3 PCSR 03-22-1994 pple VEI • MEETING OF THE ELK RIVER PLANNING COMMISSION HELD AT ELK RIVER CITY HALL TUESDAY, MARCH 22, 1994 Members Present: Chairman Tveite, Commissioners Eberley, Kreger, Kuester, Minton, and Tacheny. Members Absent: Commissioner Carr Staff Present: Steven B. Ach, City Planner, Stephen Rohlf, Building and Zoning Administrator, Gary Schmitz, Planning Assistant, Catherine Schmidt, Recording Secretary. 1. Call Meeting To Order Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission was called to order at 7 p.m. by Chairman Tveite. 2. Consider Planning Commission Agenda Commissioner Minton added discussion regarding cities the Planning Commission • members would be visiting. Commissioner Eberley requested to update the Commission regarding items at the last City Council meeting. Chairman Tveite added discussion regarding student involvement on the Planning Commission. COMMISSIONER EBERLEY MOVED TO APPROVE THE AMENDED 3/22/94 PLANNING COMMISSION AGENDA. COMMISSIONER MINTON SECONDED THE MOTION. THE MOTION CARRIED 6-0. 3. Consider Planning Commission Minutes Regarding the 2/22/94 Planning Commission Minutes: Commissioner Eberley commented that the date in Item 4 was incorrect, it should be March 21, 1994. COMMISSIONER MINTON MOVED TO APPROVE THE AMENDED 2/22/94 PLANNING COMMISSION MINUTES. COMMISSIONER KREGER SECONDED THE MOTION. THE MOTION CARRIED 6-0. Regarding the Planning Commission Annual Meeting Minutes: COMMISSIONER MINTON MOVED TO APPROVE THE 1/22/94 PLANNING COMMISSION ANNUAL MEETING MINUTES. COMMISSIONER KUESTER SECONDED THE MOTION. THE MOTION CARRIED 6-0. 4. Planning Commission Representative to Attend City Council Meeting • It was indicated Chairman Tveite would attend the 4/18/94 City Council meeting to be held at Elk River City Hall. Consider Preliminary Plat of North Meadows 2nd Addition, by Joyce Mickelson, Public Hearing, Case No. P 94-03 Staff report presented by Steve Ach. Mr. Ach stated that the applicant has not provided staff with the necessary information for review of the preliminary plat request, therefore, recommended the Planning Commission table this request until the April 26, 1994, Planning Commission meeting. COMMISSIONER KREGER MOVED TO TABLE THE PRELIMINARY PLAT REQUEST BY JOYCE MICKELSON, CASE NO. P 94-03, TO THE APRIL 26, 1994, PLANNING COMMISSION MEETING. COMMISSIONER KUESTER SECONDED THE MOTION. THE MOTION CARRIED 6-0. Commissioner Kreger stated that he has a conflict of interest regarding Agenda Items 6 and 7 and would abstain from discussion and voting on these two items. Commissioner Kreger removed himself from the table. 6. Planning Commission Comments on Gravel Mining Draft EIS Staff report presented by Steve Rohlf. Mr. Rohlf explained that this item was a "discussion" item only, therefore, the Commission did not have to vote on this particular item. However, Mr. Rohlf explained that all comments would be welcomed and forwarded to the City Council. Comments from the Planning Commission included: • 1. Straightline is spelled incorrectly in the DEIS (Straightline is one word, not two). This operator employs five people. 2. The groundwater contours near the Elk River Landfill are incorrect. The contours have been revised on a new groundwater contour map. 3. There is a word missing between pages 3-31 and 3-32. The word influence has been added at the top of page 3-32. 