Request
Consider a request by the City of Elk River to rezone approximately 60 acres of
the east half of the northeast quarter of Section 14 lying north of Highway 10
and south of 165th Avenue from Rla (Single Family Residential) to I1 (Light
Industrial).

Background
At the February 27,1996 Planning Commission meeting, this item was tabled
after it was determined that rezoning this property from Rla to I1 would make
the existing Cargill Animal Nutrition Center a non-conforming use. In May
1995, Cargill was granted a Conditional Use Permit for a feedlot so that they
could upgrade and expand the existing facility. Feedlots are a conditional use in
the Al and Rla districts but are not allowed in the I1 district.
Issues
In response to the issue of making the Cargill Animal Nutrition Center a non-
conforming use, staff is presenting the following as four alternatives regarding
the proposed rezoning:

• Continue with the proposed rezoning to I1 but adjust the boundary so that it
• does not include the structures associated with the Cargill Nutrition Center;
• Maintain the existing Rla zoning;
• Continue with the rezoning to I1 as proposed and amend the zoning
ordinance so that feedlots are a conditional use in the I1 zoning district.
Analysis
Continue with Rezoning as Proposed
The City initiated this rezoning request so that the zoning of the property would
be consistent with recent changes to the land use map and expansion of the
urban service area. The proposed rezoning would reflect the light industrial land
use designation and the fact that the property is now included in the urban
service area. The rezoning would also be consistent with Comprehensive Plan,
Section V. Industrial plan. The goals and policies of this section include
providing and encouraging industrial development opportunities in areas of the
City that are within the urban service area and considering industrial
development opportunities in the southeast sector of the City.
However, proceeding with this rezoning as proposed will make the Cargill
Nutrition Center a non-conforming use. Cargill was recently granted a
• conditional use permit to operate a feedlot on this property and feedlots are not
an allowed use in the I1 district. The conditional use permit included the area
under consideration for rezoning along with other Cargill property to the east.
Adjust the Boundary of the Proposed Rezoning
Under this alternative the area would be rezoned to light industrial; thereby,
maintaining consistency with elements of the Comprehensive Plan and land
use map as well as allowing uses appropriate for property located within the
urban service area. Instead of having the boundary of the proposed I1 zone
follow a quarter section line that runs through the center of the Cargill facility,
the east boundary of the proposed light industrial zone would be adjusted so that
it is about 1000 feet east of the adjacent parcel to the west. (see attached map)
This adjustment would maintain the existing Ma zone over most of the Cargill
Nutrition Center facility, including all of the structures, and the facility would
not become a non-conforming use.
However, the conditional use permit issued for the feedlot includes the entire 60
acres currently under consideration for rezoning. Even if the zone boundary is
adjusted so that the buildings are not included as part of the rezoning request,
part of the Cargill property will be made non-conforming under this alternative.

operations; the feedlot operation includes all the supporting farmland as well as
• the structures.
Amend the Zoning Ordinance so that Feedlots are a Conditional Use in the I1
Zone
This alternative involves proceeding with the rezoning request as proposed, but
also amending the zoning ordinance to include feedlots as a conditional use in
the light industrial zone. This alternative would allow the rezoning to proceed as
proposed, ensuring that the zoning of the parcel is consistent with the land use
designation of light industrial and reflecting the type of development that is
often associated with land located within the urban service area. It would also be
consistent with the goals and policies of the Comprehensive Plan and maintain
the Cargill Nutrition Center as a conforming use.
Since this alternative involves amending the zoning ordinance so that feedlots
are a conditional use in the light industrial zone, a determination should be
made regarding whether a feedlot, which many would consider an agricultural
use, is an appropriate use for the light industrial zone.
Maintain Existing Rla Zoning
• This alternative consists of keeping the existing Rla zoning in place. The entire
Cargill facility would stay a conforming use. Maintaining the existing Ria
zoning would reflect the existing use of the property and, in light of the recent
conditional use permit issued to upgrade the facility, the future long range use of
the parcel and most of uses allowed under the Rla zone are compatible with the
adjacent Kelly Farm property.
However, maintaining the existing zoning would not be consistent with the land
use map, which designates this parcel as light industrial not low density
residential. When property is within the urban service area, as this parcel is,
development of the parcel is generally more intense than that normally
associated with low density residential development. This alternative is also
inconsistent with the Comprehensive Plan's section on industrial development.
The plan calls for expansion of industrial opportunities in the southeast sector
and in areas that are within the urban service area; this is one of the few parcels
that qualify. If this parcel is left as Rla, other potential industrial property, that
meets the goals and policies found in the Comprehensive Plan, should be
identified and the boundary of the urban service area may have to be adjusted so
that this parcel in not included.

