RDF City Consultant from Cedar Corporation was called to order at 7:30 p.m. by Mayor Gunkel. 1. The meeting 2. COUNCILMEMBER TRALLE MOVED TO APPROVE THE AGENDA AS AMENDID . COUNCILMEMBER DOBEL SECONDED THE MOTION. THE MOTION PASSED 5-0. 3. Consider 2/2/87 City Council Minutes Under item 10.1. delete the word "feeling" and add the word "consensus." Also under this same item add the following: "Rob Vanvalkenberg did not respond for reappointment to the EDC. Hank Duitsman responded favorably. however. it was the consensus of the Council that Hank was already on the HRA Committee and Utility Commission and the Council preferred to bring new people on the Committee." COUNCILMEMBER TRALLE MINUTES AS AMENDED. PASSED 5-0. MOVED TO APPROVE THE FEBRUARY 2. 1987 CITY COUNCIL COUNCILMEMBER DOBEL SECONDED THE MOTION. THE MOTION 4. Open Mike No one appeared before the Council for this item. 4.5. Presentation by Gary Ackerman Mr. Gary Ackerman. president of Trio Energy. stated he was summoned to appear before the City Council by a group of concerned citizens. He indicated he would like to present to the City of Elk River an energy process that does not burn and does not pollute the atmosphere. Mr. Ackerman stated he would like to present this type of energy process to the City Council and citizens at a future date as an alternative to RDF. Mayor Gunkel stated that if Mr. Akerman were interested in pursuing this type of proposal he should contact Sherburne or Anoka County. Page 2 City Council Minutes February 9. 1987 e 5.1. Conditional Use Permit Request by NSP/Public Hearing Mayor Gunkel matter because approved by the noted that no action was required from the Council on this the conditional use has already been considered and City Council at its December 1. 1986 meeting. 5.2. License Request by NSP/Public Hearing The solid plant. Building and Zoning Administrator noted that NSP is requesting a waste facility license to operate a refuse derived fuel processing Peter Beck. Assistant City Attorney stated that the license basically covers the same topics as the conditional use permit and requires additional regulations for operation of NSP's RDF plant. Mr. Beck briefly went through the license for the RDF plant. Mayor Gunkel opened the public hearing. At this time she stated each person wishing to speak may address the City Council for a maximum of five minutes and requested the public to stay on the subject. e Tom Woods stated his opposition as to how the meeting was being conducted. He felt people should be able to discuss the pros and cons of the RDF issue. Mr. Al Fisher stated the City is noted as becoming the garbage city of the area. He stated he would like to see the pros and cons and also that he would like to see the cost benefit to the City; specifically. what are the revenues to the City as opposed to the revenues to UPA and NSP. Dr. Bob Swan stated he felt the two new Councilmembers should have the right to hear the information that has been presented to the other Councilmembers and proceeded to speak regarding the pros. cons and health affects of RDF. Mr. Dave Sipe stated he felt the public is not aware of the RDF issue. e Mr. Dan McConnon of UPA stated that MnDOT refused the cross over on Highway 169 but agreed on the right out to the southbound lane on 169. Mr. McConnon stated that the proposed access to the UPA site would be via Highway 10 to Main Street to UPA Drive. He indicated that this was originally proposed by former Mayor Hinkle and Mr. McConnon stated he was surprised to see the Planning Commission vote against this route. He stated the Planning Commission's opposition was mainly to safety concerns and aesthetics. Mr. McConnon stated they had done a survey regarding the amount of truck traffic and vehicular traffic on this intersection and stated the results showed that 5% of the vehicular traffic at the intersection of Highway 10 and Main Street was truck traffic. He stated with the 54 RDF trucks per day. this would only increase the total truck traffic amount one half of one percent. He stated that the small Page 3 City Council Minutes February 9. 1987 e increment of traffic that UPA would add to the intersecton would not be an interference and further that this would not become a safety problem. Mr. McConnon responded to the subject of aesthetics by stating the tractor trailer hauling the RDF would be no different than any other tractor trailer using the itersection. He stated it would be a completely covered trailer and that there would be no way the ROF could escape the trailer. Mr. Maconnon handed out a memo from UPA's Attorney regarding the City's authority in regulating the type of trucks traveling in the area. Mr. Don Chmiel noted that the legal description in the resolution was not correct and further noted that #13 in the license should be amended to allow open trailers in th public drop off area. Vicki Swan stated she would like to see the time limit strictly enforced regarding public speaking. She stated she felt favoritism was being shown to UPA and