REQUEST
Wendy's International is requesting a conditional use permit for site plan
review to construct a restaurant facility as part of the Elk Park Center PUD
(Planned Unit Development).
LOCATION
• The northeast corner of Freeport Avenueand 192nd, Lot 1, Block 1, Elk Park
Center.
ZONING / LAND USE
PUD (Planned Unit Development) / HB (Highway Business)

OVERVIEW
The Elk Park Center PUD (Planned Unit Development) has been structured
to require each new development to obtain a conditional use permit prior to
commencing construction. This request by Wendy's is the first application to
come forward since the approval of the main shopping center, which lies west
of Freeport Avenue.
The proposed site is a triangular piece of property located at the northeast
corner of 192nd, which is the access road off of Highway 169 and Freeport

Avenue. Similar to the main shopping center, this property has two (2)
utility easements bisecting the property. The first is a one hundred (100) foot
utility easement for United Power Association (UPA) and the second is a
seventy-five (75) foot easement for Northern Natural Gas, which overlaps the
previously mentioned utility easement by fifty (50) feet. In total, the
easement is one hundred twenty-five (125) feet in width. These two utility
easements, along with the irregular shape of the parcel limit the possibilities
for designing the site.
SITE PLAN REVIEW
The following are a list of comments based on the proposed plans presented
by Wendy's:
A. Site Plan
1. The proposed parking area and building meet the required
setbacks approved for the Elk Park Center PUD
2. A letter from Northern Natural Gas and UPA will need to be
• provided authorizing use of their easement for parking purposes
and the construction of a trash enclosure prior to issuing a
building permit.
B. Parking and Circulation
1. It is recommended that three parking stalls and stripped island
immediately north and east of the trash enclosure respectively,
be removed and replaced with a landscaped area. This area can
be used to screen the trash enclosure and allow vehicles to enter
the site without conflicting with parking maneuvers.
2. The driveway on the south side of the building should be
increased to twenty-four (24) feet in width to allow vehicles the
opportunity to bi-pass vehicles waiting at the pick-up window.
C. Landscaping
1. Underground irrigation should be provided throughout all
landscaped areas.

2. The entrance drive should be accented with a planting theme
similar to that approved for the main shopping center on the
west side of Freeport Avenue.
3. The landscaped area along the south property line should
include a hedge similar to that proposed along Freeport or some
conifers to help buffer the drive-up window.
4. All landscaping should be removed from the thirty (30) foot sight
visibility triangle to allow adequate visibility for vehicle traffic.
5. By removing the parking stalls around the trash enclosure,
additional landscaping can be provided to help screen the trash
enclosure area.
6. All disturbed areas will need to be sodded.
D. Pedestrian Circulation
1. Sidewalk in front of the building should be a minimum of six (6)
• feet in width. This will allow four (4) feet of space for
pedestrians and two (2) feet of overhang for the vehicles.
2. Handicap ramps will need to be provided on site.
3. It is suggested a segment of sidewalk be provided from the
sidewalk along Freeport Avenue to the parking area allowing
pedestrians access without crossing the landscaped area. One
location may be immediately west of the building as it aligns
with the sidewalk in front of the building.
E. Refuse Collection
1. Trash enclosures shall be constructed of masonry material to
match the proposed building and have gates.
F. Drainage and Utilities
1. Refer to Terry Maurer's memo dated July 19, 1994 for additional
information.

G. Building Elevations
1. The proposed building will consist of a brick veneer along with
an accent band of split-faced concrete block. A copper facia will
span the front and wrap around each side of the building. The
copper facia will continue around the top of the building acting
as a parapet wall to screen all rooftop equipment.
H. Signage
1. The proposed signage consists of one wall sign facing Highway
169 and roughly an eight (8) feet wide by nine (9) feet high
monument style sign at the southeast corner of the site. Both
signs meet the guidelines for the Elk Park Center PUD as
approved and made part of the Planned Unit Development
Agreement (see attached for specific requirements).
2. Directional signage will also be provided on site which includes
an enter, exit, and pick-up window sign. Since this restaurant
has a drive-up window, there will also be a menu board located
• on the west side of the building which is approximately six (6)
feet and nine (9) feet wide. These signs will have to meet the
required dimensions as set forth in the City zoning ordinance.
I. Lighting
1. On-site lighting should consist of poles that will match those
proposed for the main shopping center.
RECOMMENDATION
It is recommended the Planning Commission recommend approval of the
conditional use permit request by Wendy's International to construct a
restaurant facility within Elk Park Center PUD with the following
conditions:
1. ALL COMMENTS STATED WITHIN THIS MEMO AND
INCLUDING TERRY MAURER'S MEMO DATED JULY 19,
1994, BE INCORPORATED INTO THE PROPOSED
DEVELOPMENT PLANS.

