CITY OF ELK RIVER FOR THE
MINERAL EXCAVATION DISTRICT/
PUBLIC HEARING CASE NO. ZC-94-09
REQUEST
The City is initiating a zone change to "Mineral Excavation Overlay District"
on most of the parcels that were included in the study area as identified in
the Environmental Impact Statement on mineral excavation. Some property
owners included in the study area requested not to be part of this zone
change request.
• LOCATION
The properties proposed to be rezoned to "Mineral Excavation Overlay"
include parts of Sections 2, 3, 4, 9, 10, 11, 15, 16, 17, 21, and 22; all in
Township 33, Range 26, Sherburne County, Minnesota. A complete legal
description is available upon request. Map "A" attached to this memo, shows
the location of the parcels where the property owners requested to be part of
this rezoning.
ANALYSIS
With an overlay district, the underlying zoning and the rights that go along
with that zoning designation remain in effect. The parcels involved with this
request are currently zoned Al, R1A, and I2. An amendment to the land use
map will not be necessary.
The "Mineral Excavation Overlay District" will put future purchasers of
property in this area and surrounding areas on notice of the intent of these
property owners to mine gravel deposits. It does not give anyone the right to
mine, however. Along with the zone change, each parcel will be looked at on
a case by case basis through the Conditional Use process. A license for
• mineral excavation must also be obtained. There are many factors that must

• be considered prior to approving mineral excavation. Further, any and all
mining must be consistent with the long range planning and findings of the
Environmental Impact Statement prepared by the City.
This rezoning of the mining district is the logical next step in the City's
attempt to better regulate mining activities. The first step in this process
was the Environmental Impact Statement. The next step, after the zone
change, will be updating any antiquated existing mining permits. An
ongoing step is to better administer the yearly licenses.
Staff is recommending approval of this zone change request with the
exception of the northeast quarter of the southwest quarter of Section 20,
Township 33, Range 26 (Shown on Map B with an X through it). This parcel
is currently not owned or leased by gravel companies and makes a logical
separation from mining activities to adjacent neighborhoods.
Staff also considered not rezoning areas where setbacks from mining
activities would be required. However, it was too difficult to predetermine
these buffers at this time. This task would be easier to accomplish on a case
by case basis through the Conditional Use Permit process.
• Staff offers the following findings for recommending approval of this
rezoning:
1. The rezoning is consistent with the long range planning put
forth in the Environmental Impact Statement on mineral
excavation. It is also consistent, Section 910 (18) "Mineral
Excavation Overlay Zoning District", and Section 900.44
"Amendment Procedures" of the City of Elk River Zoning
Ordinance.
2. The rezoning would help conserve property values by putting
surrounding property owners on notice of the intent of the
property owners within the mining district, to extract gravel.
Also, through the Conditional Use Permit process, other
safeguards to protect property values can be instituted.
3. The rezoning is consistent with the use the properties in
question are being devoted to at this time.
Further, any and all mining must be consistent with the long range planning
and findings of the Environmental Impact Statement prepared by the City.
