Untitled . MEETING OF THE ELK RIVER PLANNING COMMISSION HELD AT THE SALK JR. HIGH SCHOOL, ELK RIVER, MN THURSDAY, JUNE 10, 1993 Members Present: Chairman Minton, Commissioners Eberley, Emerson, Kuester, Spotts and Tveite. Members Absent: Commissioner Kreger Staff Present: Stephen Rohlf, Building and Zoning Administrator; Terry Maurer, City Engineer; Peter Beck, City Attorney; Bill Weber, Planning Consultant; and Catherine Schmidt, Recording Secretary 1. Call Meeting to Order Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission was called to order at 7:05 pm by Chairman Minton. 2. Consider Planning Commission Agenda COMMISSIONER EBERLEY MOVED TO APPROVE THE 6/10/93 PLANNING COMMISSION AGENDA. COMMISSIONER TVEITE SECONDED THE MOTION. THE MOTION CARRIED 6-0. • 3. Planning Commission Meeting Process Chairman Minton briefly explained the process of a public hearing. Peter Beck, City Attorney, explained the proposed zone change request, the conditional use permit request, and the preliminary plat request. Mr. Beck stated the requests are appropriate. 4. Proposed Elk Park Center Project Developers: Scott Erickson and John Weicht Architect: Mike Shields Traffic Engineer: Jim Benshoof Architect: Ron Anveny Civil Engineer: John Bogart The aforementioned addressed the Planning Commission and staff regarding the original site plan and statcd that after several meetings with various groups, they are presenting a revised site plan. From this point, the group addressed the revised site plan, which included a WalMart and a Cub Foods, however it did not contain the Menards originally proposed. Chairman Minton addressed the public regarding procedures during a public hearing and reviewed the types of comments appropriate to the • proposed request. Chairman Minton stated with the revised site plan, this meeting would have to be continued to allow staff time to review the revised site plan and make the appropriate recommendations, Elk River Planning Commission Minutes Page 2 June 10, 1993 however, public comments would be heard at this meeting and the public • hearing would be continued to a later date. Chairman Minton entered into public record; 1) Minutes from the Park and Recreation Board dated February 3, 1993; 2) Letter from the Architect, Mike Shields; 3) Letter from the Elk River Chamber of Commerce dated November 12, 1992; 4) Letter from David Shay, Attorney for the Elk River Mall dated June 1, 1993; 5) Several responses regarding the EAW (included in the packet) ; 6) Letter from Citizens Who Care dated June 15, 1993. Chairman Minton opened the public hearing. Phil Johnson, 19440 Oak Street NW, Elk River stated his concern and the concern of the Citizens Who Care group; the location of this proposed project. Mr. Johnson quoted from page 68 of the Focus Area Study, Subarea B-3, and stated that this proposed project is not consistent with the Area Focus Study or the Comprehensive Plan, note Condition #2 of the Seven Standards for granting a Conditional Use Permit. Mr. Johnson quoted Condition #4 of the Seven Standards for granting a Conditional Use Permit and stated that this proposed project requires widening area streets, relocating utilities, the installation of sidewalks, it affects school crosswalks, increases police and fire needs and, in particular, will create traffic congestion and interfere with neighboring public thoroughfares. Mr. Johnson continued with Condition #5 of the Seven Standards for granting a Conditional Use • Permit and addressed the Environmental Assessment Worksheet, page 5, #23, which states that an Indirect Source Permit is required to access the effect of the increased levels of carbon monoxide caused by high levels of exhaust in the immediate vicinity. Mr. Johnson stressed that this particular project does not meet the Seven Standards for granting a Conditional Use Permit and requested the Planning Commission to require the developer to re-scale the proposed project to fit within the guidelines of the Comprehensive Plan and the Focus Area Study. David Shay, Elk River Shopping Mall, stated this proposed use was not consistent with the covenants of the Elk River Shopping Mall which states Jerry Hagen can not start a new grocery store near that mall. Dennis Gorman, 12905 Highland Road, Elk River, expressed concern regarding the Area Focus Study and addressed several concerns regarding the Riverdale Crossing shopping mall and its insufficient roadway. Mr. Gorman is concerned with the increased traffic so near to the schools and asked that the Planning Commission take testimony from the school bus drivers regarding the current traffic problems and related safety issues. Tom Dillon, 824 Jackson, Elk River, expressed concern regarding traffic issues, particularly the corner of Jackson and School Street. Diane Schmacher, 11063-208th Avenue, Elk River, indicated she was in • favor of the Elk Park Center project and was confident City staff would make the appropriate recommendations. Elk River Planning Commission Minutes Page 3 June 10, 1993 .' Ken Williams, 19762 Brentwood Lane, Elk River, stated he is opposed to this proposal in the school area. Mr. Williams requested a poll of citizens present at this meeting to show how the majority of the citizens feel. Further, he commented