Recommendation
IIStaff is recommending approval of the rezoning from Ma to I1 and that the east
boundary of the proposed light industrial zone be adjusted so that it is
approximately 1000 feet east of the adjacent parcel to the west. Cargill has
expressed an interest in tabling this request to allow them time to review the
proposed options. Staff does not have any objections to tabling this request.

Dear Commissioners:
I am in-house counsel for the Feed Division of Cargill, Incorporated ("Cargill").
Below please find our position regarding the above-referenced rezoning issue, as well
as our concerns regarding the manner in which the City of Elk River has handled this
matter in light of our long-standing history of being a good corporation citizen in the Elk
River community.
Cargill seeks confirmation that the City of Elk River's proposed rezoning of 60
acres of the Cargill Animal Nutrition Center ("ANC") from R-1 a to I-1 will not alter the
research center's status as a permitted use. We have operated our agricultural
research center at the present site since 1958. We have invested millions in site
improvements, including a new $3 Million swine facility being completed just this month
under City and State permits and we intend to continue our research activities in Elk
River indefinitely. We believe that the Planning staffs view that the research operations
may be rendered a non-conforming use by the proposed rezoning is incorrect, and we
request confirmation that our research operations are a permitted "research laboratory"
use in the I-1 zoning district. If such confirmation is not available in light of the Planning
staff memorandum recently provided to the Planning Commission, we suggest holding
• this matter over for further discussion.

Background
The ANC is a research agricultural center located at 10383 165th Avenue in Elk
River. The ANC is the central component of the Cargill Animal Research Group. Its
mission is the development of improved technology in animal nutrition, nutrient
utilization and management. The ANC conducts beef research, dairy research, swine
research, and preservation research on a site consisting of 980 acres. Materials
describing the operations of the ANC are attached.
The ANC has conducted agricultural research at its present location since 1958.
Thus, Cargill's operations at our present site predates the City of Elk River's assumption
of governmental jurisdiction over this area by two decades. While there have been
changes in applicable land-use regulations over the nearly 40 years that the ANC has
been in operation, our activities at this site at all times have been authorized uses.
Prior to the consolidation of Elk River Township with the City of Elk River in 1978,
the Cargill property was zoned A-2, General Agricultural District, by Sherburne County.
When consolidation occurred, the City placed the ANC property in its A-1, Agricultural
• Conservation District, which permits general agricultural uses. The ANC obviously was
a permitted use under these classifications. In fact, although Cargill has sought and
obtained all necessary City permits for numerous improvements to the ANC since 1978,
until last year, we were never required to obtain a conditional use permit for our
research agricultural uses.
It is our understanding that in 1988, Elk River rezoned hundreds of acres of
agricultural land as part of its long-term growth Management Strategy. As part of this
process, the ANC property and most of the surrounding properties were rezoned R-1 a,
Single Family Rural Residential District. Cargill was not given direct notice of this
zoning change. This change did not affect the ANC, however, because the R-1 a zoning
district is intended to permit agricultural activities of the type conducted by the ANC
side-by-side with low-density residential development to create a "rural life-style."
(Council minutes from September 7, 1988 include a staff summary stating "[f]arming is a
principal use on lots five acres or larger within the R-1 a zone. Being zoned to R-1 a
does not eliminate farming or affect farm taxes.")
In 1990, Elk River rezoned several large areas of land along Highway 10 south of
the central business district to I-1, Light Industrial District. These broad zoning changes
were made to conform to the Comprehensive Plan. Approximately 225 acres of the
ANC property lying north of 165th street were rezoned to I-1 as part of this larger
rezoning. However, this change again did not affect the ANC because research
• laboratories are permitted uses in the Light Industrial District. It always has been our

