Ach, City Planner.� « DATE: September 26, 1995 SUBJECT: Land Use Plan Amendment, Zone Change and Preliminary Plat Request by the City of Elk River, Public Hearing Case No.'s LUA 95-6, ZC 95-6 & P 95-4 Request The City of Elk River is requesting the following applications: • a) A comprehensive land use plan amendment changing the land use designation from MR (Medium Density Residential) to HB (Highway Business) b) Rezoning from Rlc (Single Family Residential) to C3 (Highway Commercial) c) Preliminary Plat to plat a 3 acre parcel into one commercial lot and one outlot Attachments • Revised Plat • Planning Commission report dated August 22, 1995 Land Use Amendment and Rezoning The land use and rezoning request is amended in accordance with the revised plat. The developable portion (Lot 1, Block 1) of the three acre parcel is the only area subject to the land use and zone change. Therefore, the outlot will retain its current MR (Medium Density Residential) land use and Rlc (Single Family Residential) zoning designation. III 13065 Orono Parkway • P.O. Attached is a sketch of a revised plat that would create the one developable lot at the south end of the parcel and the balance of the property would be left as an outlot and retained by the city. Attached is a copy of the staff report to the Planning Commission dated August 22, 1995 with some additional information and background regarding these three applications. Recommendation A. Amending the land use plan from MR (Medium Density Residential) to HB (Highway Commercial), and, B. Rezoning that area proposed as Lot 1, Block 1, from Rlc (Single • Family Residential) to C3 (Highway Commercial) based on the following findings: 1. The times and conditions have changed to warrant the new zoning and land use designation to allow for commercial development at the intersection of Highway 169 and 193rd. 2. The rezoning and land use plan amendment will be consistent with the recommendations from the Steering Committee to extend commercial development north along Highway 169 to approximately the 194th alignment. 3. The rezoning and land use plan amendment will be a logical and continuous extension of the existing commercial along Highway 169. 4. The land use amendment and rezoning to commercial can be supported by the availability of water and sewer to the south and the existing transportation system. 5. The rezoning and land use plan amendment for the one and a half acre parcel will not enable an intense commercial development that may be detrimental to the surrounding • residential area. s:planning:pc:lua-6 C. Box 490 • Elk River, MN 55330 • (612) 441-7420 • Fax: (612) 441-7425 City of Elk River Property/Hwy. 169 and 193rd Page 2 August 22, 1995 • Overview The three applications involve a 3 acre parcel at the northwest corner of Highway 169 and 193rd Avenue, and is also bordered on the west by Holt Avenue. The property extends north of 193rd along Highway 169 to approximately 194th alignment. The property is a triangular-shaped parcel which is not conducive to full development, given the narrowness of the parcel at the north end along with the existing mature pine trees and existing utilities. However, the site does have approximately 1-1/2 acres immediately at the corner of Highway 169 and 193rd for development opportunity. The property was originally part of Minnesota Department of Transportation right-of-way which, after the reconstruction of Highway 169 and Jackson, was able to be turned back to the City of Elk River. By turning this property back to the City of Elk River, there now presents a developable piece of property at the intersection of 193rd and Highway 169. Comprehensive Plan Amendment and Rezoning The Steering Committee has recently discussed the extension of commercial development north along Highway 169. The Committee has recommended • that commercial development be extended north along Highway 169 to approximately 194th alignment which would include the City property at the northwest corner of 193rd and Highway 169. The proposed land use plan amendment and rezoning request would allow for commercial development under the C3 standards. The C3 zoning district is the City's most intensive commercial district and is consistent with the existing commercial found along Highway 169. Although the rezoning to C3 would allow for a variety of possible uses, some of which may not be fully compatible with the residential to the west, however, the City, as property owner, can control the type of use. This "control" can respect the needs of the neighborhood to the west and meet the community's needs for commercial opportunities. Preliminary Plat The preliminary plat involves approximately 3 acres of property along Highway 169 between 193rd and 194th. The north end of the property has several mature pine trees that help buffer the residents west of Holt Street from Highway 169. The southernmost portion of the property is the area that is the most conducive to development, given its proximity to the • intersection of Highway 169 and 193rd, and the lack of mature pine trees. s:planning:p c:1ua95-6 City of Elk River Property/Hwy. 169 and 193rd Page 3 August 22, 1995 • The plat also includes dedicating the right-of-way for the recently realigned Holt Avenue, as well as a portion of Jackson Avenue. The plat also includes the appropriate easements for existing utility lines and drainage and utility purposes. As mentioned above the new parcel is three acres in area which meets the minimum lot size of one acre in the C3 zoning district. The purpose in platting the property at this time is to establish a legal description of a lot and block, clarifying any title problems that may exist, and put the property in a marketable condition for a possible end user. Recommendation It is recommended the Planning Commission recommend approval of the following: A. Amending the land use plan from MR (Medium Density Residential) to HB (Highway Commercial), and, B. Rezoning from