CU 93-21 ATTACHMENTS Location Map, Zoning Map, Land Use Map, Site Plan, Floor Plan of Restaurant, List of Property Owners . PROPOSED LOCATION 508 Freeport Avenue (Elk River Plaza immediately south of Pamida, formerly the Billiard Center) , Elk River, MN. REQUESTED ACTION A conditional use permit to amend Elk River Plaza PUD Agreement allowing a pizza and pasta restaurant facility. • ZONING/LAND USE PUD (Planned Unit Development) /HB (Highway Business) BACKGROUND In 1987 , Big Wheel Rossi built a new building of approximately 16 ,000 sq ft on Lot 5, Block 1, Elk River Plaza, Second Addition. This development was consistent with the PUD Agreement at that time. In 1989, an amendment to the PUD Agreement to allow recreational facilities was approved by the City Council . Prior to this, another amendment was approved by the City Council permitting professional and business offices . The original PUD Agreement for Parcel F (aka Lot 5, Block 1, Elk River Plaza Second Addition) stated permitted uses would consist of "retail establishments" in accordance with the Cl, C2 , and C3 zoning text. Since a restaurant is not defined as a retail establishment, the PUD Agreement must be amended accordingly. The specific amendment would allow Class I (sit down) restaurants within any bay of the Big Wheel Rossi building (Parcel F) . USE ANALYSIS 110 Amending the PUD Agreement will allow restaurants within the Elk River Plaza development. A restaurant would be compatible P.O. RESTAURANT The proposed restaurant would occupy the vacant space previously occupied by the billiards establishment. The restaurant will occupy roughly 3,400 sq ft of floor area. Mr. LaRose plans on applying for a liquor license from the City Council to sell beer and wine along with ordered entrees . PARKING Based on the existing tenants and vacant future retail establishments within the building, total parking stalls required would be 51 stalls . There are presently 45 stalls available. However, 6 new stalls could be added if a parking problem begins to occur. Installing the additional 6 stalls would meet the current City requirements for parking purposes . Because of different peak hours of operation and 3 bays presently being vacant, parking should not become a problem by adding the restaurant to this multi-bay commercial building. LANDSCAPING • Existing landscaping was installed according to previous landscaping standards . Therefore, the current standard of 1 tree for every 40 feet of perimeter distance is not satisfied. According to the current landscaping standards, 35 trees would be required on this site if it was developed today. The Planning Commission may wish to include a condition whereby some additional trees be installed in an attempt to bring the site into compliance with current landscaping requirements . RECOMMENDATION Staff recommends approval of amending the PUD agreement to allow Class I restaurants on Lot 5, Block 1, Elk River Plaza Second Addition with the following conditions : 1 . IF A PARKING PROBLEM BEGINS TO OCCUR, ADDITIONAL PARKING STALLS SHALL BE INSTALLED TO ALLEVIATE THE PROBLEM. A REVISED SITE PLAN MUST BE SUBMITTED FOR CITY REVIEW PRIOR TO COMMENCING WORK. 2 . IF LIQUOR IS TO BE SERVED WITHIN THE ESTABLISHMENT, A LIQUOR LICENSE NEEDS TO BE OBTAINED FROM THE CITY COUNCIL. 3 .