view that the I-1 zoning is intended to permit research activities of the type conducted by
Cargill.
Relying on the fact that the ANC has been a permitted use in the various zoning
districts employed in Elk River, Cargill has made substantial investments to its
agricultural research center over the years. For example, since 1985, Cargill has
invested over $3 Million in site improvements and buildings on the ANC property and
almost $2.5 Million in technology and equipment to be used at the Elk River site. The
total investment over the life of the ANC has been considerably more. The cost of
replacing the facilities at another location has been estimated to be at least $8 Million.
As part of our investment in the ANC, in 1995 we began work on replacing our
aging swine research buildings with a new state-of-the art swine research facility. The
portion of the property where swine research is conducted is located south of 165th
Street in an area presently zoned R-la. When Cargill as a courtesy gave the City
advance notice of its construction plans, Elk River officials requested that we obtain a
conditional use permit for an approximately 300-acre portion of the ANC south of 165th
street, apparently viewing this portion of the research facility as within the "feed lot"
•
definition of the Zoning Code.
This was the first time that the City had suggested that the ANC was a
conditional use. It is not readily apparent in retrospect that this conditional use
classification was necessary or appropriate. Because there was no opposition to the
suggested permit, however, there was no discussion between Cargill and Elk River staff
as to whether the City had appropriately categorized the ANC to require a conditional
use permit. We obtained a permit from the City for the swine project on May 15, 1995.
Thereafter, we made a $3 Million investment in this state-of-the-art research facility,
which is now nearing completion.
In sum, Cargill has followed the planning process in Elk River for many years,
including the recent amendments to the Comprehensive Plan. To our knowledge, there
has been no indication at any point in this planning process that the ANC would not
continue to be a permitted use consistent with Elk River's long-range plans. It is not at
all clear why at this point in time, with this long background of Cargill's operations in Elk
River, that City staff have recently come forward with a non-conforming use issue with
the ANC.

The Current Proposed Rezoning
The City of Elk River is proposing to rezone a number of properties to conform
with recent amendments to the Comprehensive Plan. As part of this proposal, an area
along Highway 10 would be rezoned from R-1 a to I-1. Approximately 60 acres of the
ANC property located south of 165th Street (which is subject to the 1995 conditioned
use permit) are affected by this proposed rezoning. These 60 acres would be rezoned
from R-1 a to I-1 under the proposal.
To our surprise, we were told in late February by Planning staff that this proposed
rezoning may make the affected 60 acres of the ANC a non-conforming use. The basis
for this Planning staff conclusion is apparently that the area in question previously has
been permitted as a "feedlot" and feedlots are not permitted uses within the 1-1 zone.
We were told by Planning staff that the Planning Commission would take up the
proposed rezoning on May 27, but there would be discussion of the non-conforming use
issue prior to that time so there would be no impact to Cargill's operations.
• Just over a week ago we learned second-hand that the proposed rezoning had
been moved up to April 23. Late last Friday, we received a staff memorandum - not
only discussing this non-conforming use issue, but recommending a course of action
inconsistent with long-standing activities at the ANC. Planning staff has never
presented any of its concerns directly to Cargill. If we had not requested this
memorandum after learning of it second-hand, we would not have even known that the
Planning staff was proposing action that is incompatible with Cargill's past and intended
future uses.
The Planning staffs memorandum is very disturbing, both because of the
Planning staff's failure to even discuss the matter with us, and more importantly,
because the memorandum's conclusions seem without recognition of pertinent legal
principles and relevant facts, many of which have existed for years. The Planning staff
is recommending action which would make the ANC (or at least a significant portion of
it) a non-conforming use under the Zoning Code. Such a result obviously is not
acceptable since it drastically alters Cargill's long-standing authorization to conduct its
operations in Elk River as a conforming use, and impairs our ability to continue our
activities in the future.
What is particularly unfortunate is that we believe that an issue has been raised
here where none exists. The ANC is a permitted use in the I-1 zone. A "research
laboratory" is one of four permitted uses in the I-1 zone. Elk River Zoning Code §
900.10(14)(A)(iii); the ANC is, and for nearly forty years has been, such a research
• facility. The ANC is comprised of various structures and activities dedicated solely to