CIVIL ENGINEERING WENDY'S SITE PLAN REVIEW
ENVIRONMENTAL Dear Mr. Ach:
MUNICIPAL As requested, we have reviewed the site plan information for the proposed Wendy's site in
the Elk Park Center Development. The information we reviewed was prepared by Loucks
and Associates, Inc. and was dated June 29, 1994.
PLANNING
The grading plan contained within the packet of information now reflects the accurate
STRUCTURAL representation of the proposed grades for Freeport Avenue and 191st Street. The grading
• internal to this site is appropriate for this location. There is a 934 contour labeled at the east
SURVEYING side of the site which we believe is actually 933 and is just mislabeled. The grading plan
allows for drainage to be channelled internally to two locations where it is proposed to be
picked up with storm sewer which will connect to the existing storm sewer on Freeport
TRAFFIC Avenue.
TRANSPORTATION The utility plan shows a 6-inch water line and a 8-inch sanitary sewer line in the location that
the stubs are proposed to be placed on the Freeport Avenue Project. I believe the City's
construction plan was to extend the utilities approximately 10 feet into the property to avoid
conflicts with the sidewalk along Freeport. The developers of the Wendy's restaurant should
verify the location of the sewer stubs prior to beginning construction on this site.
The access to the site is by one driveway located approximately mid-lot on Freeport Avenue.
Having only one access point requires traffic to flow around the restaurant building. We
would recommend that the driving lane on the south side of the proposed building be
widened from 20 feet to 24 feet. This will provide more room should a vehicle be parked
at the drive up window with another vehicle trying to pass on the south side. We believe the
1326 Energy Park Drive 20 foot width on the east side of the building is adequate since it is likely that only one

I• SIGN REQUIREMENTS
a. General Guidelines
1. All signs within Elk Park Center (EPC) Planned Unit
Development (PUD) must consist of materials and a design which
compliments the architectural elements of the principle building and
character of the project.
2. All freestanding signs shall have a minimum ten (10) foot
setback from all property lines.
3. Prior to installing any signs, a sign permit must be obtained
from the City Planning Department.
b. Development Sign (Along Highway 169)
1. One freestanding development sign identifying EPC will be
1111 permitted at the corner of Highway 169 and 192nd Avenue.
2. This sign may have a maximum height of thirty (30) feet and
width of seventeen (17) feet. The number of tenants allowed on
this sign shall be limited to two (2).
3. Attachment A, - an illustration of the approved development
sign.
c. Development Sign (Jackson Road and Freeport Avenue)
1. A second development sign may be installed at the
intersection of Freeport Avenue and Jackson Road.
2. This sign may have a maximum height of eight (8) feet and a
width of sixteen (16) feet. Total area shall not exceed one
hundred, twenty-eight (128) square feet.
3. Said development sign may identify two (2) of the tenants
within Elk Park Center.
• 4. Sign must be of a monument style and be constructed as
illustrated in Attachment B.

• d. Tenant Identification (Along Jackson)
1. A monument style sign may be located at the intersection of
Jackson Road and southernmost entrance to the project.
2. This sign shall have a maximum height of six (6) feet and a
width of four (4) feet.
3. The purpose for this sign is to identify the anchor tenant
(Target) located at the southerly end of the project.
4. Said sign shall be constructed in accordance with the
illustration on Attachment B.
e. Monument Sign For Freestanding Sites
1. Each of the freestanding buildings within EPC will be
allowed to have a freestanding sign. The freestanding sign must
be of a monument style with a maximum height of ten (10) feet and
a maximum area of one hundred (100) square feet.
• 2. Attachment C illustrates a typical monument sign ign for
freestanding buildings.
f. Wall Signs (Freestanding Sites)
1. Wall signage for each freestanding building must consist of
individual letters and shall not have more than one (1) wall sign for
each principal building except that where the building abuts two (2)
or more public streets.
2. The gross surface area of a wall sign for freestanding
buildings shall not exceed ten (10) percent of the area of the
building wall, including doors and windows, to which the sign is to
be affixed.
g. Wall Signs (Multi Tenant Building)
1. Fascia signs for individual retail tenants shall be for store
identity only.

2. Capitol letters shall be no larger than 32" high, lower case
letters shall be no larger than 24" high. Signs shall be centered
over the entrance doors to the tenant space, or the leased area,
but in no case shall they extend closer than 3'-4' from the projected
lease line.
3. These signs shall be internally illuminated, individual letters
placed on a 4" square electrical raceway, painted to match the
brick facia.
4. No signage shall be permitted on the sides or rear of the
building, other than that required for delivery identification or traffic
control.
5. Attachment D illustrates a typical wall sign.
h. Major Tenant Signage

"Pharmacy" sign with 2'-0" (approximately) internally illuminated
letters shall be placed adjacent to the entrance.
2. Signage for the other anchor tenant, Cub Foods, shall be
compatible with both Cub's requirements and City approval. All
signage shall be internally illuminated, individual letters; proposed
signage includes the following:
"Cub" approximately 10'-0" high
"Foods" approximately 6'-0" high
"24 Hour Savings" approximately 3'-0" high
"Pharmacy" approximately 2'-0" high
Other Signs
1. All other signage that may occur within Elk Park Center PUD
and not specifically mentioned herein shall comply with Section
900.22 of the Elk River City Code.
2. Requests for signage that is not specifically mentioned