on the environmental impact this project would have in this particular location. Ed Stoutenberg, 19032 Yale Circle, Elk River, voiced concerns regarding traffic around Jackson and School Street. The Elk River Police Department currently directs traffic in this area daily. Would this proposed project increase traffic problems in the area and how would this increase of traffic affect the safety of the children. Carla Fourniar, 716 Washington Court, Elk River, explained her concerns for the safety of children so close to the proposed mall and crime and gang activity increasing due to the close proximity of the schools to the proposed mall. There is no youth facility in the area, therefore, our youth will gravitate toward this location possibly increasing gang activity. Ms. Fourniar questioned the developer and/or City staff regarding additional security in the proposed mall and who is liable for the safety of children in and around the mall. Fred Short, 16651 Kangaroo Circle, Ramsey, commented on crime and the affects on our youth. By choice, Mr. Short sends his child to school in Elk River and is very concerned about the close proximity of the proposed mall to the schools. He is opposed to the proposed mall in • this location. Ed Renkin, 816 Jackson, Elk River, stated he recently moved to Elk River from Egan to avoid the gang activity in Egan. Mr. Renkin is concerned about the safety of children around the proposed mall area, especially at night. Nancy Schumacker, 1127-5 Street, Elk River, iterated concerns for child safety, however, she did like the idea of the proposed mall but on a smaller scale than what is being proposed. Jack Sheedy, 4940 Viking Drive, Minneapolis, representing the managing firm for the Elk River Shopping Mall, questioned if this development would be paying its share of taxes. Rolf Anderson, 19411 Irving Circle, Elk River, reiterated concerns for child safety, an increase in traffic, and the overall scope of this project. Mr. Anderson introduced Ken Anderson, Anderson Engineering, an independent engineer hired by the Citizens Who Care group to review and identify potential traffic concerns regarding the proposed mall. Ken Anderson, Anderson Engineering, submitted copies of his memo to the Planning Commission and staff. Mr. Anderson reviewed his memo and felt this site would be overdeveloped, even if the proposed mall would be reduced in size. Also, a traffic study was done in this area however, it was done by Maier Stewart in July. Mr. Anderson would like to • suggest a new study be done during peak traffic hours and also with consideration to seasonal traffic. He would like to meet with Terry Elk River Planning Commission Minutes Page 4 June 10, 1993 Maurer, City Engineer, to discuss the necessary details this proposal • would involve. Sharon Bromen, 20969-152 Street NW, Elk River, stated she is in favor of the project. She is a retail business owner and welcomes the proposed project. Cathy Wise, 19424 Irving Circle, Elk River, explained that she is a school bus driver and commented on the pedestrian traffic around the Jackson and School Street area. Reiterated concerns regarding pedestrian safety and increased gang activity. Jeff Polger, 13131 Mississippi Road, Elk River, is in favor of the proposed project and stated he would like to see the additional retail business in the City. Fred Short, 16651 Kangaroo Circle, Ramsey, presented the Planning Commission and staff with signatures in favor of this type of development but not in the proposed location. Darlene Jacobson, 10730-198 Avenue NW, Elk River, stated she is opposed to the proposed mall due to the close proximity to the schools. Steve Patterson, Chamber of Commerce, 372 Jackson Avenue, Elk River, informed the public attending the meeting that growth is essential to • the City of Elk River and that this project would be a benefit to the q: community. Mr. Patterson reviewed his memo included in the packet. Charlie Blesner, 19360 Norfolk, Elk River, stated he is concerned about the size of the development. Further concerns included signage on Jackson, storm water and drainage, and trees and landscaping. Karri Ryans, 19128 Carson, Elk River, informed the Planning Commission that she is a teacher and reiterated concerns regarding the safety of children and environmental issues. There being no comments at this time, Chairman Minton asked City staff and the developer's staff to respond to the aforementioned concerns. Stephen Rohlf addressed the signage issues and indicated further review was necessary due to the revised site plan. Terry Maurer commented on the storm drainage plan and discussed the City's current storm water plan that is being reviewed. John Bogart, John Oliver & Associates, stated that after reviewing the 100 year storm plan, this request can meet the necessary requirements. Jim Benshoof, Traffic Engineer retained by the developer, requested a meeting with the City Engineer to discuss all areas of concern. Testimony from the public continued. . . . Elk River Planning Commission Minutes Page 5 June 10, 1993 •) Duane Kropuenske, 20760 York Street, Elk River, addressed concerns relating to crime and gang activity. Mr. Kropuenske pointed out that this proposed project will not bring crime or gang