PUBLIC HEARING CASE P94-2 ISSUE Consider request for preliminary plat by Country Ridge Partnership to subdivide approximately 40 acres into 73 single family lots. LOCATION NE corner of the extension of Joplin Street on County Road 30. • ATTACHMENTS Revised preliminary plat. Unapproved minutes from the March 21 City Council meeting. Unapproved minutes from the February 22 Planning Commission meeting. Report to the Planning Commission dated February 22, 1994. Memorandum to the Park and Recreation Commission dated March 31, 1994. BACKGROUND The Planning Commission originally recommended approval of this preliminary plat as it was presented which consisted of 97 lots throughout the entire 40 acre parcel. However, at the City Council meeting Park and Rec Commission Chairman Dave Anderson, offered some comments regarding the number of trees that existed along the north end of the project and expressed an interest to save these trees. One option expressed by Mr. Anderson was to have approximately the northerly seven acres dedicated as park to assure complete protection of the large stand of trees. The other option would be to increase the lot sizes considerably to enhance the preservation of the trees. The City Council directed staff to meet with the • developers and present a revised plat to the Park Commission for their consideration as well as bringing the plat back to the Planning Commission. Box 490 • 13065 Orono Parkway • Elk River, MN 55330 • (612) 441-7420 • Fax: (612) 441-7425 Country Ridge Page2 P94-2 • Therefore, before the Planning Commission this evening is a revised preliminary plat of Country Crossings which includes the requested park dedication of approximately 7 acres along the north edge of the property and a reduction in number of lots from 97 down to 73. ANALYSIS For the most part, the design of the plat is consistent with what was previously presented to the Planning Commission on February 22. Basically 24 lots have been deleted from the plat and the internal streets have been shortened to accommodate the 7 acre park along the north edge of the plat. The following are some of the changes that were made as part of the revised plat: • The road accessing the plat from Orono Parkway has been aligned in a manner that will reduce the number of trees lost during construction. • The plat no longer includes trail corridors at the NE and NW corners of the plat. • 182nd Avenue off of Joplin Street has been shifted 100 feet to the south as a result of lots being adjusted. • The revised plat presents no new issues that were not covered in the original staff report to the Planning Commission. However, there is one adjustment that will need to made to the plat which relates to all corner lots. The zoning ordinance requires all corner lots to be increased by 20 feet; therefore, all corner lots will need to be 100 feet in width. YARD TREE REQUIREMENTS Upon further review of the City's subdivision ordinance, it was discovered that front yard trees are required as part of all subdivisions. To the best of my knowledge, this standard has not been implemented in other subdivisions. This standard specifically requires one 2" caliper tree to be provided every 60 feet throughout the plat. Beginning with the Country Crossings plat, all further plats will be required to provide a front yard tree. However, it is recommended the 60 foot interval be amended to read each lot provide a front yard tree. Staff would like to bring back to the Planning Commission an ordinance amending this section. PARK AND RECREATION RECOMMENDATION • THE PARK AND RECREATION COMMISSION REVIEW THE REVISED PRELIMINARY PLAT ON APRIL 6. THE PARK COMMISSION APPROVE pc-cridge Country Ridge Page3 P94-2 • THE PROPOSED DEDICATION OF 7 ACRES ALONG THE NORTH EDGE OF THE PLAT FOR PARK PURPOSES. THIS LAND DEDICATION OF 7 ACRES, IN CONJUNCTION WITH 3 ACRES SOUTH OF COUNTY ROAD NO. 30, WILL SATISFY IN FULL THE PARK DEDICATION REQUIREMENTS FOR THE ENTIRE SINGLE FAMILY DEVELOPMENT BY COUNTRY RIDGE PARTNERSHIP. STAFF RE COMMENDATION STAFF RECOMMENDS APPROVAL OF THE REVISED PRELIMINARY PLAT BY COUNTRY RIDGE PARTNERSHIP TO SUBDIVIDE APPROXIMATELY 40 ACRES INTO 73 SINGLE FAMILY LOTS WITH THE FOLLOWING CONDITIONS: 1. A PLAN BE SUBMITTED TO THE CITY IDENTIFYING THE LOCATION OF ALL MAILBOXES AND A DETAIL ILLUSTRATING THE UNIFORM MAILBOX DESIGN THAT WILL BE USED THROUGHOUT THE PLAT. 2. THE DEVELOPER PROVIDE A LANDSCAPE PLAN TO THE CITY FOR APPROVAL ILLUSTRATING BERMING AND LANDSCAPING • ALONG JOPLIN STREET AND COUNTY ROAD NO. 30. SAID PLAN SHOULD CONSIST OF CONIFER AND SHRUBS WHICH HELP BUFFER AND PROVIDE AN AESTHETIC STREET SCAPE. 3. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 4-0. � f`/.l 1 Update on Elk Park Center Steve Ach indicated that the Planning Commission will be reviewing the development plans of the first phase of Elk Park Center at a special meeting on March 29. The City Council will then meet to discuss the situation on April 21. 0 Preliminary Plat request by Country Ridge Partnership/Public Hearing P-94-02 Steven Ach indicated that Country Ridge Partnership has requested preliminary plat approval to subdivide approximately forty acres into 97 single-family lots. The location of the plat is the northeast corner of the extension of Joplin Street and County Road No. 30. Steve Ach indicated that all the lots meet the minimum lot size requirements for R 1 a zoning standards, however, the configuration and minimum depth of some lots originally proposed have limitations for constructing homes. The plat has been revised to meet these situations. Steve Ach reviewed the changes. Steve Ach reviewed the Park and Recreation Commission's recommendation for a trail system within the plat and the extension of Joplin between County Road 30 and Highway 10. • Steve Ach indicated that the Planning Commission recommended approval of the preliminary plat. Mayor Duitsman opened the public hearing. Mayor Duitsman expressed Councilmember Scheel's concerns regarding the mailbox requirement in the plat and the concern of the trails affecting the back yards of those along Joplin Street. Dave Anderson, Park and Recreation Commission Chair, indicated that the trail was originally intended to be a direct connection from the Heritage Landing plat. After talking to residents, a new plan was drafted by staff which runs the trail west along Mississippi Road, east of Joplin. He also expressed his concern that there may not be enough room for the trail between the road and the power poles. He indicated that this is a very important link to the trail system. Dave Anderson, 14845 County Road 30, stated that he would like to see the developer and the city work together to develop a plat that would incorporate some very old trees that are located on the north one-quarter of the plat. Dave Anderson spoke to the uniqueness of the site and the fact that it contained over 150 oak trees. He indicated that the significance of the site was overlooked by staff and by the Park and Recreation and Planning Commissions. He also indicated his concern regarding the minimum lot sizes. • Mayor Duitsman and Councilmember Dietz indicated their concern regarding the lot sizes and the originality of the plat. He also indicated his support for preserving the trees in the plat. Jay Johnson, representative of Country Ridge Partnership, stated that the number of proposed homes is necessary in order to maximize the use of the plat. He stated that the average lot size is 2,000 square feet larger than required. He indicated that Country Ridge Partnership is also in favor in preserving trees, and suggested preserving the trees on Outlots A and B. Mayor Duitsman closed the public hearing. Councilmember Holmgren questioned the reasoning for the naming of Hudson Lane and Hudson Street. He stated that this may be confusing during emergency responses. He also spoke to the issue of tree preservation. He stated that although he is in favor of tree preservation, this may not be the proper time to request the trees be saved. He questioned how the developer could deal with this issue at this point in time without spending a large amount of money. Peter Beck, the City's Attorney indicated that the City's existing ordinance allows for tree preservation. Councilmember Farber spoke to the inconsistency in requiring park land versus payment in lieu of park land for developers. He stated that he would like to see a • park in the area of the plat. Councilmember Dietz indicated that there were several lots less than 10,500 sq. ft. in the plat. He indicated his concern regarding traffic safety in relation to the number of homes in the plat. Mayor Duitsman indicated that he would prefer to see park land in lieu of payment. COUNCILMEMBER HOLMGREN MOVED TO CONTINUE THIS ISSUE UNTIL THE MARCH 28, 1994, CITY COUNCIL MEETING TO ALLOW STAFF TO DETERMINE A TIMETABLE THAT WILL ALLOW THE DEVELOPER TO CONSIDER REVISING THE PLAT AND FOR THE PLANNING COMMISSION AND CITY COUNCIL TO REVIEW THE REVISIONS. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 4-0. The City Council recessed at 9:25 p.m. and reconvened at 9:32 p.m. 8.1. Consider resolution approving clans and specifications and authorize the advertisement for bids for the Wastewater Treatment Plant interim plan improvement project Terry Maurer, City Engineer, indicated that the plans for the interim improvement to upgrade the wastewater treatment plant have been completed and reviewed and approved by the Minnesota Pollution Control Agency. The applicant requested preliminary plat approval to subdivide approximately 40 acres into 98 single family lots. Tony Emmerich, applicant, asked if the park trail could be in front of the yards, not on the back side. Mr. Emmerich stated that it is hard to sell lots with trails in the rear yards and had concerns relative to security and privacy of property owners next to the trail. Dave Anderson, Chairman of the Park and Recreation Board, reviewed the options presented to the Park and Recreation Board and explained why this option was chosen. Mr. Emmerich requested if the trail is constructed within rear yards that he be given a credit to erect a privacy fence between the trail and the homes. Further, • he stated he did not intend to comply with two requirements in staff's memo, condition #7 and #14. Commissioner Kreger questioned Mr. Emmerich as to why he would not comply. Mr. Emmerich replied that he would not initiate public improvements for the Joplin Street extension and pay the entire cost of extending Joplin Street to Highway 10. Also, the building that must be removed is Mrs. Lakoduc's home and he would not inconvenience Mrs. Lakoduc. Steve Ach responded that condition #7 could be re-worded so the developer would not have to petition the City for public improvements, however Mr. Emmerich would be responsible for a portion of the improvement. Mr. Ach also stated that platting Joplin Street with a building in the right of way would present problems for construction of Joplin. However, he would have to check with the City Attorney if these are options for moving the building from the right of way. Chairman Tveite opened the public hearing. Sue Hecker, 13196 Mississippi Road, E.R., stated her concerns regarding the park trail. She is not in favor of the trail being behind the homes due to lack of privacy and questionable security. Steve Ach briefly reviewed the trail system for this area and suggested the Park and Recreation Board consider wider "corridors" for trails through residential areas to avoid potential problems of infringing upon resident's privacy. Dave Anderson responded. Discussion ensued between the Commissioners, staff, and Mr. Anderson. • Maria Darikson, 18210 Fresno Street, questioned what type of construction will be taking place to build these trails - will there be construction on Fresno? There was discussion among the Commissioners relating to sedimentation collected in the pond and if the pond is lined. Terry Maurer responded that the pond is not lined and sedimentation would be cleaned out about every ten years. As presented, the plat meets these minimum standards. EXISTING CONDITIONS The 40 acre parcel is bounded by County Road No. 30 on the south, existing single family on the east, County Fairgrounds to the north, and the Lakoduc homestead on the west. Staff is recommending the access on to County Road No. 30 be removed to reduce the number of turning movements on to the County road. This was also recommended by the County Engineer upon his review of the plat. As mentioned, all the lots meet the minimum standards, however, Lot 1, Block 6, is a lot which will be difficult to locate a house and will restrict expansion (i.e., deck, porch) opportunities without requesting a variance. Therefore, it is recommended the lot be eliminated and the difference be added to the other lots within Block 6. ROADWAY IMPROVEMENTS To facilitate the development of this plat, two roadway projects external to the plat will need to occur. First, Joplin Street will need to be extended north from County Road No. 30 to Highway 10. This road is not expected to be a parkway design rather a typical collector with sidewalks. The second is the westward extension of Orono Parkway connecting with Joplin Street. Staff • expects the design of Orono Parkway to be a continuation of the parkway design that is presently in place to Joplin Street. However, west of Joplin it is anticipated that a typical residential road would be constructed to serve the new residential area as well as Sandpiper