CU 93-26 REQUESTED ACTION A conditional use permit request to construct a 2 , 000 sq ft metal skin agricultural accessory building within a platted area and to keep agricultural animals within a platted area. LOCATION OF REQUEST 20493 Meadowvale Road (Lot 4, Block 1, Hilltop Woods Estates) , Elk River, MN. ZONING/LAND USE Rla (Single Family Residential) / LR (Low Density) • ATTACHMENTS Location Map, Site Plan, Zoning Map, Property Owner List. OVERVIEW Mr. Gow is requesting a conditional use permit to construct a metal skin agricultural accessory structure in a platted area and to keep agricultural animals in a platted area. The accessory structure would be used as a stable for Mr. Gow' s horses . The building is proposed to be 2,000 sq ft. Elk River City Code of Ordinance allows accessory structures that are used for agricultural purposes to be a maximum size of 2 ,000 sq ft. FUTURE SUBDIVISION The proposed metal skin building will be located in the recently platted subdivision of Hilltop Woods Estates . The site was platted into seven 2 1/2 acre lots and one 20 acre parcel . The metal skin building and horse corral will be located on the 20 acre platted parcel . This lot is expected to be further subdivided in the future as is indicated by the dash lines on the attached site plan. The status of the agricultural use will be brought into • question when the site develops . It appears unlikely that the keeping of horses will be allowed to continue once the property is subdivided into 2 1/2 acre parcels . It is staff ' s opinion P.O. SETBACKS Elk River City Code requires that all metal skin accessory structures meet a 300 foot setback from any neighboring dwelling. Fences used to contain agricultural animals are also required to meet a 200 foot setback from any neighboring home. Currently, the proposed structure and fence would meet these standards . AGRICULTURAL USE Because of the size of the parcel ( 20 acres) , staff does not have a big concern regarding the agricultural use. The applicant will be required to meet applicable animal ordinance codes . RECOMMENDATION Staff is recommending approval of this conditional use permit to construct a 2 , 000 sq ft metal skin agricultural building within a platted with the following conditions : • 1 . THE COLOR AND ROOF OF THE ACCESSORY STRUCTURE MATCH THE EXTERIOR OF THE HOUSE OR BE OF AN EARTH TONE COLOR. 2 . WHEN THE AREA IS FURTHER SUBDIVIDED, THE ISSUE OF THE AGRICULTURAL USE WILL BE ADDRESSED. 3 . THE ACCESSORY STRUCTURE BE SETBACK A MINIMUM OF 300 FEET FROM ANY NEIGHBORING DWELLING. 4 .