NSP. David Briggs stated he would like to see a stipulation in the license stating there will be an immediate shut down if there are any hazards. and further that the plant not be reopened or given an extension until the problem is solved. e Jeanne Eggert stated her concern regarding the heavy amount of traffic on Highway 10. She further stated her concern regarding the storing of hazardous waste for a 30 day period. She stated she felt this time allotment should not be extended and further questioned how this hazardous waste could be taken care of when there has been no place determined for the disposal of the waste as of this time. Ms. Eggert further stated her concern regarding the lack of public knowledge on the subject. Mr. Bob Morton stated the consensus of the Planning Commission was strong regarding the matter of entry via Highway 10 to Main Street to UPA Drive. He stated the Planning Commission opposed this entry route. There being no further public comment. Mayor Gunkel closed the public hearing at this time. Mayor Gunkel made the following comments: 1) Our main concern was. and is. to keep ROF and ash transport trucks off residential and inner-city streets. Last year. Mayor Hinkle suggested the use of UPA Drive off Highway. It seemed a reasonable solution. e This is a new exercise of authority for the City. I think it should be handled reasonably and with caution. In my opinion we are very close to being selectively discriminating and overly regulatory if we deny one-way access to UPA Drive. Page 4 City Council Minutes February 9. 1987 e 2) We can only speculate about the future use of the current city hall site. 3) It is in our best interest to preserve the aesthetic landmark of UPA as an attractive entrance into our City. 4) The RDF material is much safer than the contents of the packer trucks that move thru our residential areas. In fact. we have no idea what some of the trucks and trains are carrying as they go through Elk River. 5) Economic growth through commerce and industry will increase the volume of truck traffic. A decision to restrict 53 trucks from using a couple hundred feet of a road could have a very negative affect upon future development. Trucks are the lifeblood of activity here. How can we think that 50-60 more one-way truck trips a day will be unbearable? They won't even be crossing lanes of traffic. 6) I question if the objection to using UPA Drive is really because of the volume of traffic or what the trucks are carrying; or is it because the City happens to own the property most affected? Mayor Gunkel stated that the Councilor Staff would attempt to respond to each speaker at this time. e Councilmembers and Staff responded to the public as follows: The meeting rules set for this public hearing meet with legal approval. To state the cost benefit is not within the scope of the Council's responsibility. The new Councilmembers h~e been aware of the RDF issue. The City Attorney stated that restrictions on the truck haul routes flow from the City's licensing power over the operation of the facilities. and that the City can designate haul routes. Mr. Beck questioned whether the City has done a traffic count. He further stated the Solid Waste Ordinance allows the City to immediately shut down the plant if there is a violation of the license or the Solid Waste Ordinance resulting in a clear and eminent danger to the health and safety of City residents or the public. Mr. Beck stated that there are designated locations where the waste can be transported to and disposed of. He also noted that the 30 day limit to get rid of hazardous waste is the maximum amount of time allowed. and further stated 30 days was decided upon to allow time for the proper legal steps for transporting hazardous waste to be followed. e e e e Page 5 City Council Minutes February 9. 1987 Councilmember Schuldt stated he did not oppose the haul route as submitted by UPA. Discussion was held regarding the possible screening between City Hall and UPA Drive. Discussion was then held regarding the possiblity of restricting the hours of truck hauling during peak traffic hours. Councilmember Tralle questioned Mr. considered any route alternatives. alternative was UPA's private drive. McConnon as to whether they had Mr. McConnon stated that the only Councilmember Tralle noted that it would be possible to reevaluate the situation during the renewal process of the license. Councilmember Dobel noted that he was opposed to the proposed route because of small children and felt as long as there was an alternative route he would be opposed to the proposed route. Councilmember Holmgren stated he felt UPA has not researched the problem to the fullest and also stated he does not want to see the trucks using the proposed route on Main Street. Mayor Gunkel noted that item 13 be changed to allow trailers to be open during public drop off time. Councilmember Tralle noted that he would like the words "in writing" added to item #5. COUNCILMEMBER TRALLE MOVED TO APPROVE RESOLUTION 87-9. A RESOLUTION GRANTING SOLID WASTE FACILITY LICENSE TO NORTHERN STATES POWER COMPANY FOR THE ESTABLISHMENT AND OPERATION OF A WASTE PROCESSING FACILITY WITH THE FOLLOWING CHANGES.NOTED IN THE LICENSE: 1) THAT THE LEGAL DESCRIPTION BE CORRECTED. 