( MEMORANDUM ty of 1R/ River TO: Planning Commission FROM: Steve Ach, City Planner.-<ree- DATE: February 25, 1997 SUBJECT: Conditional Use Permit Request to operate a Class I Restaurant and On-Sale Liquor Establishment, Public Hearing Case No. CU 97-4 Request Applebee's Neighborhood Grill and Bar is requesting a conditional use permit to operate a Class I restaurant and an on-sale liquor establishment. Location • Lot 3, Block 1, Heying Addition (northeast corner of Freeport Avenue and School Street). Zoning/Land Use C3 (Highway Commercial) / HB (Highway Business) Attachments • Memo from City Engineer dated February 19, 1997 • Location map • Zoning map • Proposed development plans • Concept plan for the Heying Addition Overview Applebee's Neighborhood Grill and Bar is proposing to construct a 4,759 sq. ft. restaurant and bar. The table dining area will have a total of 156 seats and the bar seating/dining area will have a total of 18 chairs surrounding the • centrally located bar area. The restaurant also tries to create a neighborhood atmosphere with its internal decor and ambiance. The centrally located bar area will have two TV's in close proximity for added entertainment. The proposed restaurant will not include any "live" entertainment. Hours of Operation Applebees' proposed hours of operation are as follows: Monday through Thursday - 11am to 12 midnight Friday and Saturday - 11am to 1:30am Sunday - 10 am to 12 midnight Site Plan The proposed site plan is very similar to the concept plans that were submitted along with the Heying Addition plat. The one modification that has taken place is an adjustment of the parking area adjacent to Freeport • Avenue. Originally, the parking stalls that are now along Freeport Avenue were adjacent to the proposed building. This presented a concern from the standpoint the drive aisle would only be approximately 25 feet from the travel lane of Freeport Avenue. By adjusting the parking lot as shown on the plans, the distance from Freeport Avenue to the interior parking area has now become approximately 45 feet. This additional distance allows greater stacking of vehicles on the interior, as well as a better opportunity for vehicles entering the site to get off of Freeport into the parking area. Much like the Holiday gas station, the Applebees Restaurant is oriented towards Freeport Avenue. The service and refuse collection area is then located to the east side of the building in an enclosed area with a brick material to match the exterior of the building. Parking/Traffic Circulation Access to the Applebees site will primarily occur off of the proposed curb cut off of Freeport Avenue. In addition, all of the lots within the Heying Addition will have a common driveway connecting each site internally without having to use Freeport Avenue. This overall design will eliminate unnecessary trips onto Freeport from one site to the next, rather allow for convenient movements on-site. • s:\planning\pc\cu97-4.doc Memo to the Planning Commission/CU 7-4 February 25, 1997 Page 3 As mentioned in the Holiday report, the connecting drive between Applebees and Holiday across Lot 2, Block 1 will need to be completed at the same time the Applebees and Holiday Station are constructed. This driveway will be necessary to facilitate drainage of the parking areas, as well as providing that immediate connection between the two initial sites to be developed. Building Elevations The proposed building elevations are identical to any Appplebees that has been constructed around the metro area. The materials include primarily face brick with a series of windows around the dining area. The windows are also covered with a decorative awning with Applebee's color scheme of green, sand and rust. Decorative lamps which are attached to the building will surround the entire building. As mentioned earlier, the entire trash enclosure and storage area will be completely enclosed with a brick material matching the building. On-Sale Liquor As previously mentioned, Applebee's will have a bar area offering the sale of liquor for on-site consumption. On-sale liquor is a conditional use as stated in the zoning ordinance. However, liquor establishments are also required to • obtain a liquor license from the City Council. The City does not have any "setback requirements" from other uses such as public facilities; therefore, staff does not foresee a conflict with the sale of liquor at this location. SiMnage Applebees' sign package includes a wall sign on the front of the store facing Freeport Avenue, as well as a wall sign on the south side facing the northbound traffic on Freeport. Applebees' freestanding signage will be placed along Freeport Avenue and will consist of a monument-style sign with dimensional requirements (height - 10 ft., size - 100 sq. ft.) similar to the standards in Elk Park Center. A detail of this sign is attached. Recommendation It is recommended the Planning Commission recommend approval of the conditional use permit request by Applebees Neighborhood Grill & Bar to construct a 4,759 sq. ft. Class I restaurant along with an on-sale liquor establishment, with the following conditions: • s:\planning\pc\cu97-4.doc Memo to the Planning Commission/CU 7-4 February 25, 1997 Page 4 1. All of the comments outlined in the City Engineer's memo dated IIIFebruary 19, 1997 be incorporated into the revised set of plans for approval. 2. The proposed retaining wall along the east side of the parking lot be constructed of a Keystone or similar masonry block. A detail of this retaining wall should be provided along with the final set of plans. 