08-10-1988 CC MIN CONTINUED CITY COUNCIL MEETING WEDNESDAY. 8/10/88 ELK RIVER CITY HALL ~ Members Present: Mayor Gunkel. Councilmembers Schuldt and Holmgren Members Absent: Councilmembers Tralle and Dobel Also Present: Pat Klaers. City Administrator; and Tim Keane. City Attorney 1. Pursuant to due call and notice thereof. the continued meeting of the Elk River City Council was called to order by Mayor Gunkel at 5:00 p.m. 2. Consideration of 8/10/88 City Council Agenda COUNCILMEHBER SCHULDT MOVED TO APPROVE THE 8/10/88 CITY COUNCIL AGENDA. COUNCILMEHBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 3-0. 3. Consider Watering Restriction Ordinance ~ Mayor Gunkel indicated that it was not her intent. nor the intent of the City Council to be in conflict with the Elk River Municipal Utilities. She indicated that it was the City Council's responsibility to enforce any watering restrictions that are necessary during the existing state wide drought. Attorney Keane indicated that both ordinance 88-22 that was approved by the City Council and the one proposed at this time. provide the City Council with the authority to order watering restrictions. The ordinance before the City Council at this time allows restrictions to be adopted by resolution and allows the ordinance to remain active at all times. Without the approval of this ordinance. each time the City Council desired watering restrictions. or the removal of watering restrictions. a separate ordinance would have to be approved. This ordinance before the City Council at this meeting would also repeal ordinance 88-22. MOTION BY COUNCILMEMBER HOLMGREN IMPOSING WATER USE RESTRICTIONS. MOTION. THE MOTION CARRIED 3-0. TO ADOPT ORDINANCE 88-23 AN ORDINANCE COUNCILMEMBER SCHULDT SECONDED THE Mayor Gunkel reviewed her 8/8/88 memo that outlines some of her concerns regarding water restrictions. She also distributed the summer. 1988. DNR Division of Water Newsletter and asked the Council to review this for a few minutes. This newsletter discussed the state wide drought conditions Minnesota is experiencing in 1988. Mayor Gunkel also reviewed the consensus reached at the 8/8/88 City Council meeting on exceptions to watering restrictions. It was the consensus of the City Council that yard watering restrictions would be enforced from 9:00 a.m. to 7:00 p.m. Exceptions to this watering ban would be direct application of water to trees. shrubs and gardens and the sprinkling of new sod and athletic fields could take place at any time. It was also the consensus of the City Council that such restrictions should only be enforced on citizens using the municipal water system. ~ COUNCILMlMBER HOLMGREN MOVED TO APPROVE RESOLUTION 88-65. A RESOLUTION ISTADLISHING CONDITIONS OF WATERING RESTRICTIONS ON HOUSEHOLDS HOOKED UP TO THE MUNICIPAL WATER SYSTEM. COUNCILMEMBER SCHULDT SECONDED THE MOTION. TNI MOTION CARRIED 2-1. Robert Petermann Resignation At this time the City Admini~trator indicated that this section of the City Council meeting would be tape recorded. The City Administrator distributed a letter received by the City from Officer Robert Petermann and witnessed by Officer Thomas ~yler. in which Officer Petermann resigned from being an Elk River Police Department employee contingent upon the City Council rescinding its action to terminate his employment with the City. COUNCILMEHBER HOLMGREN MOVED ~O RESCIND CITY COUNCIL ACTION TAKEN ON 8/1/88 TO TERMINATE THE EMPLOYMENT OF OFFICER PETERMANN. COUNCILMEMBER SCHULDT SECONDED THE MOTION. TH~ MOTION CARRIED 3-0. COUNCILMEHBER SCHULDT MOVED TO ACCEPT THE RESIGNATION OF OFFICER PETERMANN EFFECTIVE 8/10/88. OOUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 3-0. At this time. Don Heinzman. Edltor of the Elk River Star News. expressed his concern about obtaining do~umentation that led to the City Council's original decision on 8/1/88 ~o terminate the employment of Officer Petermann. According to the attorney representing the Elk River Star News. it is their belief that' such information is public. Mr. Heinzman presented the City Administratpr with a letter requesting the release of documentation that led to the Co~nci1's action on 8/1/88. 5.1.Lion's Club Request for Financial Assistance The City Administrator distributed a letter dated 8/8/88 from Lion's Club Member Steve Pattison. Steve and Lion's Club President. Bill Lampson were present at the 8/1/88 City Council meeting to request financial assistance (loan) for the constr~ction of the shelter in Lion's Park. The August 8. 1988. letter from the tion's Club indicated that the Lion's Club have located an alternative fund~ng source to help them with the financing of the Lion's Park Shelter. The letter expressed the appreciation of the Lion's Club for Council consider~tion of their request. 5.2.Library Board Vacanc~ The City Administrator indicated! a vacancy has been created on the Library Board with the resignation of Deloris Collins. The term of Deloris Collins expires at the end of 1988. Former Library Board Member. Ellie Kretsch. had expressed intere$t in fulfilling this term of Ms. Collins. The City has on file an application from Dr. Flannery which expresses his interest in serving on the Library Board. The City has also received an application from former Libratian. Bill Pollard. The City Council indicated that no one needed t~ be present for interviews at the 8/15/88 City Council meeting when consid~ration of filling this vacancy would take place. ' e e e Page 3 City Council Minutes August 10. 1988 5.3.Discussion on 8/15/88 City Council Meeting Open Mike/Agenda Item The City Administrator indicated that during open mike at the next City Council meeting a presentation would be make for the winners of the "Name that Park" contest. It is anticipated that Recreation Board Chairman. Mike O'Brien will attend this meeting to make a presentation. 5.4.Distribution of Growth Management Plan The City Administrator distributed the final draft of the Growth Management Plan. This plan is to be considered by the City Council at its 8/22/88 meeting. COUNCILMEHBER HOLMGREN MOVED TO ADJOURN THE 8/10/88 CITY COUNCIL MEETING. COUNCILMEHBER SCHULDT SECONDED THE. MOTION.