2) THE WORDS "IN WRITING" BE ADDED TO NUMBER 5. 3) THAT 110 BE AMENDED TO INCLUDE MAIN STREET AND UPA DRIVE. 4) THAT 1/13 WILL ALLOW OPEN TRAILERS IN THE PUBLIC DROP OFF AREA AND THAT THEY BE COVERED DURING NON-DROP OFF TIMES. COUNCILMEMBER DOBEL SECONDED THE MOTION. Discussion was held regarding the hours of truck hauling. COUNCILMEMBER TRALLE MOVED TO ADD TO #10: "THAT BETWEEN THE HOURS or 4-6:30 P.M. NO RDF HAULING TRUCKS BE ALLOWED TO MOVE THROUGH MAIN STREET BETWEEN HIGHWAY 10 AND UPA DRIVE. Counsel Peter Beck noted that the trucks could possibly use the UPA Private Drive during this time. e e e Page 6 City Council Minutes February 9. 1987 YrlOvttlJ COUNCILMEMBER TRALLE MOVED TO WITHDRAW HIS AMENDMENT TO #10 AND MVEB TO AMEND #12 TO ADD "EXCEPT 4:00 P.M. TO 6:30 P.M. ANYDAY. cOUNCILMEMBER DOBEL WITHDREW HIS SECOND. Councilmember Dobel noted that if UPA could use the private drive during peak hours. he felt they could use the drive all of the time. COUNCILMEMBER SCHULDT SECONDED THE MOTION. COUNcILMEMBERS DOBELAND HOLMGREN OPPOSED. THE MOTION PASSED 3-2. 5.3. Zone Overlay Request by NSP/Public Hearing The Building and Zoning Administrator noted that NSP must go through a zone change to a solid waste facility overlay district. He explained that this allows the processing of solid waste in the new overlay zoning district and that the uses presently allowed in the district will remain. Planning Commission representative Bob Morton stated that the Planning Commission approved the zone change request. Mayor Gunkel opened the public hearing. Mr. Al Fisher indicated he wanted the benefits and costs of the projects. Mr. Dave Sipe questioned whether this project could continue without the zone change and urged the Council to vote against the zone change. Dr. Swan stated into the health affects of dioxins and lead should be taken considertion. Tom Woods stated this project would create more problems with the landfill and also will lower the real estate values and the general tennure of industry locating in Elk River. Mary Sipe stated that when the Landfill first started the public and City were not aware of the affects and further that the City is not aware of the long term affects of the RDF plant. Mr. David Sipe stated he did not feel this was an appropriate use for this area. Jeanne Eggert stated the zone change will be detrimental to the health of the citizens. She further stated she felt the meeting was not run in a fair manner in that the citizens do not have a chance for rebuttal. Mr. Gary Ackerman stated there is an alternative to the zoning that will not burn or incorporate the Landfill. Ms. Marlene Hentges urged the Council to vote against the zone change. Page 7 City Council Minutes February 9. 1987 e Mr. David Briggs stated he felt this type of zoning would offer a front door for other businesses that will not properly portray Elk River. Mr. Jack Maurey stated he felt this matter should be put up to the public for a vote. Ms. Peabody stated that she has watched the City grow. She stated she is very concerned about the devaluation of the propety because of the RDF Plant. There being no further public comment. Mayor Gunkel closed the public hearing. The following comments were made by Council and Staff in answer to the public comments: Mayor Gunkel stated that State law establishes the guidelines in which the City Council has to act regarding the rezoning. Councilmember Dobel stated that the City has more authority regarding the RDF with the rezoning of the property. e It was noted that regarding public awareness. this has been on the front page of the local newspaper for two years and over 20 public hearings have been held by the City. Mr. Klovning stated that there has been one regarding land devaluation near RDF plant. study it was concluded that there were no devaluation occurred within a five year study. the City has not heard concerns from property project. COUNCILMEMBER SCHULDT MOVED TO APPROVE AMEND ING THE CITY OF ELK RIVER ZONING MAP SWF-SOLID WASTE FACILITY OVERLAY DISTRICT. THE MOTION. Counsel Beck gave a general statement regarding the City's authority with regards to the conditional use permit and the zone change. e Mayor Gunkel noted that questions have been raised as to whether or not she had a conflict of interest and she noted to the public that she had looked into this matter and made a public statement to this affect at the August 18. 1986 City Council Meeting. e e e Page 8 City Council Minutes February 9. 