Ach, City Planner_ ed- DATE: September 26, 1995 SUBJECT: Conditional Use Permit Request by Novco, Inc., Public Hearing Case No. CU 95-23 Request Novco, Inc. is requesting a conditional use permit to construct a second principal structure and operate a truck terminal on an industrial lot in Rail 10 Industrial Park. • Location Lot 4, Block 1, Rail 10 Subdivision (17230 Ulysses Street). Zoning/Land Use I-1 (Light Industrial) /L-I (Light Industrial) Attachments • Location Map • Zoning Map • Exhibit A (approved site plan) • Exhibit B (proposed site plan) • Excerpt from Performance Standards Background Novco, Inc. originally constructed a 2,560 square foot building in 1993 for the sole purpose of storing a couple of trucks. In order to construct this building, Novco was required to go through a site plan review process prior to receiving a building permit. Attached is Exhibit A illustrating the plan that was • approved on November 10, 1993. Box 490 • Elk River, MN 55330 • (612) 441-7420 • Fax: (612) 441-7425 • Proposed Use When Novotnys originally constructed the building, it was presented as a building that would be used for storage and warehousing which is a permitted use in the I-1 (Light Industrial) zoning district. Under that interpretation, staff proceeded to review their proposed site plan and issue a building permit based on that particular use. However, with the addition of the second principal building which will serve as an office area and the current operation of the facility, staff believes a better interpretation of the use is a truck terminal A truck terminal is a conditional use permit in the light industrial district; therefore, this conditional use permit request has been expanded to include a truck terminal, as well as the second principal use. Proposed Office Building The proposed office building will be 520 square feet in size and will resemble a small residential garage. The structure will have a hip roof with asphalt shingles and pre-finished vinyl siding on all sides. These architectural materials meet the city's architectural requirements listed in the zoning ordinance (see attached excerpt from performance standards). • The proposed second building meets all of the industrial setback requirements; however, staff is concerned with its location if it interferes with the existing septic system. The approved site plan from November of 1993 indicated the septic system on the west side of the property; however, staff believes it was relocated to a location close to the proposed building. Therefore, additional information will need to be provided to make sure the building does not interfere with the existing septic system. Compliance with Approved Site Plan The approved site plan from November 1993, illustrated a bituminous parking surface along with landscaping that was to be installed as part of the improvements. Staff is concerned that these improvements have not been installed in accordance with the approved plan and would recommend that a condition of the conditional use permit state that the improvements be installed prior to June 1st of 1996. Since the original site plan was approved in November of 1993, the Planning Commission and City Council have approved anordinance requiring curb and gutter within front yard areas of industrial development. Furniture and Things located across the street and Custom Cutter and Grinding (under • construction) have both installed curb and gutter in accordance with city s:planning:p c:cu95-23 • ordinance. Therefore, staff recommends Novco, Inc. also install curb and gutter along with the paving of their parking and drive areas. Recommendation Staff recommends approval of the conditional use permit request by Novco, Inc. to operate a truck terminal and construct a second principal building with the following conditions: 1) All site improvements shown on the approved plans dated 11/10/93 be installed and completed by June 1, 1996. 2) The improvements to the parking lot include curb and gutter from the property line to the front building face, as required in the performance standards setforth in the zoning ordinance. 3) Additional information be provided to the building department, verifying the location of the existing septic system, assuring staff that will be no conflicts with the proposed building and existing system. 4) The building official and fire chief perform an inspection of the • existing building to determine if all codes are met relative to the existing use of the building and outdoor storage tanks. • s:planning:p c:cu95-23 • c 7 �! � , / i ! . , • ' , • I 1/1 -t--7-7---F . . : I. r- \. -> '\ . : : . ; . . : ,= •ii %.t.: \ . \-} : : 1 ' \r- 2 1 i ; :. All subsequent additions and exterior alterations constructed after the erection of an original building or buildings (when the original building was constructed in conformance with this section) shall be constructed of materials comparable to those used in the original construction and shall be designed in a manner conforming to the original architectural design and general appearance. E. Accessory Structures. Architectural standards as outlined in this section, shall also apply to accessory buildings. • F. Performance Standards. All portions or sides of buildings which abut a public street or a residential or institutional use or zone or place of assembly such as a public park or recreational facility shall be constructed of materials on the list of exterior building finishes • referenced in this section.