4. The EIS become part of the Elk River comprehensive Plan. 5. Members of the Planning Commission expressed concern that wildlife will be disturbed. Chairman Tveite and Commissioner Minton commended Steve Rohlf for the work and research regarding this item. Mr. Rohlf thanked the Commission and stated the individual gravel miners should also be complimented on their cooperation regarding the joint EIS. Commissioner Eberley stated that the City Council should be made aware of the Planning Commission's strong view regarding restoration. Further, Commissioner Eberley stated she would like to see this document as part of the findings for the update of the Comprehensive Land Use Plan. Consider a Conditional Use Permit Renewal by Commercial Asphalt, Public Hearing, Case No CU 94-07 Staff report presented by Steve Rohlf. Commercial Asphalt requested a two year renewal of their conditional use permit for a gravel mining related facility (temporary asphalt plant). Chairman Tveite opened the public hearing. Nathan Bunker, 20347 Highway 169, Elk River, commented on the odor problem and wanted someone to identify the emissions they are breathing. Al Fifel, Auburn Street, Elk River, stated he is opposed to the renewal of Commercial Asphalt's conditional use permit. Mr. Fifel stated that on certain days, the odor is nauseating and the smoke layer is very thick (photographs and a letters from an area resident were presented to the Commission). Brenda Bunker, 20347 Highway 169, Elk River, stated that she is also opposed to the conditional use permit renewal. The odor is awful on some days and she questioned the quality of air they are breathing. Mrs. Bunker enter two (2) more letters from area residents. Chairman Tveite read the letters and entered them into public record. Gary Sauer, Commercial Asphalt, introduced himself and addressed the Planning • Commission. Regarding the Draft EIS, Mr. Sauer invited the Planning Commission to come to Maple Grove and view their restoration process. Regarding the recycling process and the odor problems, the plant has done much to help reduce the noise, however, the odor problems are somewhat more of a challenge. Mr. Sauer assured the Commission that Commercial Asphalt would do everything possible to try to reduce the odor and smoke including raising the stack and monitoring the smoke levels on a daily basis. They are completely willing to work with City staff and implement suggested modifications as necessary. Further, they are researching the possibility of a new facility north of the present site. Dick Peterson, of Commercial Asphalt, commented on emission monitoring and the actual procedures at the plant. Questions from the Commissioners included explaining the process of recycling asphalt, the mixing operations and State requirements, emission monitoring, and how to monitor and adjust the mixing process to produce lower levels of smoke and odor. Dick Peterson explained the variables involved with the mixing process and how the State must approve all mixing percentages used prior to implementation. Nathan Bunker, 20347 Highway 169, Elk River, stated that every morning there is a smoke and odor and he is very concerned about the quality of air they breathe. Mr. Bunker stated that some days it actually hurts to breathe the air in their own yard. Steve Rohlf explained the possible options for the plant: 1) modify the plant • operation; 2) modify the plant (burner, equipment, etc.); 3) relocation of the pc3-22.minutes Planning Commission Minutes APPROVED Page 4 March 22, 1994 plant. Mr. Rohlf stated that staff is recommending a one year renewal. After one year, a review of the conditional use permit be done