activity to Elk River because it is already here. Further, the Focus Area Study is intended to be a guideline to work with the community yet allowing for growth and change within the community. Mr. Kropuenske reminded the citizens to look at the merits of this project not at their emotions. Phil Johnson, 19440 Holt Street, Elk River, addressed the Focus Area Study. Fred Short, 16651 Kangaroo Circle, Ramsey, asked if this type of project (a mall so near to area schools) has been done anywhere else in Minnesota. Greg Johnson, 11880 Highland Road, Elk River, commented that his wife is the head of the school patrol and school patrol participants have received letters warning them not to patrol should this project be approved (due to the increased traffic) . Mr. Johnson questioned if tax increases would cover the cost of additional people to patrol? Further, if the residents of Elk River paid for the Growth Management Plan to be done, why isn't the City using it? Tom Dillan, 824 Jackson, Elk River, reiterated traffic concerns. • Ken Williams, 19762 Brentwood Lane, Elk River, stated he is not opposed to the growth of Elk River, however, he is opposed to the location of this proposed project. Lloyd Johnson, representing Cub Foods, stated they are excited about working with the City. Mr. Johnson is aware of the traffic concerns, however, he feels they may be somewhat exaggerated. Further, this is an excellent location for this type of project due to the proximity of adjacent retail businesses. Mr. Johnson stressed the advantages of increased tax dollars and employment for the City. For the record, Mr. Johnson did request to further review the revised site plan with regard to pedestrian traffic areas. Dan McCullen, 810 Jackson, Elk River, reiterated traffic concerns. Ed Renkin, 816 Jackson, Elk River, reiterated concerns regarding the location of the proposed project. John Fantasia, 11955 Highland Road, Elk River, responded to a letter from MnDot regarding Freeport Avenue and 169 (traffic issues) . The letter was entered into public record. Alma Olson, 11964-194 Circle, Elk River, reiterated concerns regarding the location of the proposed project. Dennis Gorman, 12095 Highland Avenue, Elk River, requested • clarification regarding funds for the proposed project with regard to signalization. Mr. Gorman reiterated concerns regarding the location of the proposed project. Elk River Planning Commission Minutes Page 6 June 10, 1993 John Cannon, 11794-190 Avenue, Elk River, stated he felt the mall • project does not meet the seven standards for a conditional use permit. There being no comments at this time, Chairman Minton requested City staff and the developer's staff respond to the questions asked. Mike Shields, Architect for the proposed mall, responded to the question of liability/safety of children in and around the proposed mall. Mr. Shields informed the residents that it is not the developer's or the school's responsibility to try to reduce gang activity or crime and therefore, this project should not be judged by possible increases in crime/gang activity. Scott Erickson, developer for the proposed project, suggested the Planning Commission look at the Minneapolis based Calhoun Square project. It is in an area that had a high crime rate, however, the mall project helped to reduce crime in the area because individual business owners took an active part in security, etc. Testimony from the public continued . . . Sue Deliden, 19243 Lowell Street, Elk River, requested the developers consider the Area Focus Study. Shelia Hileman, 11774 Highland Road, Elk River, reiterated concerns relating to safety issues and increased crime. • Carla Fourniar, 716 Washington, Elk River, reviewed a newspaper article regarding crime and juveniles and reiterated her concern regarding crime. Rosalie Ezati, 19498 Lowell Street, Elk River, works in a retail store in Elk River and knows many of the area youths. Ms. Ezati is concerned with the affect this proposed project would have on area youths. Ken Williams, 19762 Brentwood Lane, Elk River, questioned if the Planning Commission was limited to making a decision using only the facts, or would they be able to use their own judgements. Planning Commission recessed at 9:30 p.m. and reconvened at 9:35 p.m. Stephen Rohlf discussed the Focus Area Study and explained the memo included in the packet dated June 4, 1993. Phil Johnson, 19440 Holt Street, Elk River, commented on storm water run-off, the memo in the packet from the DNR, and explained the sedimentation pond and culvert. Terry Maurer, City Engineer, addressed driveway accesses, traffic issues, and costs related to improvements. Mr. Maurer also explained that the pond behind the school currently has no outlet. This project • is proposing an outlet. Elk River Planning Commission Minutes Page 7 June 10, 1993 Chairman Minton addressed City staff: what would be required to review this proposal further. Commissioner Eberley requested more details regarding the traffic issues, Commissioner Tveite stated more information is required as per the memos from the BRW and Maier Stewart. Commissioner Tveite commented that many details must be supplied to properly review this plan. Michael Shields, Architect, requested a general approval of