser appraise his home and the evaluation was $10.000 lower than the County evaluation. Appraiser Jerry Kritzeck stated that the reason for the increase in valuation was that the house has been reappraised and a pool and a second garage have been added to the valuation of the house along with the 6% increase. COUNCILMEMBER SCHULDT MOVED THAT THE APPRAISED VALUE OF $94.300 STAND AS IS FOR THE PROPERTY LOCATED AT 11880 HIGHLAND ROAD. PIN 1115-140-050080. COUNCILMEMBER TRALLE SECONDED THE MOTION. THE MOTION CARRIED 4-0. 5) Dick and Kathy Pomeroy - 13939 189th Avenue NW - 115-410-010080. 115-410-010060. 115-410-010070. 115-410-010030 Mr. Pomeroy indicated that he owns four parcels of land and each is valued at $1.800. He further stated that he owns a fourth parcel which includes his home and that a valuation of $94.400 has been placed on this Parcel. He indicated that his property value raised 6%. He stated that the homes in his area were of much less value than his and. therefore. felt his home was valued too high. Appraiser John Cullen indicated that the property was last appraised with an on-site appraisal in 1980. COUNCILMEMBER HOLMGREN MOVED TO REEVALUATE THE ASSESSED VALUE OF THE PROPERTY OWNED BY DICK AND KATHY POMEROY DUE TO THE SURROUNDING LOWER PROPERTY VALUES. COUNCILMEMBER TRALLE SECONDED THE MOTION. THE MOTION CARRIED 4-0. e 6) Cece1ia Scheel - 10271 213th Avenue NW - 117-000-123200 Ms. Scheel indicated that she owned 80 acres of property with two homes on the property. She stated that the property was valued at $166.700. She stated that there has been no change in the value other than the 6%. Page 3 Board of Review Minutes May 11. 1988 e Her concern. however. was the fact that the property was valued so high. Appriaser John Cullen indicated that one house had a full homestead and the other house only carried a half homestead credit. Also noted by the Appraiser was the fact that the Scheel's did not send in their green acres card. He indicated these factors accounted for the high valuation. Appriaser John Cullen then checked the computations in the assessment book and indicated there may have been a mathematical error which could possibly reduce the valuation. It was the consensus of the City Council to check the math on the computation. 7) Chris Kreger - Sanitary Landfill - 117-000-032400. 117-000-032100 Mr. Kreger indicated his concern regarding the value placed on the sanitary landfill and the property south of the landfill. He indicated that due to excavated gravel and burried garbage. the land becomes worthless. He stated that the acres of land which do have burried garbage and excavated gravel should be valued at a much lower level than the property still in operation. He indicated that about twenty acres of the land has reached final grading and can no longer be used. e COUNCILMEMBER ENCOURAGE MR. EQUALIZATION. CARRIED 4-0. HOLMGREN MOVED TO UPHOLD THE PROPERTY VALUES AND ALSO TO KREGER TO BRING THIS CONCERN TO THE COUNTY BOARD OF COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION 8) The following property owners were present but did not appear before the Board of Review as their questions were answered by the Appraisers. LerRoy Kennedy - 117-000-243100 Gerald Louden - 115-140-040140 Earl Greer - 117-000-143002 Irv Moldenhauer - 115-468-020040 9) The following letters of appeal were submitted to the Board of Review: Dale Johnson - 115-025-010010 and 115-025-010020 Mr. Johnson indicated in his letter that his property was the only property value which raised in the area. Assessor Ty Bischoff indicated this was due to the fact that Mr. Johnson lives in a commercial zone and the 6% increase applies only to residential dwellings. COUNCILMEMBER HOLMGREN MOVED TO UPHOLD THE VALUE OF THE PROPERTY OWNED BY DALE JOHNSON. COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION CARRIED 4-0. e Page 4 Board of Review Minutes May 11. 1988 e Phil Tenenbaum - Apartments at 7 - 3rd Street and 21 3rd Street 115-115-000001 and 115-115-000002 Mr. Tenenbaum indicated by letter. that he wished to appeal the assessments due to the fact he is not given a large enough operating percentage in the method used to appraise the property. Jerry Kritzeck indicated that Mr. Tenenbaum has been requested to submit his operating expenses to the County to be used in determining the assessment. Mr. Tenenbaum has not submitted these expenses to date. COUNCILMEMBER SCHULDT MOVED TO UPHOLD THE VALUE OF THE PROPERTY OWNED BY PHIL TENENBAUM. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 4-0. Sheldon Vie - Barrington Place - 115-220-030140 Mr. Vie indicated by letter that he is appealing his assessment because he feels the estimated value of $55.000 is too high. Councilmember Holmgren indicated that this same area was brought to the Board's attention last year. He indicated he felt the properties have been slightly overvalued in the past. e COUNCILMEMBER HOLMGREN MOVED THAT THE 6% INCREASE ON THE 1988 ASSESSMENTS BE ELIMINATED FROM ALL BARRINGTON PLACE TOWNHOMES. COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION CARRIED 4-0. COUNCILMEMBER TRALLE MOVED TO CONTINUE THE BOARD OF REVIEW UNTIL THE JUNE 6. 1988. CITY COUNCIL MEETING AT 7:00 P.M. TO BE HELD AT THE ELK RIVER PUBLIC LIBRARY. COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION CARRIED 4-0. There being no further busines. COUNCILMEMBER TRALLE MOVED TO ADJOURN THE BOARD OF REVUEW MEETING. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 4-0.
