Location • The area under consideration for rezoning is generally bounded by County Road 13 on the north and west, 185th Avenue alignment on the south and Wilson Street alignment on the east. The properties are owned by George Deschenes and Industrial Hardfacing. Zoning/Land Use Ric (Single Family Residential) / LI (Light Industrial) Attachments • Location map • Zoning map • Land use map • Map of area#8 • Ordinance No. 96- Background These properties were included as part of a larger area (area#8) that was considered for rezoning to light industrial in March 1996. As part of the update • of the comprehensive plan, the land use designation was changed to light industrial. The rezoning was initiated in order to bring the zoning into 13065 Orono Parkway • P.O. When the rezoning was originally • presented to the Planning Commission, the Commission recommended approval of the rezoning as proposed. However, when the rezoning was presented to the City Council it was denied in a large part because of arguments made by a prospective developer of Waddy Schultz's property. During the course of the Council's deliberation, there was some discussion that there should be some consideration given to rezoning the properties owned by Industrial Hardfacing and George Deschenes. It was noted that the possible realignment of County Roads 12 and 13 would better define a possible industrial area and that these properties would likely be within the boundaries of any future industrial zone. In light of this discussion, the Council directed staff to look into the possibility of rezoning the Industrial Hardfacing and Deschenes properties and present the issue to the Planning Commission. Existing Conditions The approximately 13 acres is currently zoned Rlc (Single Family Residential) with a land use designation of LI (Light Industrial). The surrounding properties are zoned Ric. The land use designation of the properties to the south is light industrial and to the north, east and west is medium density residential. Industrial Hardfacing is a light manufacturing facility and the Deschenes IPproperty contains a single family house. There are wetlands on both the Industrial Hardfacing and Deschenes properties. The wetland on the Industrial Hardfacing property consists of a small pond and shoreline wetland. The Deschenes property has a horseshoe shaped wetland area near County Road 13. The center of the wetland area consists of a small pond. The site is relatively flat with some lowlands associated with the wetlands. Vegetation includes stands of hardwood, areas of brush and volunteer growth. Evaluation of Request In order to approve a rezoning request there must be a finding that a) the plan was in error when it was adopted, and therefore, should be changed or, b) the times and circumstances have changed since the plan was adopted, and a change is warranted. This rezoning is being considered in order that this area will be consistent with the land use plan. The updated land use plan designated this area as LI (Light Industrial). The proposed rezoning to I1 (light Industrial) is consistent with that revised land use designation, and therefore, the second finding is met. 1111 Memo to the Planning Commission/ZC 96-18 Page 3 October 22, 1996 Consideration should also be given to the existing conditions within the area • directly and indirectly affected by the proposal, the use to which the property affected is being devoted at the time and the relevant portions of the land use plan. The Industrial Hardfacing property is currently being utilized in a way that is consistent with light industrial zoning. The rezoning is consistent with the concept of providing industrial land within the urban service area and the ease that municipal services could be extended make this area very suitable for industrial uses. Furthermore, the area is accessed by County Road 13 which connects with Highway 169 Recommendation Staff can recommend approval of the proposed rezoning from Rlc (Single Family Residential) to I1 (Light Industrial) based on the following: 1. The proposed rezoning is consistent with the Comprehensive Land Use Plan designation of LI (Light Industrial). 2. The area has access to a major arterial, Highway 169, by way of County Road 13. • 3. The area is within the urban service area with availability of urban services and utilities upon future development. 4. The proposed rezoning is consistent with the concept of providing industrial land within the urban service area. • s:\planning\scott\zc96-18.doc ORDINANCE 96 - CITY OF ELK RIVER • AN ORDINANCE AMENDING THE CITY OF ELK RIVER ZONING MAP TO REZONE CERTAIN PROPERTY FROM R1C (SINGLE FAMILY RESIDENTIAL) TO LI (LIGHT INDUSTRIAL) CASE NO. ZC 96-18 The City Council of the City of Elk River does hereby ordain as follows: Section 1. The duly adopted Zoning Map of the City of Elk River is hereby amended to rezone the property described as: See Attached Exhibit A Section 2. The rezoning is being approved based on the following findings: 1. The proposed rezoning is consistent with the Comprehensive Land Use Plan designation of LI (Light Industrial). • 2. The area has access to a major arterial, Highway 169, by way of County Road 13. 3. The area is within the urban service area with availability of urban services and utilities upon future development. 4. The proposed rezoning is consistent with the concept of providing industrial land within the urban service area. Section 3.
