Ms. Geissler is requesting a Conditional Use Permit to operate an Upholstery
Business out of her home.

Background
Ms. Geissler is requesting a Conditional Use Permit to operate an upholstery
business from her home located at 58 NW 6 1/2 Street, Elk River, Minnesota.
The applicant currently does upholstery at her home as a hobby and would like
to open a full time business out of her home. The reason this item is required to
go through a Conditional Use Permit is that some of the equipment such as
industrial sewing machines are not normally found in a home.

Ill Business
The business will consist of primarily residential re-upholstery and a small
amount of commercial re-upholstery. The applicant will also do some boat and
RV seats, but the seats will be removed and no boats or RVs will be stored on the
property. The applicant is proposing no outside storage related to the business.
The business is proposed to be operated out of the applicant's 22' x 38' basement.
The business will use a 15' x 16'area in the basement. The applicant will pick
up and deliver all merchandise to the customer's home, therefore, there will be
very little traffic associated with the business. UPS will deliver fabric and
supplies once a week, usually on a Saturday.
Number of Employees/Hours of Operation
The business will consist of the applicant and one part time employee. Hours of
operation would be 8:00 a.m. to 5:00 p.m., Monday through Friday, with
Saturday deliveries. Both of these standards meet the requirements
established in the home occupation ordinance.
Equipment
• The applicant has indicated that the machinery needed to operate an upholstery
business consists of an air compressor, a staple gun, an industrial sewing
machine and a circular saw. The sewing machine and staple gun are the
primary tools used in daily operation, the circular saw is used occasionally to
remove damaged parts, and the air compressor is used as a backup for the staple
gun and if the part time employee is hired. The business will be operated from
the basement of the applicant's home. There will be no outside storage of pieces
or equipment.
Previous Home Occupations
In 1993, the city approved a similar home occupation upholstery business for
Todd Altenweg at 11925 191st Avenue and in June 1995, the city approved a
similar home occupation upholstery business for Jeff Colbath, at 13155 183rd
Avenue NW. The City's Planning and Zoning Departments have not received
any complaints regarding either business.
Recommendation
Staff feels this request meets the seven standards for a conditional use permit as
;outlined in Section 900.20 of the Elk River City Ordinance, as well as the Home
• Occupation Ordinance. Staff is recommending approval of the conditional use

permit request to operate an upholstery business out of the applicant's home,
• with the following conditions:
1. Hours of operation be from 7 a.m. to 10 p.m. as per City Code.
2. No exterior storage related to this business shall be allowed.
3. Signage be limited to two square feet and mounted flat on the wall
of the dwelling.
4. A maximum of one full time employee or equivalent, other than
those persons who customarily reside on the premises, shall be
employed.
5. If valid complaints are received, this item will be brought back
before the Planning Commission and City Council for review.

At the present time , I am doing reupholstery on a limited basis
as a hobby. I intend to , if approved, work at this on a full - time
basis as a job in my home at 58 NW 62 St . in Elk River .
Mainly I will be doing residential reupholstery, some RV cushions ,
some boat seats and occassionally commercial reupholstery . The
business will be run out of my basement . RV ' s and boats will not
be left at my home , since the cushions and/or seats can be
removed .
Machinery which will be used in my business are an industrial sew-
ing machine , an air compressor , a staple gun, and a circular saw.
Most of the time I will be using the sewing machine and the
electric staple gun . The compressor will be used only occas-
sionally if another employee is hired and it will be used as a
back up for the electric staple gun . The saw is used seldom to
help replace weakened parts .
411 My basement is 22 'x38 ' . I will work out of an area in the base-
ment 15 'x16 ' . There will be no storage of pieces , other than
that which I will be working on and possibly one other . So there
will be no need to store furniture outside my home .
There will be little traffic to my home , except an occasional
delivery of furniture which someone may choose to deliver . Gen-
erally, I will pick up and deliver most furniture . UPS will
deliver packages of fabrics and supplies perhaps once a week.
I plan to operate the business by myself and probably one other
part-time employee . Business hours will consist of approximately
8-5pm, Monday through Friday, with delivery days usually on
Saturday.
Presently, I have no plan for a sign . If however , I should decide
to put one up, it would be small , no larger than 2 'xl ' and will
be located on side by the garage .