Rlc (Single Family Residential) to C3 (Highway Commercial) based on the following findings: • 1. Ach, City Planner--- DATE: September 26, 1995 SUBJECT: Discuss City Policy Regarding Development within the Urban Service Area without City Water and Sewer Attached is a memo that was provided to the City Council on September 18th regarding this issue. The City Council discussed this item during open mike of the meeting on September 18th. After listening to a brief presentation from Craig House, attorney representing Mr. Chuba and Mr. Kincanon, the • council discussed the item and suggested that the Planning Commission discuss this item at their next meeting and make a recommendation to the City Council. In addition to the memo that was sent to the City Council, I have also attached some background information to assist the Planning Commission in reviewing this issue. Mr. Chuba and Mr. Kincanon have also provided some plans and a letter from ASCS office, explaining their situation and interest in locating in Elk River. There are several issues associated with this issue that, for the most part, relate to the city's growth management policies. Unfortunately, these policies may conflict with immediate development interest, making the decision on these matters that much more difficult. Ach, City Planner DATE: September 18, 1995 SUBJECT: REQUEST TO DEVELOP WITHIN THE URBAN SERVICE AREA WITHOUT CITY WATER AND SEWER Issue At Monday night's meeting the City Council may be addressed at open mike by Dennis Chuba and Richard Kincanon. Their issue is allowing development without city water and sewer. 1111 Background Over the past couple of weeks I have been talking with Dennis Chuba and Richard Kincanon regarding a 4,000 square foot office building they would like to construct at the southwest corner of Waco Street and Highway 10, which is the western gateway to the community. This particular piece of property is within the urban service area and is, therefore, subject to the ordinance requirement that commercial development "must hook up to sewer at water if it is within the city sewer district." The three acre parcel of land that Mr. Chuba and Mr. Kincanon want to develop at this time does not have water and sewer available. The city water and sewer currently stops at the county courthouse building and does not have an immediate need to be extended any further. Staff has discussed the issues and has presented Mr. Chuba and Mr. Kincanon three options for them to continue the pursuit of developing their property at this time. These options are as follows: 1. Request an ordinance amendment deleting the requirement that commercial development within the urban service area must hook up to water and sewer; or, • 2. Petition the city to have water and sewer extended to serve their property and allow the development to occur. Besides the issue of city water and sewer, staff has also identified some issues relating to traffic and the possible need for developing a frontage road concept similar to the frontage road currently being constructed from Joplin to Waco. Secondly, the city engineer has indicated options are still being explored to extend Waco Street across Highway 10 and ultimately, the Elk River. There is a chance that the realignment of Waco Street may involve a portion of the subject property to be developed. Allowing this type of development to occur prematurely is contrary to the city's growth management control policies and the existing zoning ordinance. Staff would encourage the City Council to carefully consider this issue because of the ramifications that will occur as a result of"premature (leap- frog) development" without any water and sewer. This situation of managing growth in the urban service area will be applicable to the east Highway 10 corridor when water and sewer is extended. Therefore, depending upon the Council's decision on this matter, a precedent may be set, further • complicating the efficiency to serve the east Highway 10 corridor with city water and sewer. Phase I expansion is targeted to occur before 1993. This five year expansion is to be I west of the existing urban service area between the Mississippi River and the Elk River (the western area),and east of Highway 169 between Elk Hills Drive and 197th Avenue. The western area should be serviced as soon as economically feasible. Phase II expansion is targeted to occur after the completion of Phase I. Any expansion is contingent upon the City's determination that there is readily available a cost effective method by way of which to extend those services to the serviced properties without I undue burden to the taxpayers. All future development within the boundaries of the planned urban service district will require hookup to the water and sanitary sewer systems except the area between the I= Elk River, County Road 35, Meadowvale Road and the western boundary of the City which will require overlay plats for future development. Since the number of Agr ' cultural producers has declined in the tri-county area with urban development these two offices were required to combine. Our first offer t( rent space was from the county for the previous administration blob, which did not get accepted. Our other offer was. with River Wood Developers in Joplin Mall . I worKed with Barb DonCaster to try and work out a lease agreement. River Wood stated they wanted • more of a retail :usiness not an office. Our office advert: _ed again for rental space and had several offers. The government rewires that we look at the cost to rent as a primary factor along with the location to the Court House, accessibility and other factors. CFSA offices are suppose to be located where the county seat for the coun' y is located , Sherburne County was decided out of the three counties be: ause it has more producers than Anoka-Hennepin. With this locatio , all of our requirement would be met and the move .to collocate could s ill be completed by the end of 1995. KT .