Estates. GRADING/UTILITY PLAN Terry Maurer is reviewing a preliminary grading and utility plan for the proposed plat. This information was received rather late, therefore, Terry's memo will be added to the Planning Commission report or be distributed at Tuesday night's meeting. TREE PRESERVATION The north end of the plat has a large mass of significant trees. It is recommended that the developer and builders make every effort to protect and preserve as many trees as possible during construction. Appropriate fencing should be utilized during construction to assure tree protection. • Country Ridge Partnership,. • Page 3 February 22, 1994 • PERIMETER/LANDSCAPING To assist in buffering the homes that back up to County Road No. 30 and Joplin Street, it is recommended berming and landscaping be provided. The berm should be natural in appearance and have landscaping material incorporated (such as conifers) that provide a year-round screen. A plan should be submitted by the developer for staff review prior to the City Council meeting. MAILBOXES A typical condition in residential developments is to ask for cluster mailbox designs. In addition, to improve design continuity within the subdivision, a uniform mailbox design should be used throughout the plat. A plan identifying location of mailboxes and a detail illustrating the style of mailboxes should be provided to the City prior to releasing of the final plat for recording. ENVIRONMENTAL ASSESSMENT WORKSHEET • This plat, in and of itself, does not require an Environmental Assessment Worksheet (EAW). However, the developer owns additional land adjacent to this plat which exceeds the threshold for a mandatory EAW. Therefore, an EAW is in the process of being prepared for distribution to the appropriate agencies and review by the City Council. This process will need to be completed prior to receiving final plat approval by the Council. PARK COMMISSION RECOMMENDATION Attached is a memo from Phil Hals outlining the Park Commission's recommendation for park and recreational needs for this plat. The sole purpose of this meeting is to evaluate a revised Park Dedication proposal that is associated with the Country Ridge plat. As you may know, Chair Dave Anderson offered some comments to the City Council when the Country Ridge preliminary plat was before them. The comments from Dave related to the environmental value of the approximately 7 acre oak tree area in the • north part of this plat (directly south of the proposed Orono Parkway, which runs along the southern boundary of the County Fairground property). The Commission has reviewed this plat a number of times as it relates to the proposed trail. The developers control approximately 160 acres of property that was formerly owned by the Lakoduk family. Approximately 120 acres of this property is planned for residential development. During a concept review of the entire residential development area, some park land was designated along Joplin Avenue south of County Road 30. The remaining park dedication requirements were going to be fulfilled through cash payments. A meeting has been held with the developers, and a revised proposal has been presented. This revised plat proposal calls for the northern boundary of the plat to be very close to the southern boundary of this tree area. The developers are also proposing to dedicate approximately 7 acres of this tree area as "park land" in order to meet their park dedication requirements for the entire 120 acres of residential land. As a City and a Park and Recreation Commission, I believe we must also insist on a 3 acre park south of C.R. 30 in order to have the developer meet our park dedication requirements for the 120 acres. Approximately 10 acres of park land for 120 acres of residential • property is slightly less than our general rule of 10%. The developer would still have a road coming through this tree area to access the plat, and the P.O. Essentially, in order to save the trees, the developer has offered this property to the City in order to meet their park dedication requirements. The issue before the Park and Recreation Commission is whether or not this park dedication proposal meets with its goals and objectives for park land in this part of the community. The developer believes that the only way to realistically save most of the trees in this area is to simply not develop in this 7 acre area. The developer believes that if they try to create lots among the trees that, unfortunately, most of the trees will be lost. • •