research. Its mission is research. Its function is research. It employs research
scientists and technicians. No one has ever before suggested any interpretation of the
I-1 zone that would exclude the ANC from the permitted research category, nor would
such an interpretation be reasonable given the long history of Cargill's operations.
Accordingly, we do not understand why this non-conforming use question has
been raised at this time. Because it has, however, the City should now confirm that the
ANC is a permitted use in the I-1 zone. There can be no serious question that Cargill's
activities at this site, for decades, has always conformed to local land use requirements.
As long as this confirmation is provided, Cargill has no objection to the proposed
rezoning as detailed more fully below.
Response to Planning Staff Options
We understand from Planning staff's memorandum that it is currently considering
four options to the non-conforming use issue it has raised. As outlined above, we
believe the question is best resolved by clarifying that the ANC is a permitted "research
laboratory" use in the I-1 zone. Our position on each of the four options raised by the
• Planning staff is summarized more specifically below:
Staff Option 1: Continue with Rezoning as Proposed
This option is appropriate as long as the City confirms that the ANC is a
permitted use as a "research laboratory" in the I-1 District. This is a reasonable
interpretation of the Zoning Code and would be the most expeditious alternative for
resolving this issue. If the City cannot provide this confirmation, then Cargill agrees with
the Planning staff that this option is completely unacceptable. We have invested
millions of dollars in the ANC since it was constructed in 1958. Less than one year ago,
Cargill was granted a permit by the City to build a new $3 Million swine research facility
at the ANC. The ANC is an integrated research facility. To rezone the proposed area to
make part of the ANC a non-conforming use would not only represent poor planning by
the City, it would be directly contrary to Cargill's reasonable, investment-backed
expectations.
Staff Option 2: Adjust the Boundary of the Proposed Rezoning
This option is unacceptable to us. Again, the ANC is an integrated research
facility with all portions of the site contributing to Cargill's operations. Drawing an
arbitrary line between individual structures on some theory that they may or may not fall
• within some unidentified definition of "feedlot" has no basis in fact and inevitably would
lead to future confusion. The entire center serves a singular purpose - agricultural

research. The Commission should adopt a solution that is consistent with the actual
operations of the ANC.
Staff Option 3: Amend the Zoning Ordinance so that Feed Lots are a Conditional
Use in the I-1 Zone
This option may represent an acceptable solution. We understand that if this
solution were adopted, the City will revise the Zoning Code and then reissue or amend
Cargill's conditional use permit to reflect that the ANC's entire operations in the I-1 and
R-la districts are permitted. Although we do not believe it is necessary to classify the
ANC as a feedlot, Cargill would be willing to explore this option with the Planning Staff
as long as there are no additional restrictions placed on the scope of activities that are
authorized to occur.
Staff Option 4: Maintain Existing R-la Zoning
This option also is an acceptable solution. The Planning staffs concern with this
option is that it is inconsistent with the Comprehensive Plan. We understand, however,
•
that the intent of the Comprehensive Planning process was to allow the ANC to continue
to operate as a permitted use in zone I-1. We therefore disagree with the Planning
staffs suggestion that this option is inconsistent with the Comprehensive Plan.
Summary
The best solution to this unfortunate situation would be for the City to confirm that
the ANC is a permitted use in the I-1 District. If the City is not prepared to provide this
confirmation at this time, Cargill concurs with the Planning staff that this proposed
rezoning should be tabled until we can confer with the Planning staff to develop a
recommendation that is consistent with the Comprehensive Plan, consistent with the
Zoning Code, and, most importantly, consistent with the actual operations of the ANC.
Unfortunately, if the City were to either make the ANC a non-conforming use or
leave this non-conforming question unresolved, Cargill would likely be required to take
action to address this situation. Classification of the ANC as a non-conforming use at
this late date would be profoundly unfair to Cargill. We have invested millions of dollars
in this state-of-the-art research facility based on our understanding that the ANC is and
has been a permitted use.

Cargill's Worldwide Feed business is led by David Larson (President of Cargill's Feed Division since 1983 and past
Chariman of the American Feed Industry Association) and his team of 8 senior managers, all of whom have vast
experience in both the U.S. and the international feed marketplace. Managerial guidance is provided through
review of operating reports, regular personal contact to discuss current issues in the marketplace and regular trips
to provide in-depth review and suggestions for improvement.

Cargill offers many in-house training programs including courses in leading and managing people, marketing
management, problem solving and decision making, and executive development. in addition to these, we offer
training specifically geared to Feed employees including: Professional Selling Skills,Territory Management, animal

Individual training programs for selected nationals are developed with specific objectives tailored to the individual's