the concept of this proposal. Commissioner Tveite stated that too many details are lacking to approve a concept of this plat. Chairman Minton questioned staff if another meeting day could be set to continue the public hearing and discussion on this proposal. Discussion ensued. A meeting date of July 15, 1993, was set. COMMISSIONER SPOTTS MOVED TO CONTINUE THE SPECIAL PLANNING COMMISSION MEETING AND PUBLIC HEARING REGARDING THE PROPOSED ELK PARK CENTER PROJECT ON JULY 15, 1993, AT THE ELK RIVER CITY HALL AT 7 P.M. Benshoof)4 D RE: Updated Traffic Analysis for Elk Park Center PURPOSE AND BACKGROUND A revised development plan for Elk Park Center has been presented to the City of Elk River. In that context, the purpose of this memorandum is twofold: • To indicate the extent to which the revised development plan alters the results of • traffic analyses for the former development plan . To respond to traffic issues raised by project participants regarding the earlier plan. Regarding the second above point, the following documents, which present traffic comments on the former plan, have been reviewed and are addressed in this memorandum. . Letter to Steve Rohlf, City of Elk River from Terry Maurer, Maier Stewart & Associates, June 21, 1993 • TRAFFIC FORECASTS The current development plan is practically the same as the prior plan in terms of basic traffic access and circulation. In both instances principal access is provided by an • Mr. Steve Ach -2- September 17, 1993 • extension of Freeport Avenue north from School Street to Jackson Avenue. Secondary access is provided along Jackson Avenue and via one right turn in and out only access point on T.H. 169. Though the basic traffic layout is much the same, the current development plan is distinctly smaller than the former plan in terms of size and trip generation. Under the current plan, the complete development, including anticipated expansion of the Cub and Wal-Mart uses, will consist of 376,000 sq. ft. of building area, which is about 25 percent less than the approximate 500,000 sq. ft. size of the former plan. A major reason for the reduced size is that a Menards Store no longer is included in the development. The projected p.m. peak hour trip generation for the current development is shown in Table 1. This table indicates that the current trip generation projections are 12 percent less than under the former plan. The trip generation projections have not been reduced as much as the square footage because the current plan includes larger Cub and Wal- Mart stores. The net effect of this reduced trip generation is that the volume of development trips at every effected location will be reduced by 12 percent from the former projections. Traffic Operations on School Street Between Freeport Avenue and T.H. 169 Indepth analyses regarding level of service, queuing and signal coordination have been performed to address the important aspects involving this segment of School Street. The capacity analyses have indicated that the intersections of School Street and Freeport Avenue will accommodate the projected 1997 post-development volumes at level of service C and that the intersection of School Street and T.H. 169 will operate at level of service D. Queuing analyses have indicated that, under 1997 p.m. peak hour post-development conditions, the 90th percentile queuing for left turns from the gazt on School Street Freeport to the south.op Avenue , ill be nine ve_�hides_and the 90th percentile queuing for left turns from the west on School Street to the north on T.H. 169 will be 11 vehicles. Work sheets documenting the capacity and queuing analyses have been provided under separate cover to staff of Maier Stewart and Mn/DOT. Another important element to ensure effective traffic operations on the subject portion of School Street is that efficient coordination is provided between the existing traffic signal at T.H. 169 and the future signal at Freeport Avenue. A concept plan for the integrated timing of these two signals has been developed and is shown in Figure 1. With this type of timing plan, we are confident that traffic will flow efficiently through • the two signalized intersections, without undue delays, queuing, or interference being caused. Based on the preceding analysis results, an updated concept plan has been developed for the segment of School Street between Freeport Avenue and T.H. 169. As shown in Figure 2, this plan will involve widening of School Street to achieve the necessary through lanes and turn lanes. The two westbound through lanes that are shown east of Freeport Avenue would merge together west of Freeport Avenue to the existing single westbound through lane. Access on Jackson Avenue for Taco Bell Use In the context of the former development plan, we conducted extensive analyses regarding the feasibility of access on this portion of Jackson Avenue for the northernmost development components. As presented in a memorandum we prepared dates October 20, 1992, we determined that such access meets necessary sight distance requirements and thus is fully feasible. Thus, it is our conclusion that the proposed access for Taco Bell is satisfactory and will not cause adverse effects. Right Turn In and Out Only Access on T.H. 169 ,`4 Mn/DOT staff