Adopt,by motion, an ordinance to rezone certain property from I-3 (General Industrial) to C-3
(Highway Commercial).
Background/Discussion
The property is zoned I3 (General Industrial) and the applicant is seeking to rezone the subject property
to C3 (Highway Commercial) to comply with the Comprehensive Plan,which guides the property for
Highway Business.
The rezoning is consistent with the City of Elk River Land Use Plan adopted as part of the City of Elk
River Comprehensive Plan.
Planning Commission Meeting
No one spoke for or against the request and staff has not received any comments since the Planning
Commission meeting.
The applicant had no issues with the recommended conditions.
The Planning Commission unanimously recommended approval of the request.
Statutory Review Period
Per State Statute 15.99 the required 60-day review period ends on May 11, 2018.

Ordinance 18 -
An Ordinance Amending the City of Elk River Zoning Map to Rezone Certain
Property from 1-3 to C-3.
Case No. ZC 18-01
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1. That the duly adopted Zoning Map of the City of Elk River is hereby amended to
rezone the property described on attached Exhibit A to C-3 Highway Commercial
SECTION 2.That the rezoning approved by this Ordinance is based on the following findings:
1. The rezoning is consistent with the City of Elk River Land Use Plan adopted as
part of the City of Elk River Comprehensive Plan.
SECTION 3. That this ordinance shall take effect upon adoption and be published as provided by
law.
Passed and adopted by the City Council of the City of Elk River this 16th day of April, 2018.

Recommend, by motion, approval of an ordinance rezoning certain property from I3 (General Industrial)
to C3 (Highway Commercial) for the following reason:
1. The rezoning is consistent with the City of Elk River Land Use Plan adopted as part of the City
of Elk River Comprehensive Plan.
Background/ Discussion
The property is zoned I3 (General Industrial) and the applicant is seeking to rezone the subject property
to C3 (Highway Commercial) to comply with the Comprehensive Plan, which guides the property for
Highway Business.
The applicant is also applying for a Conditional Use Permit (CU 18-05) for mini storage. Mini storage
facilities are allowed by CUP in both the I3 and C3 districts.
The zoning and land use currently do match on the subject parcel. Staff suggested the applicant apply for
a Zone Change versus a Land Use Amendment. Approving a Land Use Amendment would result in a
small parcel of land with an Industrial designation surrounded by Highway Business Land uses.
Applicable Regulation
In reviewing a proposed amendment, consideration shall be given to existing conditions witbin the area directly and indirectly
affected by the proposal, the conservation ofproperty values, the use to which the property affected is being devoted at the time,
and relevantprovisions, if any, in the land use plan.
In the review of the standards for a Zone Change as outlined, it appears that the request is consistent
with all of these standards.
