BACKGROUND
Mr. Ertal is requesting a conditional use permit to construct a
38 'x60 ' metal skin non-agricultural accessory structure.
Non-agricultural accessory structures larger than 1, 000 square
feet in size are required to obtain a conditional use permit in
the Rla zoning district. The applicant owns 4 . 58 acres of
property.
BUILDING SITE
It has come to staff ' s attention that Mr. Ertel has purchased a
45 ' x100 ' piece of property from his neighbor so his proposed
building can fit on his lot without the need for a variance.
To my knowledge, staff has not reviewed this addition of land.
The addition of the 45 ' x100 ' strip of land to his existing
parcel will leave a very odd shaped lot. This may make the
future subdivision of this parcel less efficient due to the
irregular lot lines . Staff is currently working with Mr. Ertel
on a better design of the addition. Therefore, if this
proposal is approved, the applicant will be required to receive
permission from the City of Elk River to add the new parcel .
The City will require that the strip of property be recorded at
• Sherburne County and combined with his existing parcel .
Although Mr. Ertal owns 4 . 58 acres, this particular location is
the best location on this site for the proposed building.

• Other locations would require excessive fill or the loss of
trees .
BUILDING
The proposed metal skin building will be used to store Mr.
Ertel ' s personal items, i .e. , RV, lawn tractors, several
trailers, and other miscellaneous items . A picture of the
proposed building is attached. Currently, Mr. Ertel rents
space for his equipment and would like the option of storing
the equipment at his home. There is an existing detached
garage currently in the approximate location of the proposed
building. The existing garage will be removed to make room for
the new structure. If this structure is approved, staff would
recommend the exterior of the building match the existing home
or be of an earth tone color.
RECOMMENDATION
Staff is recommending approval of the conditional use permit
request to construct a 2,280 square foot non-agricultural metal
skin building as it meets the seven standards for a conditional
use permit with the following conditions :
1 . THE COLOR OF THE BUILDING MATCH THE EXTERIOR OF THE
• HOUSE OR BE OF AN EARTH TONE COLOR.
2 . THE STRIP OF LAND PURCHASED BY THE APPLICANT BE
APPROVED BY STAFF, RECORDED AT SHERBURNE COUNTY, AND
ADDED TO MR. ERTEL' S PARCEL.