have confirmed that one right turn in and out only access point on T.H. • 169 is acceptable. ELK PARK CENTER FREEPORT AVENUE AND TRANSPORTATIONENGINEERSANDPLANNERS T.H. 169 Mr. Steve Ach -6- September 17, 1993 • Validity of Traffic Counts Used as a Basis for 1997 Post-Development Traffic Forecasts As presented in Maier & Stewarts' traffic report dated January 1993, the existing p.m. peak hour traffic volumes were established using counts conducted on Tuesday and Thursday, July 21 and 23, 1992. These counts include the summer peaking characteristics and thus constitute a sound basis for the traffic forecasts and analyses. CONCLUSIONS Major conclusions that we have established from this updated traffic analysis are: . The proposed development plan will generate 12 percent fewer p.m. peak hour trips than the former plan. . With this reduced trip generation, the public roadway system will provide better operations than previously projected . A signal timing plan and geometric layout plan have been developed for the segment of School Street between Freeport Avenue and T.H. 169, which will enable that segment of School Street to provide safe, effective traffic operations. • • q -U N \sif ? ?fiver TO: MAYOR AND CITY COUNCIL FROM: GENE SCHULDT, COUNCILMEMBER DATE : NOVEMBER 19 , 1992 SUBJECT: CITIZENS ' CONCERNS REGARDING ELK PARK WEST DEVELOPMENT I apologize for the delay in producing this memo, but the recent elections set back my timetable . Also, the result of the election gave me pause as to whether or not it would be of much use in set- ting these comments down, but I have concluded that it is in the best interests of all concerned to do so. On Tuesday, October 27, 1992 I had a dinner meeting with Phil JOhnson and Rolfe Anderson of the Citizens Who Care neighborhood group to , discuss concerns about the north Jackson Avenue commercial develop- ment known as Elk Park West . It was I who called the meeting, and I did so after Terry Maurer ' s presentation at the Planning Commission workshop on October 20, 1992 on his Traffic Impact Study. I have • felt for several months that concerns related to the development were not being addressed . It was comments made at the Planning Commission meeting that convinced me to meet with the leaders of the neighbor- hood group. I understand that plans for the development are being withheld from the City Council until they are finalized and ready for council scru- tiny . That makes sense, but my present concern is not what will take place within the development , but rather outside the development - the impact on the surrounding neighborhood and the city in general . Some months ago I tried to initiate a discussion at a council meet- ing regarding these concerns , but was unsuccessful . What follows are the concerns discussed at the supper meeting . Terry Maurer ' s Traffic Impact Study, dated August 1992 , was a main topic of conversation. What stood out most was the calculated sum of 32 , 044 daily trips being initiated by this development . The question arose as to how all that traffic would be handled . For instance , School Street would have to be widened to four lanes . According to Terry Mauer , it now has the equivalent of three lanes . The fourth lane would have to be added in what is now the boulevard on the north side of the street , because there is not any room on the south side , from Proctor Avenue to Freeport Avenue . There would have to be a sidewalk installed along the south side of • School Street . A couple of years ago I inquired of the City Council as to the feasibility of installing the sidewalk/ using MSA funds , due to the nine apartment buildings in the area and two churches , one 720 Dodge Avenue N.W., Elk River, Minnesota 55330 (612) 441-7420 2 • with a school and the other with a daycare center . The topic was not of great interest to the councilmembers . In fact , one councilmember made the comment that southside pedestrians could cross the street and use the sidewalk on the northside . The increased traffic gener- ated by the proposed development would render crossing a four-lane street to be extremely hazardous . Pedestrians would have to walk in the traffic lane to reach a corner crosswalk. In all likelihood Jackson Avenue, south of School Street , would have to be a four-lane street . The street is currently four lanes wide , however, two are traffic lanes and two are curbside parking lanes . Thus , the curbside parking would have to be eliminated . This would cause a great deal of inconvenience for some of the residents . Since most of the residences are older homes , they do not have driveways or the ability for off-street parking. Although there is an alley be- hind the homes , with garages , to provide for residence vehicles , there would not be any provisions for needed parking for visitors , home deliveries, service calls , and the like . Of course, Jackson Avenue north of School Street would also need widen- ing to four lanes . A B&Z representative at a council meeting suggested that a sidewalk (pathway) would only be needed on one side of the street . That is not necessarily so. With schools located both east and west of Jackson Avenue , it could very well require sidewalks on both sides for pedestrian safety, mostly