11-02-1987 CC MIN e e e MEETING OF THE ELK RIVER CITY COUNCIL HELD AT HANDKE ELEMENTARY SCHOOL MONDAY. NOVEMBER 2. 1987 I Members Present: Mayor Gunkel. Councilmembers Schuldt. Tralle. Dobel. Councilmember Holmgren arrived at 7:06 p.m. Members Absent: None Staff Present: Pat Klaers. City Administrator; David Sellergren. City Attorney; and Terry Maurer. City Engineer. 1. Pursuant to due call and notice thereof. the meeting of the Elk River City Council was called to order at 7:00 p.m. by Mayor Gunkel. 2. Consideration of 11/2/87 City Council Agenda Item 7A - Business Expo was added to the agenda COUNCILMEMBER DOBEL MOVED TO APPROVE THE 11/2/87 CITY COUNCIL AGENDA AS AMENDED. COUNCILMEMBER TRALLE SECONDED THE MOTION. THE MOTION CARRIED 4- O. 3. Consideration of 10/26/87 City Council Minutes COUNCILMEMBER TRALLE MOVED TO APPROVE THE 10/26/87 CITY COUNCIL MINUTES AS SUBMITTED. COUNCILMEMBERDOBEL SECONDED THE MOTION. THE MOTION CARRIED 4- O. 4. Open Mike No one appeared for this item. 5. Main Street Improvements/Public Hearing Mayor Gunkel explained that the people notified for this public hearing are people with front footage on Main Street. Jackson and Proctor Avenue. The public hearing is for the purpose of informing the residents of the improvements which include sanitary sewer. watermain. street and storm drainage. Mayor Gunkel explained that this public hearing will be continued for the purpose of discussing downtown beautification and sanitary sewer assessments for properties not abutting the street improvement. She further noted that properties affected by sanitary sewer assessments and not abutting the street improvement have not been notified of tonights meeting. however. they will be notified of the upcoming December 7. 1987. continued public hearing. Councilmember Holmgren arrived at this time. Page 2 City Council Minutes November 2. 1987 ----------------------------------- e Terry Maurer. City Engineer. handed out an information packet dated November 2. 1987. to all people present. Mr. Maurer then proceeded to explain the Main Street Project in detail by going through the handout. The following was explained by Terry Maurer: project size. street improvements west of Lowell. the Main Street and Tipton Avenue intersection. downtown parking. the existing and proposed sanitary sewer improvements. watermain improvements. Jackson Square parking. and the estimated project costs. Mr. Maurer explained that the existing sewer line along the river is impossible to maintain and is not in good shape. He indicated that the replacement of this line is included in the 5 year Capital Improvement Program. Mr. Maurer explained that the new line will eliminate the use of the old line as a trunk line. but that the old line will still be used as a lateral line. Mayor Gunkel opened the public hearing. Bob Morton - 1107 Main Street - stated One lot consists of front footage on not. Mr. Maurer explained that the Main Street would be determined as buildable. his property consists of two lots. Main Street and the other lot does assessment on the lot not abutting to whether or not the lot was e Mr. Chuck Dare questioned whether the sewer line along the river bank was clay or cement. He also questioned the theory that this sewer line could not be maintained in its current state. Mr. Gary Grills of 1171 Main Street stated that he would like to build a garage on the west side of his house. but the sewer line runs across his lot in that spot. Mr. Maurer informed him that he would not be allowed to build on top of the sewer easement. Cliff Lundberg questioned how corner lot assessments would be handled. The City Administrator explained that one full side would be assessed and 1/3 of the other side. The shorter side of a corner lot. that is in a project where both streets of the corner lot are improved. would receive the full assessment. John McGibbon 1437 Main Street - stated that William Mills was the Engineer at the time the old sewer line was built. He indicated that Mr. Mills has the "asbuilts" for this line. Mr. McGibbon stated that as he could recall. the western portion of the sewer line was probably only 20 years old. He indicated his concern that the City know exactly what exists as sewer line before any decisions are made. Mr. Maurer explained that the main concern is not the age or material of the line but the fact that it cannot be maintained. Mr. McGibbon questioned the proposed design of the intersection at Tipton and Main Street. He questioned why the traffic going westbound must come to a complete stop. Mr. McGibbon further stated that he has checked with the Police Chief who had no direct recollection of any accidents on that e corner. Mr. Dick Gongoll stated he agreed with Mr. McGibbon regarding the intersection at Main and Tipton. He stated he did not feel that hindering the traffic flow would be of a benefit to the downtown area. Page 3 City Council Minutes November 2. 