Request
Consider a request by Camas Minnesota (Shiely Masonry) for a conditional
use permit for the construction of a masonry block manufacturing plant.

Overview
The applicant is proposing to construct an additional block manufacturing
plant and a minor expansion on the existing plant to house blowers to cure
concrete blocks. The site is located next to the Plaisted gravel facility on .
County Road 33 just west of Highway 169.
Buildings
The proposed expansion will be located on the east side of the existing
building and is needed to enclosed the new curing system that is being
installed. It will measure approximately 25 feet by 190 feet (4750 sf.).

. The new plant will be located to the north or rear of the existing facility and
will measure approximately 220 feet by 185 feet ( 40,700 sf.). The building
will be used for the manufacturing and storage of concrete blocks. The new
plant will be connected, but will not abut, the existing plant
The exterior of the existing building will be upgraded; it will be repaired and
tinted to give it a color and texture similar to the Plaisted building to the
east. The exterior of the addition and the new building will match the
upgraded exterior of the existing building.
The new aggregate bins that will provide aggregate for the new building will
be enclosed and have garage doors on the front.
Site improvements
The applicant is proposing the following site improvements:
• Additional driveway
They are proposing to construct a second access from County Road 35. They
currently have a driveway at the east end of their property. This second
driveway will be located near the west end of the property and shall have a
• maximum width of 36 feet. It will provide access to the aggregate bins which
supply aggregate to the new building. The applicant should verify the vertical
curve of County Road 33 for sight distance for the proposed driveway; sight
distance to the west may be a problem. The proposed second driveway will
also require a permit from Sherburne County. The site plan has been
forwarded to the County Engineer for his review and comments; any
comments or concerns will have to be addressed in the site plan.
• Paving
The applicant is proposing to pave the existing east driveway and provide
curb and gutter. There is an internal driveway that connects with Plaisted's
facility to the east. The paving and curbing will tie in with the improvements
that were part of the recently approved conditional use permit for the
expansion of the Plaisted facility. Internal paving includes paving the area
from the existing drive back to the paved area currently used for employee
parking.
The proposed second driveway will also be paved and include curb and
gutter. It will be paved back to the area that will be used by dump trucks as a
turn around when delivering aggregate.

• The applicant would like to be able to phase completion of the paving
improvements over a two year period. They would complete the curbing and
paving of the entrances this year and complete the paving of the interior
areas next year.
• Landscaping
The applicant is proposing to plant 25 evergreen trees between the existing
building and County Road 35. They are also planning on cleaning up the site
by removing the existing debris and equipment that is currently found in the
area between the road and the buildings, and stabilizing the drainage area
along the road. There is a 50 foot electrical easement along County Road 33;
all trees should be kept out of that easement. The applicant will have to •
provide a landscaping plan for review and approval.
Drainage
The site appears to drain away from the road towards the interior of the site.
The applicant should provide drainage information for review and approval
by the City Engineer.
County Road 33 currently has a 33 foot half right-of-way. Future
• improvements to the road will likely include expanding the half right-of-way
by 17 feet to 50 feet. Site improvements should take into consideration the
17 feet needed for the expansion of the right-of-way and the required 10 foot
setback from the front property line.
Recommendation
It is recommended that the Planning Commission recommend approval of
Shiely Masonry's request for a conditional use permit for the expansion on an
existing block manufacturing building and the construction of a second block
plant with the following conditions.
1. A landscaping plan be provided for review and approval.
2. The east entrance be paved provided with curb and gutter. The curb and
gutter should be continued back to a line that is parallel to the front of the
existing building and include the connection with the Plaisted facility. The
paving should be extended so that it connects with the paved area currently
used as employee parking and the include the area around the aggregate bins
in the southeast corner of the site.

