(Arby's), Public Hearing Case No. CU 96-14 Request Franchise Associates, Inc. is requesting a conditional use permit for site plan review to construct a Class II restaurant facility in Elk Park Center planned unit development. • Location Lot 5, Block 2, Elk Park Center (generally located directly west of Wendy's Restaurant). Zoning/Land Use PUD (Planned Unit Development) / HB (Highway Business) Attachments • Memo from the City Engineer dated 6/19/96 • Location map • Zoning map • Proposed development plans Overview Arby's is proposing a 4,515 square foot Class II restaurant facility in the Elk Park Center planned unit development. The restaurant will include a drive- • thru lane, leading up to two pickup windows. The first window would be for Arby's customers and the second window would be the Sbarro pickup. 13065 Orono Parkway • P.O. This is one more space than is required by city code. The interior design of the restaurant offers a traditional Arby's service counter in addition to a Sbarro pizza and pasta counter. The common seating area will have a total of 92 seats with a variety of tables and seating booths. Elk Park Center Planned Unit Development The Elk Park Center approved development plan identified a building pad slightly smaller (about 100 square feet) than proposed by Arby's. The plan did not reflect a drive-thru lane for a restaurant; however, given the conceptual nature of the plan, slight modifications are and have been accepted. For the most part, the proposed building, associated parking and setbacks meet the development plan that was previously approved. Building Location Staff has briefly discussed with the architect the possibility of sliding the building and parking about 10 feet to the west. This may possibly accomplish the following: II • Establish additional green space between the drive-thru lane and Freeport Avenue. • Provide enough space along Freeport Avenue for a monument-style sign to be located and meet the 10 foot minimum setback requirement. • Provide an opportunity to adequately locate an electrical transformer as required by Elk River Municipal Utilities. • Increase the sidewalk area to meet the six foot width requirement. The architect will explore this suggestion and may have a response at the Planning Commission meeting. Site Plan Review A. Parking and Circulation 1. Staff has some concerns with the width of the drive-thru lane. Supposedly, the drive-thru lane is wide enough to allow two lanes of traffic; however, staff questions whether the 16 feet is • actually wide enough for two cars to pass one another. If the adequate width cannot be accomplished, staff would recommend that the drive-thru lane be narrowed to discourage this by-pass s:\planning\pc\cu96-14.doc Memo to the Planning Commission/CU96-14 Page 3 June 25, 1996 • move from occurring and accomplish additional green space along the south edge of the site. 2. Relocating the traffic/landscape islands that were previously installed by the developer will need to be made part of the plans to define the end of the parking rows. This improvement is reflected in the plans and should be included in any revisions. B. Landscaping 1. Underground irrigation will need to be provided throughout all landscaped areas. 2. The existing ornamental trees shown along Freeport Avenue and the 191st Lane entry are not installed as shown on the plan. These trees should be installed as part of the landscaping improvements. 3. Grouping of medium-sized shrubs should be incorporated along with the existing trees along the 191st Lane entry and along Freeport to soften the appearance of the drive-thru lane. • C. Pedestrian Circulation 1. Consideration should be given to providing a sidewalk connection from the restaurant facility to the sidewalk along Freeport Avenue. This a similar improvement that has been made to other facilities along Freeport Avenue (i.e., Wendy's). 2. Sidewalk along the west side of the building should be increased in width to six feet. D. Drainage and Utilities 1. Please refer to the attached memo dated June 19, 1996. E. Signage 1. The proposed monument-style sign at the southeast corner will need to be relocated to meet the 10 foot setback requirement. Attached to this report is a memorandum from Kendra Lindahl regarding the proposed signage. The signage requirements outlined in the Elk Park Center PUD shall be met. 3. The proposed directional signs beyond the project's property limits shall be eliminated. All signs associated with the business will need to be on the same lot as the development. F. Architecture 1. The Elk Park Center planned unit development agreement identifies a brick material be used as part of the building. The current plans presented Arby's do not include any type of brick material; however, staff has met with the architect to discuss this and revisions are being made to incorporate some brick. It is anticipated that the revised plans will be available for the Planning Commission's review at the meeting Tuesday night. Recommendation • It is recommended the Planning Commission recommend approval of the conditional use permit request by Arby's to construct a 4,515 square foot Class II restaurant facility with a drive-thru window with the following conditions: 1. All of the comments outlined in the memo dated June 25, 1996, to the Planning Commission be incorporated into the revised set of plans. 2. All of the comments stated in the City Engineer's memo dated June 19, 1996, be incorporated into the revised set of plans. 3. Box 490 Fax:612-644-9446 Elk River, MN 55330 RE: ARBY'S SITE PLAN REVIEW Dear Mr. Ach: As requested, we have reviewed the site plan information provided by Progressive Architecture regarding the proposed Arby's restaurant to be located in Elk Park Center. Based on our review and comments received at the staff review meeting, we would offer the following comments: CML ENGINEERING ENVIRONMENTAL 1. A 5-foot wide concrete walk is shown on the west side of the building. Parking stalls UNICIPAL', adjacent to this walk are 18 feet deep. This depth of parking stall is allowed PLANNING anticipating that a vehicle could overhang the concrete curb and gutter by two feet. SOLID WASTE If this occurs, the usable walk area would be reduced along the side of the building STRUCTURAL from five feet to three feet. We believe that the walk area should be widened, SURVEYING anticipating the overhang of cars parked adjacent to it. We would also recommend TRAFFIC that the sidewalk continue to the north and provide another access point over the curb TRANSPORTATION for vehicles that would choose to park north of the restaurant. ELECTRICAL/MECHANICAL 2. The sign shown in the southeast corner of the site is located within an existing 10-foot ENGINEERING: utility and drainage easement. HVAC POWER DISTRIBUTION 3. At the staff review meeting, Glenn Sundeen of the Elk River Municipal Utilities SCADA raised the question of where his electrical box would be located. He indicated that SYSTEM CONTROLS the code requires it to be located 10 feet away from doors, windows, or flammable walls. Consideration should be given to where this electrical box can be located on the site. 4. We understand that the restaurant will have two drive-up windows, one for Arby's and the other for Sbarro. We question whether the drive-up lane is wide enough to allow vehicles to pass each other to access the two windows. We believe with the tight radius on the corner and 17 feet of width on the east side drive-through, that it will be very difficult for cars to bypass the first window and access the second •OFFICES IN: window without causing conflicts. However, the drive-through lane is wide enough MINNEAPOLIS for vehicles to attempt these types of moves. The drive lane is shown as 26 feet wide, so there is ample opportunity to make adjustments to provide the longer parking stalls. 6. The information provided on the grading plan is rather confusing. At several locations, there are elevations provided with the notation "TOC", which we assume is top of curb, and "BOC" which we assume is bottom of curb. In some locations, this is shown as a half a foot difference, in other locations it is shown as .25 feet difference, and in yet other locations the "BOC" is shown higher than the "TOC". In any case, there is ample opportunity for grading the site and allowing for drainage to the existing catch basins. However, we would suggest that the grading plan be reviewed and corrected as needed, such that the City will have a correct version in their files. The monument sign is too large, and they have more wall signage than is allowed. The directional signs are not mentioned in the PUD agreement, but the proposed signs are larger than allowed by the sign ordinance.