students and children. I can- • not imagine that north Jackson Avenue would not require four lanes . At the present time, the City of Eden Prairie is proposing to widen a two- lane street into four lanes , and it only has a 12 , 000 vehicle traffic count . With the continuous increase of traffic on the surrounding streets , the need for signalized intersections was discussed. If this development were to become a reality, it is assumed School Street and Freeport Ave- nue would be a cross intersection and signals would be installed . School Street and Jackson Avenue would become a equally critical inter- section and would require signalization, if not at present, then soon. Even now, the combination of passenger vehicles and school buses makes it necessary for a police officer to direct traffic at that intersec- tion . Freeport Avenue, extending north of School Street through the proposed development , should exit opposite from Highland Avenue at Jackson Street and no where else , and that intersection will probably require signals . Terry Mauer is on record as stating that is where Freeport Avenue should exit . The latest proposal submitted shows Freeport Avenue exiting across from 193rd Avenue . The future of Highland Avenue was also of great concern. Under normal circumstances that street would have to be upgraded in due time . If the development occurs , this street would absorb a greatly increased amount of traffic in a much sooner time span, thereby requiring the upgrading to be accomplished sooner . Highland Avenue is the east/west • traffic corridor north of School Street that runs directly to the site . At the present time there is not a sidewalk on either side of Highland 3 • Avenue . If the development occurs , sidewalks on both sides of the street would be a necessity. When Highland Avenue is rebuilt , would city policy prevail and new underground utilities (sewer, water, and storm sewer) be installed at the same time . If so , what would be the policy for assessment? The bottom line to all these concerns is not only what improvements would have to be made outside such a development , but who would pay for those improvements . The cost would be astronomical . Since the need would be created by the development , does the developer pay the costs? If not , why not? If not the developer , then who? All of the property owners in the city? Only some of the property owners in the city and, if so, which ones? Please note that I have not mentioned a water tower for the proposed development . It has al- ready been stated by staff that such a development could not exist without a water tower, and that would be the developer ' s responsi- bility. There are concerns that the developer is showing a proposed layout for this development that includes well-known names on some of the buildings , such as Cub, Wal-Mart , Menards , Tires Plus , Payless Shoes , Wendy ' s , Taco Bell , Perkins and others . It is generally known that none of the above businesses have committed to being located in the proposed development , and to label the schematic in such a way is misleading . • Lastly, most residents would probably welcome the businesses that are being labeled on the project layout for the convenience of shopping. However, that welcome is tempered against the location adjacent to the neighborhood and the schools and the negative impact the devel- opment would create . It is not enough to claim that such a project in that location is worthwhile simply because of the tax revenue it would generate , while ignoring the irrepairable harm it would cause . In short , it is the right development in the wrong location. A personal note, if I may . In talking with the representatives from the neighborhood group, I found myself agreeing with their concerns . If it should be that their concerns are unfounded , then a great deal of community anxiety could have been avoided if the city had held a public information meeting at the very outset . It would have bene- fitted the developer as well to be aware of public sentiment . When the city campus project was initiated last year , we promised that public information meetings would be announced and held whenever a large project was to be considered in the future . That was not done with this proposed project . Lastly, on Wednesday, November 18 , 1992 the B&Z Administrator showed me the latest layout of the proposed de- velopment and said he was recommending approval of it . It seems to be premature . Our analysis is primarily focused on Trunk Highway (T.H.) 169 since that is our area of jurisdiction. Since the intersection of School Street affects T.H. 169 operation, we have extended our study to encompass impacts to School Street also. Many of our assumptions are based upon findings by Benshoof and Associates. Utilizing his report submitted earlier to the City greatly assisted our efforts and allowed us to be responsive to the City in a timely manner. We are greatly appreciative of Mr. Benshoof's assistance in this matter. Traffic Forecasts & Volumes Traffic volumes are critical in the overall findings of impacts to the roadways. We are fortunate to have the availability of a very recent forecast undertaken by Mn/DOT, Metro Division, for T.H. 101. The T.H. 101 corridor