Northern Access onto Highway 169 for the Deerfield 3rd Addition

Mayor Dick Hinkle opened discussion on this issue and reviewed a meeting that
took place between Elk River Staff members, himself, and MN DOT representatives
on July 7th in Elk River. During this discussion with MN DOT, it was determined
that in order to obtain a new access onto Highway 169 to facilitate the Deer-
field 3rd Addition, three issues had to be addressed. These three issues were
(1) the servicing of MN DOT through a frontage road which would allow the MN
DOT access onto Highway 169 to be closed in the future; (2) the obtaining of
the access rights on Highway 169 which currently serve the Specht property; and
(3) the realignment of 201 on the west side of 169 to match up with the proposed
access for the Deerfield Addition on the east side of 169.
The Mayor continued to discuss the meeting that took place between MN DOT
representatives, himself, and developers of the Deerfield 3rd Addition in the
MN DOT Brainerd office on Thursday morning July 17, 1986. This Brainerd
meeting followed a staff and developer meeting on July 16, 1986. At this July
17th Brainerd meeting it was indicated to MN DOT that (1) the MN DOT property
would be serviced by a frontage road coming from the south off of Elk Hills
Drive that would be provided as part of the Deerfield 3rd Addition which would
allow the access currently used by MN DOT onto Highway 169 to be closed; (2)
written statements signed by Mr. Dale Specht and his parents were presented to
MN DOT which release their access rights onto Highway 169; and (3) that the
City was willing to work with MN DOT in the realigning of State Highway 201
on the west side of Highway 169 so that it will match up to the new proposed
access which will service Deerfield 3rd Addition. This third point will allow
for future signalization, if required.
The Mayor then presented a letter dated July 17, 1986 from MN DOT District
Engineer W. N. York which indicated that the Brainerd MN DOT office will
recommend approval of the proposed access onto Highway 169 provided that the
City fDllow through on the three issues presented to them and that no expenses
be accured by MN DOT in relationship to this new access being constructed.

It was indicated by the Mayor that the first item desired by MN DOT was an
abstract of the Specht property. It was further indicated by the Mayor that
MN DOT and the City will have to work together on the location of the proposed
new access and alignment of 201 on the east side to match into this new
proposed access.

Discussion by the Council followed on the realignment of 201 to match into the
Deerfield access and the requirements indicated by MN DOT in their July 17, 1986
meeting.
COUNCILMEMBER ENGSTROM MOVED TO (1) INCLUDE DEERFIELD 3RD ADDITION INTO THE BOND
ISSUE THAT WILL BE PRESENTED FOR APPROVAL TO THE CITY COUNCIL ON JULY 21, 1986;
(2) TO RESEND THE MOTION MADE AT THE JULY 14, 1986 MEETING WHICH DIRECTED THE
STAFF TO DELETE THE DEERFIELD 3RD ADDITION FROM THE BOND ISSUE; (3) THAT THE
JULY 17, 1986 LETTER RECEIVED FROM MN DOT BE PART OF THE MINUTES WHICH INDICATES
THEIR WILLINGNESS TO RECOMMEND APPROVAL OF THE NEW ACCESS ONTO HIGHWAY 169 TO
SERVE THE NORTHERN PORTION OF DEERFIELD 3RD ADDITION CONTINGENT UPON THE CITY
MEETING REQUIREMENTS RELATING TO CLOSING THE SPECHT ACCESS, SERVICING MN DOT
AND CLOSING THAT ACCESS, AND REALINING HIGHWAY 201 TO MATCH INTO THE NEW
PROPOSED ACCESS; AND (4) THAT THE RELEASE OF HIGHWAY ACCESS STATEMENTS SIGNED
BY MR. DALE SPECHT AND SIGNED BY EVERETT AND VERNA SPECHT BE PART OF THE MINUTES.
COUNCILMEMBER GUNKEL SECONDED THE MOTION. THE MOTION PASSED 4-0.

Discussion followed on concerns of the Council on when the access will be built,
when the MN DOT access will be closed, and when construction will be needed on
Jackson Road to align into the new access. It was the consensus of the Council
that the City will work very closely with MN DOT and follow there direction in
precise location of the Deerfield 3rd northernly access and that the City will
also work very closely with MN DOT in realining the State Highway 201 on the
west side of 169. The Council understood that MN DOT will be serviced and the
City lot north of MN DOT will be serviced by a frontage road provided by the
Deerfield 3rd Addition plat coming from the south off of Elk Hills Drive.
2. Request from George Deschenes to have the City pay $300.00 for the Easement of
the existing Cul-de~Sac that is on his Property and to have the City pay $935.00
for repair work done by George Deschenes in 1984 for Drainage work done in
relationship to the Barrington Place Development
It was the consensus of the Council to offer Mr. Deschenes $300.00 for easement
to allow the existing Cul-de-Sac to remain in place. It was also the consensus
of the Council that further negotiations need to be done between Mr. Deschenes
and the City before any payment of repair work could be paid to Mr. Deschenes
for work that he did in 1984.
3. Adjournment
COUNCILMEMBER GUNKEL MOVED TO ADJOURN THE MEETING. COUNCILMEMBER SCHULDT
SECONDED THE MOTION. THE MOTION PASSED 4-0.
There being no further business, the meeting adjourned at 7:17 p.m.
