The authorized Conditional Use Permit shall be recorded, and the use shall not be considered a legal use until then. 2. Prior to recording, the city's Building Official and Fire Marshal shall inspect the building for compliance with all state and local building codes. 3. The Conditional Use Permit is not a building permit and the applicant must apply for and receive approval of required building and sign permits before construction may begin. 4. All refuse collection containers shall be stored within an enclosure facility large enough to accommodate the collection of all materials. Refuse containers and materials must be out of sight from neighboring properties and street. 5. Update site plan to show designated employee parking areas. 6. Indoor and outdoor facilities are to be kept in a clean, dry, and sanitary condition. 7. Indoor facilities shall be adequately ventilated and have ample light, cooling, and heating. 8. Adequate storage and refrigeration shall be provided to protect food supplies against contamination and deterioration. 9. Waste shall be picked up immediately and disposed of in a sealed container. 10. Animals are allowed outside only under direct supervision. 11. No more than four (4) animals per supervisor shall be allowed outside the fenced area and will be leashed at all times. 12. Outdoor play shall not be used before 7:00 a.m. or after 9:00 p.m. 13. The outdoor play area will be screened by a six foot opaque fence. Vinyl, or other, slats in chain link fencing shall not be used. 14. Noise shall be mitigated so as to not create a public nuisance for adjoining properties. If a dog continuously barks, it must be brought inside. Background/ Discussion The property is zoned C3 Highway Commercial where Commercial Kennels require a Conditional Use Permit (CUP). The applicant is seeking a CUP to operate a dog day care and boarding facility in an existing multi -tenant building. The applicant is currently operating a dog grooming business on the subject property. The Elk River Vision A avelcoming community avith revolutionary and pirited resourcefulness, exceptional p o w E R E o e r service, and community engagement that encourages and inspires prosperity [NATURE] Analysis Comprehensive Plan The subject property is guided by the Mississippi Connections which seeks to reinvent the area as a destination for a variety of uses and activities. The redevelopment framework was adopted by the City Council in November, 2012. The proposed use is consistent with the Comprehensive Plan. Parking Based on the ordinance for sales/services, a total of 3 parking stalls would be required. The site plan and narrative indicate 5 parking stalls are available. The proposed plan provides an adequate number of onsite parking stalls. Staff recommends the employee parking be designated. Transportation/ Circulation The business is part of a multi -tenant structure that is accessed via two locations on Highway 10. No additional access points are being proposed. Hours of Operation The hours of operation will be from 6:00 a.m. -7:30 p.m. Monday through Friday. Applicable Regulation The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. 1Ylill not endanger, injure or detrimentally affect the use and enjoyment of otherpropery in the immediateviciniy or the public health, safety, morals, comfort, convenience orgeneral welfare of the neighborhood or the city. The impacts of the proposed operation were reviewed by staff. It does not appear the proposed dog daycare and hotel use will detrimentally affect surrounding parcels. 2. Weill be consistent with the comprehensive plan. It is consistent with the comprehensive plan, which encourages redevelopment in this area. 3. Will not impede the normal and orderly development and improvement of surrounding vacantproperty. It will not, as the surrounding areas are developed and also used for commercial purposes. 4. Will be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer systems, parks and schools; and will not, in particular, create tralc congestion or interference with trac on adjacent and neighboring public thoroughfares. The property is located inside the urban service area and will utilize city services. The proposed use is not expected to adversely affect public safety or city services. Traffic impacts are not expected to create excess congestion or wear. 5. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons or property because of excessive tralc, noise, smoke, fumes, glare, odors, dust or vibrations. The proposed use will not be detrimental to surrounding areas. 6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. Wlill fully comply with all other requirements of this Code, including any applicable requirements and standards for the issuance of a license orpermit to establish and operate the proposed use in the city. The use and CUP will comply fully with all requirements of the Code. If denial of such a permit should occur, it shall accompany determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654. In the review of the standards for a CUP as outlined, it appears that the request is consistent with all of these standards. Financial Impact None Statutory Review Period Per State Statute 15.99 the required 60 day review period ends on April 27, 2018. Council Meeting If acted on, this item will go to the April 16, 2018, City Council meeting. Our new facility opened in Elk River this past August and we thank you for the warm welcome to the city. So far we have had great feedback and our business is doing wonderfully with much potential, we hope to be here a long time ahead. Shannon Forsberg is the owner of the establishment and has experience not only in master grooming skills, but also has over 20 years of experience in dog boarding of all settings from high end to farm to corporate settings as well as retail front in Edina and Wayzata. One thing I love about the location on highway 10, is we are separated from other businesses so noise complaints are not an issue O We are hoping to open a dog daycare/small boarding facility beginning in April to add to our already large and reputable grooming business. Hours of operation will be from 6:30am-8:OOpm so the dogs will be supervised during those hours of operation including feedings, medication, potty breaks outside and indoor playtime. Our staff is well educated, the owner is a certified dog trainer having gone through rigorous courses over a 3 year period with a well -renowned dog -trainer named Inga(Owner of Positive Gun Dog Training, and Hippie Dog) as well as we have a manager that has her degree as a Vet Technician. Lilly Bees stands alone in experience hands down next to all competitors. Our groomers are highly skilled and not fresh from a corporate grooming school, we have had teachers of grooming on our staff from high end grooming colleges including Pucci Pet Career Studios. Dog cpr and safety will be taught to all employees. All of our workers will go through a training program in animal behavior and basic manners. We will have 2 to 5 employees on staff, we offer 5 parking stalls, and we offer an indoor and outdoor play area with separation for dogs that are small or not socialized. In the evening we will offer dog training courses Tuesdays through Thursdays to teach basic manner classes to puppies or older dogs, and we are also looking to offer canine good citizen classes in the future.