before recommending approval of the second year of the conditional use permit or revocation. Commissioner Eberley suggested staff give an update to the Planning commission regarding the modifications sometime this summer. There being no further comments from the public, Chairman Tveite closed the public hearing. COMMISSIONER EBERLEY RECOMMENDED APPROVAL OF THE RENEWAL OF A CONDITIONAL USE PERMIT FOR A GRAVEL MINING RELATED FACILITY (TEMPORARY ASPHALT PLANT) BY COMMERCIAL ASPHALT, INC., PUBLIC HEARING, CASE NO. CU 94-07, CITING STAFF'S MEMO DATED MARCH 22, 1994, PUBLIC HEARING DISCUSSION, INCLUDING ALL BACKUP MATERIAL ATTACHED TO STAFF'S MEMO AS FINDING OF FACT, WITH THE FOLLOWING CONDITIONS: 1. A MAXIMUM OF 30% RECYCLED ASPHALT CAN BE USED IN THE OPERATION IN ORDER TO CONTROL ODOR. IF WEATHER CONDITIONS MAKE ODOR TOO NOTICEABLE, THE OPERATOR MUST TEMPORARILY REDUCE THE PERCENTAGE OF RECYCLED ASPHALT IN THEIR OPERATION UNTIL ATMOSPHERIC CONDITIONS ALLOW THE 30% LEVEL TO CONTINUE. 2. THE LEAD CONCENTRATION IN FUEL OIL COMPLY WITH CURRENT MPCA REGULATIONS OR BE NO MORE THAN 4,000 MKG, WHICHEVER IS LESS. FURTHER, THAT ANALYSIS OF LEAD CONCENTRATION BE PROVIDED AS PER MPCA'S • REQUIREMENTS. 3. A MAXIMUM OF 20% CAPACITY IS ALLOWED FOR EMISSION FROM THE STACK FOR THIS OPERATION. 4. PARTICULATE EMISSIONS BE LIMITED TO A MAXIMUM OF .04 GR/DSCF. 5. ALL CORRESPONDENCE BETWEEN BARTON'S AND MPCA, INCLUDING TEST RESULTS, BE COPIED TO THE CITY. 6. THAT BARTON'S BE ALLOWED TO USE BAGHOUSE FINDS IN THEIR ASPHALT MIX, BUT THAT THESE FINDS MUST BE KEPT IN AN ENCLOSURE TO AVOID WINDBLOWN LEAD CONTAMINATION. 7. THE NATURAL VEGETATION BETWEEN THE PROPOSED ASPHALT PLANT AND HIGHWAY 169 BE LEFT TO ACT AS SCREENING. FURTHER, THAT ADDITIONAL PINES ARE PLANTED TO FURTHER SCREEN THIS AREA. 8. DURING DRY PERIODS, THE SITE MUST BE WATERED TO AVOID DUST. 9. BARTON'S REIMBURSE THE CITY FOR THE COST OF REVIEWING THEIR PROPOSAL. THE CITY HAS THE RIGHT TO CLOSE THIS OPERATION DOWN IF THERE IS IMMINENT DANGER AND THAT CITY STAFF HAS THE RIGHT TO INSPECT THE PREMISES AT ANY REASONABLE HOUR FOLLOWING NOTIFICATION. • 10. THE NORMAL HOURS OF OPERATION FOR THE PLANT ARE FROM 7 A.M. TO 7 P.M., SEVEN DAYS A WEEK. FURTHER, MPCA NOISE LEVELS MUST BE ADHERED TO AT ALL TIMES DURING THE OPERATION OF THIS PLANT. 11. THE BAGHOUSE FILTER IS TESTED ONCE PER MONTH FOR LEAKS AND THE RESULTS OF THOSE TESTS ARE COPIED TO THE CITY. 12. THIS CONDITIONAL USE PERMIT BE REVIEWED IN ONE YEAR AND A NEW PERMIT BE OBTAINED AT THAT TIME. 13. STOCKPILES OF RECYCLABLE MATERIALS NOT BE PLACED IN SURFACE WATER AND THAT RUN-OFF FROM THESE STOCKPILES IS DIRECTED AWAY FROM ANY SURFACE WATER. THE SIZE FOR THE STOCKPILES BE LIMITED TO THE AMOUNT OF MATERIAL THAT COULD POSSIBLE BE USED IN ONE YEAR, NOT NECESSARILY TO WHAT WILL BE USED IN ANY ONE GIVEN YEAR. FURTHER, THE CITY UNDERSTANDS THAT WITH THIS CONDITION, SOME RECYCLABLE MATERIALS WILL BE RETAINED OVER THE WINTER SO RECYCLING CAN START AT THE SAME TIME AS SPRINT START-UP FOR THE ASPHALT PLANT. 14. COMMERCIAL ASPHALT CONTINUE TO WORK WITH CITY STAFF TO RESOLVE PROBLEMS WITH ODOR AND NOISE. 15. AT STAFF'S DISCRETION, COMMERCIAL ASPHALT IMPLEMENT PART OR ALL OF THE ACTIONS IDENTIFIED BY STAFF TO ELIMINATE SEDIMENT FROM BEING INTRODUCED TO THE POND ON THE EAST SIDE OF HIGHWAY 169. • 16. COMMERCIAL ASPHALT SHALL REDUCE ODOR FROM THEIR PLANT TO ACCEPTABLE LEVELS BY MODIFYING THEIR OPERATIONAL PROCEDURES OR PLANT EQUIPMENT. THE ELK RIVER PLANNING COMMISSION WILL REVIEW THE ODOR ISSUE AGAIN IN JUNE, 1994. COMMISSIONER MINTON SECONDED THE MOTION. THE MOTION CARRIED 5-0. Mr. Rohlf asked the Planning Commission to consider Agenda Item No. 9 next. The Planning Commission agreed. 