MEETING OF THE ELK RIVER CITY COUNCIL
HELD AT THE ELK RIVER PUBLIC LIBRARY
MONDAY. 10/24/88. 6:30 p.m.

Steve Rohlf. Building and Zoning Administrator arrived at
6:55 p.m.
1. Pursuant to due call and notice thereof. the meeting of the Elk River City
Council was called to order at 6:30 p.m.
2. Consider 10/24/88 City Council Agenda
Mayor Gunkel indicated that items 5.1. 5.2. and 5.3 all relate to TIF #5
and require a public hearing. She noted that Staff inadvertantly
neglected to place the proper notice for a public hearing. therefore these
items would be deleted until such time that the notice for public hearing
has been published.
Items 4.1 and 4.2 were moved after items 5.4.. 5.5.. 5.6.. and 5.7 due to
the fact Staff was not present to present these items.
COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE 10/24/88 CITY COUNCIL AGENDA
AS AMENDED. COUNCILMEMBER DOBEL SECONDED THE MOTION. THE MOTION CARRIED

Consideration of 10/17/88 City Council Minutes
The following corrections were made to the 10/17/88 Council minutes:
1) Page 6. Item #5.7 #4 should read excactly the same as in item 5.6 #4.
2) Page 6. Item 5.8. the first sentence in the second paragraph should
read as follows: "Discussion was held regarding the fact that the permit
does not specifically state that NSP is to retain fire suppression water
that comes into contact with garbage."
3) Page 8. Item 8.2. the word regrading should read as "regarding."

COUNCILMEMBER TRALLE MOVED TO APPROVE PAY ESTIMATE #2 TO S & L EXCAVATING
FOR IMPROVEMENTS COMPLETED AT THE ROYAL OAKS RIDGE PROJECT IN THE AMOUNT
OF $125.006.96. COUNCILMEMBER DOBEL SECONDED THE MOTION. THE MOTION
CARRIED 4-0.

5.4.Reapportionment of Special Assessments
Council reviewed three parcels for special assessment reapportionments.
Staff was directed to review Parcel #2 - 115-000-3344110 to ensure that it
is correct. It was indicated that this parcel was split into four parcels
and as shown in the memo. the assessments are reapportioned to three lots.
COUNCILMEMBER TRALLE MOVED TO APPROVE THE REAPPORTIONMENT OF SPECIAL
ASSESSMENTS FOR THE FOLLOWING PARCELS: 115-010-000812. 115-000-341110. AND
115-000-342200. WITH THE STIPULATION THAT STAFF REVIEW PARCEL
115-000-344110. COUNCILMEMBER DOBEL SECONDED THE MOTION. THE MOTION
CARRIED 4-0.
5.6.Consider Hiring of Building and Zoning Employee

After recommendation from Steve Rohlf. Building and Zoning Administrator.
Council approved the hiring of Terry Zajac as Building Inspector as
follows:
COUNCILMEMBER HOLMGREN MOVED TO HIRE TERRY ZAJAC AS CITY OF ELK RIVER
BUILDING INSPECTOR AT A STARTING SALARY OF $23.500 WITH A ONE YEAR
PROBATIONARY PERIOD; THAT A5% INCREASE BE GRANTED UPON COMPLETION OF THE
ONE YEAR PROBATIONARY PERIOD; AND THAT HE RECEIVE A PAY INCREASE ACCORDING
TO THE 1990 PAY PLAN ON JANUARY 1. 1990. COUNCILMEMBER DOBEL SECONDED THE
MOTION. THE MOTION CARRIED 4-0.
4.1.Residential Zone Changes Request/Public Hearing
Steve Rohlf. Building and Zoning Administrator. indicated that the City of
Elk River has recently adopted a Growth Management Plan. He noted the
City is requesting the Council to consider a zone change for residential
property in the City of Elk River which is necessary in order to implement
the Plan. Mr. Rohlf noted that the City placed a full page ad in the
paper to put the public on notice of this meeting.

The Building and Zoning Administrator indicated that the Growth Management
Plan divides the city into three residential rings with each ring becoming
more densely populated closer to the downtown area. He noted that the
reason for the zone change is to create the rings. The rings are as
follows: Ring 1 - A-1/Agricultural zoning - 10 acre minimum; Ring 2 - R-
1a/ 2~ acre minimum; Ring 3 - R-1c - City sewered lots. Mr. Rohlf
explained that in order to create these rings certain residential areas
must be zone changed. Mr. Rohlf reviewed the projected zone changes as
reflected in the memo from Steven Bjork. dated September 21. 1988.

Mr. John Williams of 19401 Ulysses Street indicated that his property has
been designated to be zone changed from R-IA to R-IC. Mr. Williams also
indicated that his property lies on the border of two different
residential zones. Mr. Williams stated that due to the ponds and the
easement on his property his land is not conducive to construction and.
therefore. would prefer that his land not be zone changed but remain in
the R-la zone.
Mr. Rohlf indicated that Mr. Williams owns 4.33 acres and that because of
the ponds and easement he could only get two lots out of his parcel. Due
to this fact. Mr. Rohlf stated he would recommend that the land remain in
an R-la zone. The Council concurred with the recommendation.
Ellen Medenwaldt/12104 Highland Road questioned when sewer would be
available in the area and when street lights would be in the area. Mr.
Rohlf stated sewer would not come in the foreseeable future unless there
were problems. such as ground water contamination. in which case it could
be next year.
Mayor Gunkel closed the public hearing at this time.

COUNCILMEMBER TRALLE MOVED TO ADOPT ORDINANCE 88-27, AN ORDINANCE AMENDING
THE CITY OF ELK RIVER ZONING MAP TO ZONE CERTAIN PROPERTY 'ROM All TO R-
IA; FROM R-IA TO R-IC;. AND FROM R-IB TO R-IC. COUNCILMEMBER HOLMGREN
SECONDED THE MOTION. THE MOTION CARRIED 4-0.
4.2.0rdinance Amendment Regarding Residential Lot Dimensions/Public Hearing
Steve Rohlf. Building and Zoning Administrator. indicated that the City is
proposing an ordinance amendment regarding residential lot dimensions.
Mayor Gunkel opened the public hearing. There being no one for or against
the matter. Mayor Gunkel closed the public hearing.
COUNCILMEMBER DOBEL MOVED TO ADOPT ORDINANCE 88-28. AN ORDINANCE AMENDING
SECTION 900.18 OF THE ELK RIVER CODE OF ORDINANCES. COUNCILMEMBER TRALLE
SECONDED THE MOTION. THE MOTION CARRIED 4-0.
5.l.Discussion of Future Bond Referendum

Russ Anderson. Fire Chief. informed the Council of the referendum which
the Fire Department is planning in February of 1989. He indicated that he
is looking at the purchase of an aerial truck in the amount of $390.000 to
$425.000. and at enlarging the present fire station at a cost of $230.000
to $240.000. Discussion was held regarding the booth the Fire Department
will have at the Business Expo and the video they are working on. The
Council also discussed the fact that prior to any information regarding
the referendum being distributed to the public. all attempts should be
made to provide accurate information so as not to mislead the public. The
Council also indicated that the Fire Chief should work closely with City
Staff in coordinating the referendum and the necessary information needed
for the referendum.

MEETING OF THE ELK RIVER CITY COUNCIL. COUNCILMEMBER DOBEL SECONDED THE
MOTION. THE MOTION CARRIED 4-0.
