Request
The City of Elk River is requesting a conditional use permit for site plan
review to construct an on-sale liquor store (Northbound Liquor).
Location
The northeast corner of 193rd Avenue and Highway 169, Lot 1, Block 1,

Overview
The City of Elk River is proposing to construct a 12,818 sq. ft. liquor store
facility within the Hillside Crossing Planned Unit Development. The
building will consist of a first floor of 7,858 sq. ft. and a basement area of
4,960 sq. ft.

• Planned Unit Development
All of the proposed buildings within the Hillside Crossing Planned Unit
Development are required to receive a conditional use permit for site plan
review. This is a typical requirement in all of the planned unit developments
that are being approved along the Highway 169 corridor. This review process
is the opportunity for the Planning Commission and Council to review the
proposed development plans to determine their conformance with the "master
plan" approved for the Hillside Crossing project.
Parking/Access
The project is proposed to have two access point off of Evans Street. The first
• access closest to the intersection of Evans and 193rd Avenue will be aligned
with the first access into the Sax grocery store. The second access further
north on Evans Street is located in an approximate location as identified on
the concept plans for the Hillside Crossing Planned Unit Development.
These two access points will provide easy circulation in and out of the facility
for passenger vehicles, recreational vehicles and delivery trucks servicing the
facility.
The total number of possible passenger vehicle parking stalls on site is 69
•
spaces. The submitted site plan has been prepared illustrating 8 car-trailer
parking spaces in place of 24 passenger vehicle spaces. The Planning
Commission may want to discuss if they have a preference on how the
parking lot should be striped to accommodate car-trailer parking. The two
options that may be considered is to actually designate car-trailer parking by
striping, or, stripe the parking lot for passenger vehicles and allow the car-
trailer parking to occur wherever it may be convenient at any given time.
Landscaping
The landscaping plan consists of a variety of materials consistent with the
city's ordinances. The proposed landscaping along Highway 169 will need to
be reviewed to determine if the mature height of the proposed trees will
conflict with any overhead electric lines. If this is the case, the trees will
need to be relocated.
During staffs review of the plans it was felt that the proposed landscaping
near the entrance of the facility should probably be removed because of the
amount of pedestrian traffic in this area. Staff was concerned that the
shrubbery proposed for this area would receive a lot a abuse from customers
possibly cutting through the planting areas. All landscaped areas will be

• sodded and have underground irrigation installed as set forth in the PUD
agreement for Hillside Crossing.
Signage
The Hillside Crossing Planned Unit Development Agreement was approved
with signage requirements that could be carried out through the entire
development. When the Sax Foods facility was developed there was specific
signage approved as part of that project. In addition, other criteria were
established for the remaining lots in the Hillside Crossing project. With the
liquor store being the first free-standing site in Hillside Crossing, one of the
sign requirements in the PUD agreement has raised some concern. The
allowable wall signage is currently limited to one wall sign. This condition is
different than the sign requirements in the Elk Park Center Planned Unit
Development agreement which allows one wall sign for every free-standing
building, and two wall signs for those lots which have frontage on two streets.
In discussing this with the developer of Hillside Crossing, it was agreed that
the Planned Unit Development for Hillside Crossing be amended to be
consistent with the Elk Park Center sign requirements.
The signage proposed for the liquor store includes one wall sign on the south
elevation facing 193rd and one wall sign facing the west directed toward
• Highway 169. In addition to these wall signs, there is an electronic reader
board which will be oriented directly toward the intersection of Highway 169
and 193rd.
There is no free-standing signage proposed at this time, however, the liquor
store will utilize one of the available spaces on the Sax Foods free-standing
sign along Highway 169.
Building Materials
The building materials will consist primarily of brick with a soft earthtone
color. Through the center of the building, a raised pre-finished metal roof
will be installed with a green color matching the green on the Sax Foods
building. The building's orientation will be towards the Highway 169/193rd
Avenue intersection with the service area along the north side of the
building.
Recommendation
It is recommended the Planning Commission recommend approval of the
• conditional use permit request for site plan review to construct a 12,818 sq.
• ft. liquor store facility and amending the Hillside Crossing PUD Agreement