9, t, date of Issues Related to Custom Motors Staff report presented by Steve Rohlf. Mr. Rohlf updated the Planning Commission on the status of screening and environmental clean-up at the Custom Motors site. Staff recommended no screening if Custom Motors is rezoned to single family residential and is required to relocate, and no environmental clean-up until after the relocation takes place (if in 5 years or less). Staff indicated their recommendation would change on these issues if the Custom Motors site is not rezoned and they are not required to relocate. The Planning Commission concurred with staff. 8. Consider a Rezoning Request by the City of Elk River, Public Hearing, Case No. ZC 94-02 • Staff report presented by Steve Ach. The City is requesting a rezoning of approximately 15 acres from Il (Light Industrial) to Rib (Single Family Residential). pc3-22.minutes INNFirffil Planning Commission Minutes Page 6 March 22, 1994 • Chairman Tveite opened the public hearing. Jerry Gallati, 18738 Queen Street, Elk River, stated he is upset by the rezoning request due to the costs involved. He is opposed to the rezoning. He also commented on the need for the services provided by Custom Motors. Sandra Roy, 28008-152nd Street, Elk River, is opposed to the rezoning. Mr. and Mrs. Roy own Custom Motors and this rezoning and relocation will be economically devastating for them. Mike Boelter, 600 Highway 10, Elk River, is also opposed to the rezoning request. Mr. Boelter stated that in addition to a convenient location for his business, relocating (due to the proposed rezoning request) could increase his time to respond to the requests from the Elk River City Police and the Sherburne County Sheriff's Office. Tom Driessen, 324 Main Street, Elk River, stated that if the proposed rezoning is financially devastating for Custom Motors, the City should not approve the rezoning. There being no further comments from the public, Chairman Tveite closed the public hearing. Chairman Tveite asked Mr. & Mrs. Roy if they have located any alternative sites. • Mr. & Mrs. Roy responded they have not. Commissioner Kreger stated that he does agree with staff regarding the rezoning request, however, he feels Mr. & Mrs. Roy should receive some assistance from the City. Commissioner Kreger stated he would like to table this request to the next Planning Commission meeting and directed staff to research possible assistance measures. Commissioner Eberley agreed with Commissioner Kreger and requested "current" legal comments, an EDA proposal, a relocation plan for Custom Motors, and information from any other sources available to staff before making a decision regarding this request. COMMISSIONER KREGER MOVED TO TABLE THE REZONING REQUEST BY THE CITY OF ELK RIVER, CASE NO. ZC 94-02, TO THE APRIL PLANNING COMMISSION MEETING PENDING RESEARCH BY STAFF. COMMISSIONER MINTON SECONDED THE MOTION. THE MOTION CARRIED 6-0. Due to the possibility of a perceived conflict of interest, Commissioner Eberley stated that she would refrain from discussion and voting on Agenda Item 10 and removed herself from the table. 