1987 e Cliff Lundberg stated he has heard from a number of Main Street merchants expessing their concern that traffic will be impeded to the downtown area with the proposed intersection. Mr. Lundberg suggested that the City file for a variance from Mn/DOT. Bill Pollard expressed his the curve at Main Street however. he did not feel it concern regarding the speed of traffic around and Tipton; stating that the speed is high. was necessary to put a stop sign in the area. Gary Grills. stated that School should be looked parked cars. the parking along Main Street and across Handke at. He noted his driveway is being blocked by Don Heinzman questioned whether there would be any phasing of the project. Terry Maurer indicated that he did anticipate some phasing in order to work with the schools. residents. businesses and fire department. Mr. Al Nadeau questioned why people were required to install new service pipes for water. e Bob McCartney. representing the Public Utilities. stated that they are recommending replacing the old line because there have been problems with the old line breaking and. in order to repair this. the street has to be dug up. Mr. McCartney also indicated that to replace this line. if broken at a later date. would be a much higher cost to the property owner than the cost of installing a new line at the time of the Main Street project. Jim Simpson questioned the actual size of the project. Sara Mae Moos questioned the amount of assessment as compared to the Jackson Avenue project. Mr. Maurer indicated they would be figured at the same rate. Mayor Gunkel announced that the public hearing will be continued until the December 7. 1987. City Council meeting. Terry Maurer explained that as per State requirements. in order to receive MSA funds to improve the Main Street-Tipton intersection. either a three way stop would be required. or the curve would have to be widened. Mr. Maurer stated that it would be impossible to widen the curve to State requirements because of the house on the corner. He indicated that in order to receive MSA funds and not meet the requirements. a variance would have to be granted to the City by Mn/DOT. Ron part would Kuhn questioned what criteria determines that an area is considered of the downtown. Terry Maurer stated the zoning and use of property be the determining factors. e Mayor Gunkel noted that the Council received a letter from Elmer Anderson regarding the Main Street project which is attached to the official Council minutes. Counci1member Tra11e indicated that the City is receiving MSA funds and further indicated that the City is using approximately 40% of the 1989 and 1990 MSA funds in order to keep the cost to the homeowners down. Page 4 City Council Minutes November 2. 1987 e Councilmember Dobe1 stated that the old sewer line is made of 12" clay pipe. He further stated that there has been an accident at the corner of Main Street and Tipton. COUNCILMEMBER DECEMBER 7, THE MOTION. TRALLE MOVED TO CONTINUE THE MAIN STREET PUBLIC HEARING TO 1987, CITY COUNCIL MEETING. COUNCILMEMBER HOLMGREN SECONDED THE MOTION CARRIED 5-0. 6. EDA Levy/Public Hearing The City Administrator stated that the .75 mill being requested by the EDA will generate $37.500. He stated the budget has been reviewed and the EDA discussed using the funds for the Economic Development Consultant and to begin a marketing campaign for the community. Mayor Gunkel opened the public hearing. There being no one for or against the matter. Mayor Gunkel closed the public hearing. Councilmember Holmgren left the Council chambers at this time. COUNCILMEMBER SCHULDT MOVED TO ADOPT RESOLUTION 87-67. A RESOLUTION AUTHORIZING A LEVY INCREASE IN THE AMOUNT OF .75 MILLS FOR THE YEAR 1988 FOR THE BENEFIT OF THE CITY OF ELK RIVER ECONOMIC DEVELOPMENT AUTHORITY. COUNCILMEMBER TRALLE SECONDED THE MOTION. THE MOTION CARRIED 4-0. e Councilmember Holmgren returned. 7. Other Business The City Administrator distributed documents to the City Council regarding the TIF District #4 (RDF) for extension of sewer and water in the western part of the city. 7a. Business Expo Councilmember Tra1le updated the Council on the Business Expo. He indicated he felt it was very good exposure for the Council and the City to have a booth at the Expo and further stated that there were over 1.000 signatures on the Highway 101 petition. 8. Check Register COUNCILMEMBER SCHULDT MOVED TO APPROVE THE CHECK REGISTER. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5..,.0. 9.