3. The proposed west entrance should be paved and include curb and gutter.
• The improvements will be extended back to a line that is parallel to the front
of the building.
4. The exterior of the proposed expansion of the existing building and the
proposed new block production building will match the exterior of the
existing building.
5. County approval shall be obtained prior to beginning construction on the
proposed western driveway. All concerns and comments of the County
Engineer shall be addressed on the site plan.
6. All comments and concerns outlined in the City Engineer's letter shall be
addressed.
7. Completion of the paving and curbing shall be done in two phases. The
entrances shall be completed by November 1, 1997 and the remainder of the
interior area shall be completed by November 1, 1998.
8. Sight distance and visibility from the proposed driveway to the west shall
be check and verified to ensure that no visibility problems exist.

Dear Mr. Rohlf;
This letter is written on behalf of Elk River Landfill, Inc., ("ERL"), the owner
and operator of Elk River Landfill (the "Landfill") within the City of Elk River
(the "City"). The purpose of this letter is to present current phase plans for
the Landfill and a Long Term Development Plan for the City's review. We
understand from you that construction of the next phase of disposal cells
requires City approval. We also request the City grant that approval. To the
• extent you deem it necessary, we request the City amend its license and/or
conditional use permit to incorporate specific plans for the development of
future cells. It's important to recognize that development continues to occur
as was contemplated when the CUP and license were first issued in 1988.
This is simply the next phase of the original overall development plan.
The Minnesota Pollution Control Agency ("MPCA") recently issued the public
notice for the draft re-issued MPCA permit which addresses development of
the new disposal Cells 12 through 18 in the Landfill. In particular, the MPCA
permit now specifically allows construction of Cells 12 and 13, with a
provision for allowing additional cells to be constructed as necessary. Cell
12 must be constructed this year in order to provide necessary disposal
airspace and operating area. Detailed construction plans and specifications
will be submitted to City staff for review and approval within the next two
weeks.
The City's current license authorizes operation of the Landfill consistent with
the authority described in Minnesota Pollution Control Agency's solid waste
permit no. 74 (the "MPCA Permit"). ERL has requested reissuance of the
MPCA Permit. The MPCA has advised it intends to reissue the MPCA Permit
with modifications to accommodate construction of Cells 12 and 13.

The CUP and License both incorporate operating plans of the MPCA Permit.
Our interpretation of this provision is that the CUP and license authorize the
Landfill to be conducted according to plans approved by MPCA without the
need for further approval by the City each time MPCA makes a modification
to its permit. Nevertheless, the City has requested ERL obtain approval from
the City for the development. The MPCA Permit, when it is reissued, will
authorize construction of Cells 12 and 13 immediately. Cells 12 and 13 are
part of the natural progression of the development of the Landfill as
contemplated when the City's approvals were first granted in 1988.
ERL has requested that MPCA review and approve a plan for increasing side
slopes at the Landfill from 20 percent grades to 33 percent grades, in order
to accommodate the original permitted capacity for the facility. By
compromise with MPCA staff, waste deposit dimensions at the Landfill will
not be increased, rather the difference between the original capacity and the
capacity which can be currently developed will be banked for future
• consideration. Accordingly, the Landfill height will not be increased beyond
that which ERL contemplated in its original development plan. The maximum
height at the Landfill will be 1 170 feet which is the maximum height that
would be able to be effectively utilized at the 20% side slopes. City staff
has raised concerns about the final elevation of the Landfill. We are prepared
to address those concerns now or at such time as filling dictates the need to
address final elevation issues. ERL is confident it can demonstrate there are
no health, safety and welfare issues presented by developing the Landfill to
its full capacity reaching the 1 170 elevation and that this elevation is
consistent with original development plans. We are, however, prepared to
discuss alternative development plans if the City so chooses.
We enclose the following plans:
• Long-Term Development Plan (18 sets)
• Map of Site location (18 sets)
• Map of Operations at the site (18 sets)
• List of adjacent land owners (1 set)
Please schedule this matter for appropriate City review at your earliest
convenience. We understand the next Planning Commission meeting is April
• 22, 1997 and the subsequent City Council meeting is May 19, 1997. In
order to meet our construction schedule we respectfully request to be placed
•
on the agendas for these meetings. We are prepared to make a presentation
at the April 22 Planning Commission meeting if appropriate.