from Rogers to Elk River will be expanded to a four-lane facility in the near future. This will probably increase the use of T.H. 101 and T.H. 169 in the Elk River area. This assumption Wae taken from au earlier report by Maid Stewart & Associates. A comparison of traffic volumes from the assumed. five percent growth was made against the forecast from the T.H. 101 report. The results were amazingly close. Having made this comparison on traffic volumes, the forecasted traffic volumes can he assumed to he credible. The 1997 traffic volumes used were 31 ,378 vehir.leA per day. Design Hour Selection The Department of Transportation designs highways for 20 years future. This is a reasonable compromise between a facilities useful life, the uncertainties of long range projections, and consequences of inaccurate projections. In conjunction with the 20-year loug Lauge forecast, the Dc aic,ieut builds a highway capable of handling traffic for a Design Hour Volume (DHV). This is typically the 30th highest hourly volume expected for the year. Thirtieth highest hours vary from roadway to roadway dependent upon function and location. Trunk Highway 169 is a very seasonal route since it serves the vacationland of much of northern Minnesota. Design Hour Volumes for seasonal routeA often Ayneed 20 percent of the average daily traffic (AT)T) and can even • approach 30 percent of the ADT. Without conducting an indepth analysis of what would be an aceturate DHV for T.H. 169 and School Street intersection, we evaluated a peak Friday afternoon peak hour. This selection was for the purpose of studying operations during the busiest time of the day. Utilizing information from a Automatic Traffic Recorder (ATR) located east of Elk River on T.H. 10, we found a peak afternoon hour on Friday in July Co • be slightly greater than 9 percent of the total traffic on that Friday. Overall, a July Friday afternoon peak hour slightly exceeds IL percent of the ADI. Since the volumes on a summer Friday afceruuou peak hour: are less than an expected 30th highest hour volume, we feel our evaluation of a summer afternoon peak hour is representative of a significant number of hours throughout the year. Findings & Conclusions, A summary of the results of our analysis is as follows. ii The Department of Transportation utilizes the 30th highest traffic volume of the year in its design otudico. For this rcaaon, we utilized a time of day and day of week nearing, or less than, the 30th highest traffic volume for studying impacts to T.H. 169. >> A summer Friday afternoon peak hour was selected for our analysis. The design hour traffic used was approximately 11 percent of the ADT and is actually less than an expected 30th hour DHV on this type of facility. >> We derived design hour characteristics from en ATR in close proximity to this intersection. This yielded a 150-second cycle length at T.H. 169 and School Street. >> An overall intersection level of service (LOS) was calculated to be "E" at T.H. 169 and School Street in 1997. (This calculation took into account a widened School Street as proposed by Benshoof, and a dual left turn lane for NB T.H. 169.) "E" is an acceptable LOS for short periods of time. >> There are improvements that can be made to the highway and the intersecting street to minimize the impacts due to increased traffic. -- Dual left turn lanes for northbound T.H. 169. -- Dual left turn lanes for eastbound School Street. -- Additional lanes for through movements on T.H. 169 and/or School Street. >> Should the development and expected traffic increases occur, dialogue will need to be conducted between the City and the Department of Transportation co identify short term and long term roadway improvements. Zerwas, Chief of Police Elkr River Dace: July 14 , 1993 Police Department Subject: PROPOSED ELK PARK CENTER PROJECT In response to your request for projections on the increase in crime and traffic accidents, I must tell you this is a very difficult task. As you are aware with the present Elk River Mall, we have realized a significant increase in calls for service. This is directly attributed to additional vehicles and people coming to that area. We anticipate the same to be true with Elk Park Center whether it is built where it is being proposed at this time or any other Elk River location. Shopping centers, by design, are there to draw people to shop and I am sure this is true for Elk Park Center. We, again, should expect a significant increase in calls for service such as motorist assists, car accidents, shoplifters, thefts from autos, vandalism, check forgeries and burglaries, just to name a few. This same situation occurred in Coon Rapids with the addition of their shopping center that opened a couple years ago at Hwy 10 • and Bunker Lake Road. The question has been asked whether private security should be required to deal with crime problems; however, based on our experience with the Elk River Mall, I would not recommend private security. The reason being that the Elk River Mall, at one time, had a private security company providing protective services. It was found that the service was unreliable and also ineffective. Every time they had a problem, it seems the police were called anyway; therefore, it was decided