10. Consider a Conditional Use Permit Request by James Thompson, Public Hearing, Case No. CU 94-04 • Staff report presented by Gary Schmitz. Ed Shimek, 9974 Highway 10, Elk River, stated that he is not opposed to the request however, he would like to see large vehicles moved to the back of the site due to possible visibility problems for Mr. Shimek's business. James Thompson, 9975 Highway 10, Elk River, expressed a willingness to work with Mr. Shimek and agreed to keep high profile vehicles in toward the back of his site. There being no further comments from the public, Chairman Tveite closed the public hearing. COMMISSIONER KREGER MOVED TO RECOMMEND APPROVAL OF THE CONDITIONAL USE PERMIT REQUEST TO OPERATE A SALES LOT AND CONSIGNMENT SALES BY JAMES THOMPSON, PUBLIC HEARING, CASE NO. CU 94-04, CITING STAFF'S MEMO AS FINDING OF FACT. THE REQUEST MEETS THE SEVEN STANDARDS FOR GRANTING A CONDITIONAL USE PERMIT AND IS CONSISTENT WITH THE COMPREHENSIVE PLAN. APPROVAL IS RECOMMENDED WITH THE FOLLOWING CONDITIONS: 1. THE ENTIRE PARKING AND DISPLAY AREA BE OVERLAYED WITH A BITUMINOUS SURFACE AND STRIPED. 2. NO DISPLAY OF VEHICLES BE ALLOWED ON LANDSCAPED AREAS. • 3. THE TRASH RECEPTACLE ON THE SITE BE SCREENED WITH MATERIALS COMPATIBLE WITH THE FRONT SIDE OF THE BUILDING. 4. The applicant, James Rossman, • requested a conditional use permit for a zero lot line development for a shared 24 foot wide driveway. The proposed development for the new parcels involves a zero lot line for a shared driveway. Since the administrative subdivision request is only subject to City Council review, the Planning Commission reviewed the conditional use permit request. CU 94-06, CITING STAFF'S MEMO AS FINDING OF FACT. THE REQUEST MEETS THE SEVEN STANDARDS FOR GRANTING A CONDITIONAL USE PERMIT AND IS CONSISTENT WITH THE COMPREHENSIVE PLAN. Mr. Busillo indicated that he would be the only employee of this business. Chairman Tveite opened the public hearing. Consider a Request for Comprehensive Land Use Plan Amendment and Rezoning by the City of Elk River, Case No. LU 94-02 and ZC 94-03 Staff report presented by Steve Ach. The City requested a Comprehensive Land Use Plan Amendment changing the land use from HR (High Density Residential) to MR (Medium Density Residential), and rezoning from R4 (Multi-family Residential) to R1 c (Single Family Residential). Chairman Tveite opened the public hearing. There being no comments from the public, Chairman Tveite closed the public hearing. COMMISSIONER KREGER RECOMMENDED APPROVAL OF THE COMPREHENSIVE LAND USE PLAN AMENDMENT CHANGING THE LAND USE FROM HR (HIGH DENSITY RESIDENTIAL) TO MR (MEDIUM DENSITY RESIDENTIAL) BY THE CITY OF ELK RIVER, PUBLIC HEARING, CASE NO. LU 94-02, CITING STAFF'S MEMO AS FINDING OF FACT. APPROVAL IS RECOMMENDED WITH THE FOLLOWING CONDITIONS: 1. THE LAND USE PLAN CHANGE WILL PROVIDE SOME CONTINUITY WITH THE INTENDED USE AS PARK AND THE EXISTING PARK AREA. 2. ZC 94-03, CITING STAFF'S MEMO AS FINDING OF FACT. APPROVAL IS RECOMMENDED WITH THE FOLLOWING CONDITIONS: 1. TIMES AND CONDITIONS HAVE CHANGED TO WARRANT THE REZONING FROM MULTI-FAMILY TO SINGLE FAMILY. 2. THE REZONING WILL BETTER REFLECT THE INTENDED USE OF THE PROPERTY AS PUBLIC PARK. 3. Chairman Tveite spoke to the Commission regarding the possibility of students participating in the Planning Commission meetings and asked staff and the Commission for discussion. Steve Ach stated that it may take an ordinance amendment to add students as voting members and added that there may be other ways for youth involvement rather than becoming a voting member. Discussion ensued. Steve Ach briefed the Commission regarding the workshop "Beyond the Basics" and stated that anyone interested in this workshop should contact him. • 15.