3. The larger overstory trees and conifers that are proposed within the 30 foot easement along the east side of the property should be relocated somewhere else on site. 4. It is recommended that three of the overstory trees along the east side could be relocated along the Freeport Avenue side of the site. 5. No parking lot lighting should occur within the 30 foot drainage and utility easement along the east side of the property. Lighting within this area will not only be within the drainage easement, but also too close to the overhead powerlines along Highway 169. 6. The final set of plans will need to show the construction limits along the north side of the property. This may have to include expanding the • parking lot slightly onto Lot 4, Block 1 to avoid any erosion which may take place between the time that Applebees Restaurant is completed and the ultimate development of the final lot to the north. 7. All landscape material must meet the minimum size requirements as set forth in the zoning ordinance. 8. Box 490 Elk River, MN 55330 RE: APPLEBEE'S SITE PLAN REVIEW Dear Mr. Ach: As requested, we have reviewed the submittal package for the proposed Applebee's CIVIL ENGINEERING: located in the Heying Addition at the corner of School Street and Freeport Avenue. ENVIRONMENTAL Based on our review and comments received at the staff review meeting, we would offer UNICIPAL the following comments: NNING SOLID WASTE 1. The package we reviewed consisted of a set of 10 plan sheets prepared by John STRUCTURAL Oliver and Associates, with a revision date of February 11, 1997, and storm SURVEYING drainage calculations also prepared by John Oliver and Associates, with a revision TRAFFIC date of February 14, 1997. TRANSPORTATION 2. Sanitary sewer service is provided to the site from a 6-inch stub off of Freeport ELECTRICAL/MECHANICAL Avenue. Water service is provided to the site by tapping a 6-inch water service off ENGINEERING: of the existing 24-inch watermain on the east side of the site. An additional hydrant HVAC that the Fire Chief requested is shown also tapped off the 24-inch watermain and POWER DISTRIBUTION placed in an island in the parking lot. It will be necessary to check the final plat of SCADA Heying Addition to ensure that there is a utility easement provided for this hydrant. SYSTEM CONTROLS 3. Storm drainage from the site is collected in catch basins and small diameter storm sewer and conveyed to the pond proposed for the lot just south of the Applebee's site. On sheet 6 of 10, manhole 101 is shown as a 48-inch diameter structure. I believe this manhole needs to be at least 90 inches, and perhaps larger, due to the number of pipes and the angles at which they enter the manhole. Manhole 102 may also need to be larger than 48-inch diameter for the same reason. These should be verified and changed. OFFICES IN: 4. The site has one access off of Freeport Avenue, located at the north end of the lot. This issue was a condition of the approval of the Heying Addition plat. Therefore, this issue needs to be addressed as part of the Applebee's Site Plan review. 5. As part of the approval of the entire Heying Addition plat, storm drainage and internal traffic routes were reviewed and approved. There currently is a proposal to develop a Holiday Stationstore on Lot 1 and the Applebee's on Lot 3. It appears that it will be necessary to develop the ponding and the transportation route through Lot 2 to ensure that the concepts approved with the plat approval are functional for these first two developments. The plan should be modified to indicate how many improvements are planned to be constructed on Lot 2, south of Applebee's. 6. There is a proposed monument sign in the southwest corner of the site. This monument sign appears to be close to the 10-foot drainage and utility easement, along the front of the lot. Care should be taken to place this sign outside of that easement. The same is true of the storm sewer at the access off of Freeport Avenue. This storm sewer should be placed outside of the 10-foot drainage and • utility easement. 7. The storm sewer at the access off of Freeport Avenue shows a 12-inch stub extended to the north. The stub falls directly adjacent to a curb line. It is not clear if it is the intent to construct this concrete curb and gutter and parking area at this time, or to leave it undeveloped. If it is constructed at this time, it will be necessary to remove it in the future when the storm sewer line is extended further north. The plans should be modified to reflect what is intended to be built as part of the Applebee's development and what is intended for the future. 8. As part of the approval for the Heying Addition, the grading of the ponds included a 10-foot area directly behind the sidewalk along Freeport Avenue which was essentially flat with one foot of fall in 10 feet. It appears that the Grading Plan for the Applebee's site reflects a steeper slope than was approved. The Grading Plan should be modified to reflect the flat area immediately adjacent to the sidewalk. 9. The storm sewer calculations submitted with the Applebee's plans appear to be adequate. We would note, however, that the plan sheet showing the drainage areas still indicates that the pond outlet is to be built by others. This outlet will need to be constructed prior to or with the Applebee's improvements, so that the storm drainage system is functional. • • Mr. Steve Ach February 19, 1997 Page Three 10. There is some parking shown in the watermain easement on the east side of the property. The Developers should be required to sign an agreement stating the parking will be replaced at their expense if the watermain needs to be excavated in this area.