that the police department would contract with the mall to provide some type of on site police security service to reduce the need for patrol officers to respond to that area. With the use of our community service officer and a couple police reserve officers, it seems to have improved. As far as the issue of traffic accidents is concerned, we anticipate a noticeable increase in traffic accidents. Again, this is inevitable whether the shopping center is built as proposed at the current site or any other future site. Currently, at the intersection of Jackson Avenue and School Street, we average approximately four (4) reported accidents per year. This would definitely increase as a result of more traffic; however, we are not able to project what that number will be. Lastly, you asked about juvenile/gang activity at the proposed shopping center. I do not think this will be as much of a problem • as some people think. Again, as I indicated at the beginning of this memo, this is a difficult task with considerable speculation on my part. Our main concern, wherever the shopping center might be built, is for sufficient additional personnel to deal with the increase in calls for service. I have studied the packet materials and would like to offer my observations for your consideration. 1 ) The landscape theme identified by the developer and City Planner is difficult for me to visualize. This concept has been repeatedly identified as critical in high quality developments. With 13 separate site , plans to review, it is my concern that consistency would be difficult to maintain. I would like to see the plan include landscape "islands" in several spots in the large parking expanses, to offer aestheti c relief from the great asphalt areas. I believe a pleasant environment ' with safe lighting will encourage a greater sense of pride for those who use the facility as well as those who see it from the highway. 2) Some drawings showed 3 lanes of traffic on Jackson , others showed 4. Perhaps one is the bike path and • sidewalk as recommended by Park & Recreation Commission, Clarification may be necessary. These alternative methods of reaching the site would help to alleviate traffic concerns. 3) As Mr. Mauer stressed , the City must be well prepared for , and plan ahead for , traffic impacts. 4) All subsequent plans and drawings for the development should be dated to eliminate confusion over what is current. This became important to the Commission in reviewing plans, changes, etc. in other developments' 5) The right-in , right-out access from TH 169 may interfere with traffic flow on Freeport. Will therm be a 4-way stop , yield signs, speed bumps? Stop signs may cause excessive "stacking" , but Freeport traffic must not be allowed to move too quickly or traffic accidents may occur, Please consider the • • intersection for safety of pedestrians as well . At stake is the present and future economic security of the City of Elk River and it 's citizens. Both sides of this issue must be addressed calmly, intelligently, unselfishly, and most importantly, it must be addressed without delay. A growing economy is vital to the social and educational development of this city. Our children deserve to grow up in an environment which promotes and offers only the best in economic, educational , and social opportunities. A strong economy comes from a strong tax base. Our city, like many other cities our size, has many needs and limited resources. In the recent past we have seen the need to build a new elementary school , a new government center, and a new police station to name a few examples. The money for these and other programs must come from somewhere. Without the help from stores such as Cub Foods, Walmart , and Menards, the money will have to come from increased property taxes. I 'm sure that I am not alone when I say the property taxes in Elk River are already too high. I think the choice is clear. The most effective way to infuse a large amount of money into the tax base is to encourage retail stores to build here and thus pay taxes here. My friends, family, and co-workers who live or work in Elk River and surrounding communities, tell me they do not shop much locally. What an inconvenience to have to drive to Coon Rapids for shopping when that money could easily be spent in Elk River. With the addition of Cub, Walmart, and Menards, Elk River would not only keep its citizens shopping locally, but would also benefit from shoppers from surrounding cities and townships. In the future, Elk River will see much growth as the Twin City area expands north, especially after the Hwy 101 upgrade. It makes good economic sense to • prepare for this growth by providing good shopping opportunities. The monetary gain is only part of the benefit. Each new business provides employment opportunities for both adults and teenagers. In closing, a strong and growing economy in Elk River is essential for everyone. The city council and city planners cannot afford to let this opportunity slip away. The proposed mall project can be a major step toward a brighter future for Elk River. The time to act is now! Let 's all work together for the benefit of the city, reach a consensus, and allow Elk River to grow in a way that benefits everyone.