1987 Planning Commission Representative. Bob Morton stated that the Planning Commission discussed and heard public comments regarding the CUP for UPA. He noted that the Planning Commission recommendations are included in the draft conditional use permit. Mayor Gunkel opened the public hearing. Mr. Al Fisher questioned if the decision of the City Council can stop the RDF Facility from operating in Elk River. Mr. Ackerman stated there was a viable alternative that incorporates NSP and UPA on a State-wide basis and walU be better economically. wD~I~ Marlene Hentges stated that in the process of burning we are creating chemicals that can kill the children. Vicki Swan spoke on dioxins and lead contaminations. She stated that tests used to determine State levels were inaccurate according to EPA. She further noted that there will be lead in the soil. She urged the Council to vote against the conditional use permit on behalf of the children in the community. Mr. Bob Swan spoke on lead and dioxins and noted alternatives have not been looked at. Mr. Dave Briggs stated there was a viable alternative. He noted Mr. Gary Ackerman's process should be studied further. He further stated that people should reduce garbage production. Jeanne Eggert talked about the pollution affecting the river. She also questioned that since dioxins are so dangerous. how can the Council say they are safe by voting in favor of RDF. Robert Lowman of Little Falls stated that he feels the people have a lot of unanswered questions and felt these questions should be answered. Mary Sipe stated she felt the permit should not be issued until it is decided where the ash is going. Mr. Dan McConnon stated that #10 of the CUP should be made consistent with the CUP for NSP. He further noted that he felt item #12 was overly restrictive and felt buildings and facilities should be stricken. Mr. McConnon requested that the language in #9 be changed to be a daily average. Mr. McConnon also he had received reviewed the status of Burlington Northern and stated a letter granting approval for crossing. Counsel Peter Beck stated that the Council can deny the conditional use permit but only if standards set forth in the ordinance for issuance of a conditional use permit are not met. and that there would have to be findings of fact to support the decision that the standards are not met. Mayor Gunkel stated that it was Mr. Ackerman's option whether he wanted to present his proposal. He indicated this process was much more expensive and further stated he felt the dioxins produced would be higher produced by RDF. Mayor Gunkel noted that as MPCA arrives at new findings. they will impose greater restrictions. Mayor Gunkel noted that the Council must deal with the proposal before them. Mr. Briggs stated that without addressing alternatives on such a major subject the Council is neglecting the issue. He stated he felt the Council has not taken the responsibility to consider the lives within the City. Jeanne Eggert questioned how accurate. Mr. Klovning stated party. He further stated that the MPCA permit requires that an Ash Management Plan be submitted to them prior to approval by MPCA and further that this must be done prior to plant operation. Page 10 City Council Minutes February 9. 1987 e Counsel Beck stated that the language in #9 was from the PCA permit and that he did not feel this was necessary. Councilmember Schuldt questioned what the on-going testing rquirements were. Mr. Klovning stated the testing was extensive and further that some of the tests were done on a quarterly basis. some on a monthly basis. and some on a continuous basis. Mr. McConnon stated that the MPCA requires that testing for dioxins be 3 months after operation begins and every 15 months thereafter. Councilmember Dobel questioned how the City could be sure there were no dioxins in the air if the test was done every 15 months. Mr. McConnon stated that tests would be done at sister plants and the results of these tests would be passed on to the Elk River plant. Councilmember Tralle noted that the third paragraph in the letter from UPA to John Klovning. be changed to read that the ash trucks not be allowed to exit via UPA Drive. Main Street to Highway 169 or Highway 10. It was noted that #10 state that there be no receiving between 4:00 - 6:30 p.m. e It was noted that #12 be clarified so that the steam plant can be washed down. an also #18 should be made consistent with the NSP license. COUNCILMEMBER SCHULDT MOVED TO RESOLUTION 87-10. GRANTING A CONDITIONAL USE PERMIT TO UPA WITH. THE ABOVE MENTIONED CHANGES RELATING TO ASH TRUCKS HAUL ROUTES AND RECEIVING HOURS BE INCLUDED IN THE CONDITIONAL USE PERMIT. COUNCILMEMBER TRALLE SECONDED THE MOTION. THE MOTION PASSED 3-2. cOUNCIMLEMBERS DOBEL AND HOLMGREN VOTED AGAINST THE MOTION. 5.5. License Request by UPA/Public Hearing COUNCILMEMBER TRALLE MOVED TO EXTEND THE COUNCIL MEETING PAST MIDNIGHT. cOUNCILMEMBER DOBEL SECONDED THE MOTION. Councilmember Holmgren stated he would like to limit the time to 12:30 if at all possible. THE MOTION PASSED 5-0. Assistant City Attorney. Peter Beck. stated that United Power Association is requesting a license to operate a solid waste facility. Counsel Beck explained the contents of the license at this time. e Mr. Klovning explained. in detail. item #8 of the license relating to performance testing. Discussion was held regarding the time period at which the tests would be performed. It was discussed whether or not to have the tests done every three months. Page 11 City Council Minutes February 9. 