• to allow wall signage consistent with Elk Park Center, with the following
conditions:
1. APPROVAL FROM MN/DOT BE RECEIVED FOR THE PROPOSED GRADING IN THE
HIGHWAY 169 RIGHT OF WAY.
2. THE EXISTING FIRE HYDRANT SOUTH OF THE FIRST ENTRANCE INTO THE SITE BE
RELOCATED AT A LOCATION ACCEPTABLE TO THE FIRE CHIEF.
3. THE TRAFFIC CONTROL/LANDSCAPED ISLAND AT THE SOUTHEAST CORNER OF THE
BUILDING BE REMOVED TO EASE IN SNOWPLOWING THE PARKING LOT.
4. THE LANDSCAPING SHOWN NEAR THE ENTRANCE TO THE LIQUOR STORE FACILITY BE
REMOVED AND REPLACED WITH CONCRETE.
5. ALL SIDEWALKS ADJACENT TO PARKING AREAS WILL NEED TO BE A MINIMUM OF 6
FT. IN WIDTH.
6. THE POLICE DEPARTMENT HAS ASKED THAT AN ADDITIONAL WINDOW ON BOTH SIDES
OF THE ENTRANCE BE PROVIDED TO IMPROVE THE EMPLOYEES' SURVEILLANCE OF
THE PARKING LOT.
7. COMMENTS OUTLINED IN THE CITY ENGINEER'S MEMO DATED 1/17/97 BE
INCORPORATED INTO THE PLANS FOR APPROVAL.

RE: NORTHBOUND LIQUOR STORE SITE PLAN REVIEW
Dear Mr. Ach:
CIVIL ENGINEERING: As you are aware, the proposed Northbound Liquor Store development located at the
ENVIRONMENTAL corner of 193rd Avenue and Evans Street NW in the Hillside Crossing development is a
UNICIPAL City project. As such, we have prepared the Preliminary Grading Plan and Preliminary
NNING Utility Plan for the site. There are just a few items I believe are worth noting. They are
SOLID WASTE as follows:
STRUCTURAL
SURVEYING 1. The site will receive sanitary sewer and water service from the existing stubs
TRAFFIC located at the southern portion of the site off of Evans Street.
TRANSPORTATION
2. The existing hydrant located along Evans Street at the southeast corner of the lot
ELECTRICAL/MECHANICAL will need to be relocated at a location determined by the Fire Chief for providing
ENGINEERING: better fire protection to the building.
HVAC
POWER DISTRIBUTION
3. There is an existing catch basin on Evans Street which will fall into a driveway

opening for the site. This catch basin will need to have the casting changed to one

that is appropriate for a driveway location.
4. The proposed storm sewer for the site will pick up the drainage internal to the site
and will also provide an extension into the TH 169 right-of-way to intercept
highway ditch flow before it can enter the Liquor Store site overland. This
proposed catch basin and grading in the TH 169 right-of-way will require a
MnDOT permit.

d, Monument Sign For Freestanding Sites
1. Each of the freestanding buildings within Hillside
Crossing will be allowed to have a freestanding sign.
The freestanding sign must be of a monument style with
a maximum height of Ten (10) feet and a maximum area of
One Hundred (100) square feet.
e. Wall Signs (Freestanding Sites)
'; 1. Wall signage for each freestanding building must consist
of individual letters and shall not have more than One
(1) wall sign for each principal building.
2. The gross surface area of a wall sign for freestanding
buildings shall not exceed Ten (10) percent of the area
of the building wall, including doors and windows, to
which the sign is to be affixed.
f. Wall Signs (Multi Tenant Building)
1. Fascia signs for individual retail tenants shall be for
• store identity only.
2. Capital letters shall be no larger than 32" high, lower
case letters shall be no larger than 24" high. Signs
shall be located on the west and south sides of the
grocery store in a symmetrical manner, but in no case
shall they extend closer than 3' - 4' from the projected
lease line.
3. These signs may be internally illuminated, individual
letters placed on a 4" square electrical raceway,
painted to match the brick facia.
4. No signage shall be permitted on the sides or rear of
the building, other than that required for delivery
identification or traffic control, except the on-premise
tenant business sign identifying "Q-Cumbers" restaurant
on the southwest corner of the grocery store building.
g. Major Tenant Signage
1. Signage for the grocery tenant, Fresh Value Foods, shall
be compatible with City approvals . Proposed signage
includes the following:
"Fresh Value" approximately 10' - 0" high
"Discount Food & Drug" approximately 4' - 0" high

1. A monument style sign may be located at the intersection of
Jackson Road and southernmost entrance to the project.
2. This sign shall have a maximum height of six (6) feet and a
width of four (4) feet.
3. The purpose for this sign is to identify the anchor tenant
(Target) located at the southerly end of the project.
4. Said sign shall be constructed in accordance with the
illustration on Attachment B.