1987 e Mayor Gunkel opened the public hearing. Dave Briggs stated that he would like the license amended to state that if an accident should occur. the plant would be shut down immediately until the problem is corrected. Mr. Dan McConnon stated that the MPCA permit requires extensive initial testing. He further stated that the report is due 120 days after the test is completed and questioned the reasoning of running a test every three months when the results of the first test will not be available before the second test is started. Dr. Swan questioned the pollutants. Assistant Attorney. Peter Beck stated that the City has the authority under the Solid Waste Ordinance to suspend the license up to ten days until a hearing is held if there is a violation of the license or the ordinance resulting in a clear and eminent danger to te health and safety of the City residents or the public. and also has the authority to keep the plant shut down after a hearing until the problem is solved. Mr. Klovning responded to the possibility of artificially lowering the pollutants to alter the test. Mr. Klovning stated that even if this were done it would not be a significant adjustment. Mr. Klovning noted that surprise testing would be difficult because of the extensive amount of testing required. He also noted that the soil. water and air will be tested. Councilmember Dobel questioned whether milk samples will be taken and tested. Mr. Klovning indicated they would be tested. Discussion was held regarding the possibility of testing every 9 months in a three year span so that the results would be back before the next test is started. e Page 12 City Council Minutes February 9. 1987 e COUNCILMEMBER TRALLE MOVED TO APPROVE RESOLUTION 87-11. A RESOLUTION GRANTING SOLID WASTE FACILITY LICENSE TO UNITED POWER ASSOCIATION FOR THE ESTABLISHMENT AND OPERATION OF A WASTE BURNING FACILITY WITH THE FOLLOWING AMENDMENTS: 1) THAT /18 INDICATE THAT PERRFORMANCE TESTING WILL BE REQUIRED EVERY 9 MONTHS FOR A 3 YEAR PERIOD FOR DIOXINS AND FURONS. 2) THAT *12 BE CHANGED SO AS TO BE CONSISTENT WITH THE CONDITIONAL USE PERMIT FOR UPA. COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION PASSED 3-2. COUNcILMEMBERS DOBEL . AND HOLMGREN VOTED AGAINST THE MOTION. 5.6. Consider Zone Change Request by NSP/Public Hearing Peter Beck. Assistant City Attorney. explained that United Power Association is requesting an ordinance amendment to amend the zoning map to reflect the newly inacted solid waste facility overlay district. Planning Commission Representative. Bob Morton. stated that the Planning Commission recommended approval of the zone change. e There being no further public comment. Mayor Gunkel opened the public hearing. Al Fisher noted that the zone change would create an optimum hazard to the City. He also indicated that the Council has received a petition of over 600 names opposing the RDF Facility and questioned why this has not been mentioned. Mr. Dave Sipe stated the ROF would be posing traffic problems and the burning of potentially hazardous material. He further indicated that if this zone change is denied it would put a stop to the RDF. Mr. Tom Woods stated that this is not a good place for the RDF Project. He indicated it is inviting accidents into the community. He stated he is disappointed in the democratic process and further stated he felt the City is voting for the ROF Facility because of their fear of a lawsuit by UPA or NSP. Dr. Swan stated his concern regarding the schools being two miles from the ROF Plant and indicated there must be a better place for the plant than right downtown and close to the schools. Mayor Gunkel closed the public hearing. Mr. Klovning spoke on the concerns of the locations of the plant. He indicated there are other ROF Plants located in similar locations. e Page 13 City Council Minutes February 9. 1987 e Mayor Gunkel noted that the Council had received the petition and has it on file. She also noted that some of the people who signed the petition did not live in Elk River and also that some people signed their name twice. Councilmember Tralle noted that no matter what decision is made. the City would probably be involved in a lawsuit. and. therefore. stated that the City is not voting one way or another because of any lawsuit threat. COUNCILMEMBER TRALLE MOVED TO ADOPT ORDINANCE 87-3, AN ORDINANCE AMENDING THE CITY OF ELK RIVER ZONING MAP TO ZONE CERTAIN PROPERTY OWNED BY UPA INTO THE SWF-SOLID WASTE FACILITY OVERLAY DISTRICT. COUNcILMEMBER SCHJJLDT SECONDED THE MOTION. THE MOTION PASSED 4-1. COUNcILMEMBER DOBEL OPPOSED. 6.1. Consider Hiring of Part Time Receptionist COUNCILMEMBER TRALLE MOVED TO HIRE ALICE HEINECKE AS PART TIME RECEPTIONIST AT A WAGE OF $5.50 PER HOUR WITH A THREE MONTH REVIEW AND AN INCREASE IN SALARY TO 6.00 PER HOUR DEPENDING ON THE REVIEW.
