Please consider a request by the applicant for a conditional use permit
amendment to allow a temporary storage building.

Overview
In October 1994, the applicant was granted a conditional use permit for a
mineral excavation operation (CU 94-32). The applicant is subject to yearly
inspections and licensing of the operation. As part of the conditional use
permit, a reclamation plan has been submitted with yearly reclamation
required.

• The applicant is wants to amend the conditional use permit to allow a
temporary building to be used for the processing and storage of special soils
and vehicle storage. The building is being considered as a temporary
building, as it lies within the reclamation area and in close proximity to a
possible county road connection between Brook Road and County Road
No. 33.
Building Location
The location of the building was chosen because it is in a low area, out of the
wind and generally screened from adjacent properties by existing vegetation.
Two residences to the north will have an unobstructed view of the building.
The Ronallo residence is roughly 700 feet to the and the Lemmon residence is
roughly 1000 feet to the north.
Due to the temporary nature of the building and the distance from
neighboring residences, staff is not recommending any screening of the
building from the north.
County Engineer Comments
• The County Engineer, Dave Schwarting was asked to comment on the
location of the proposed because of the proximity to a possible County Road
connection between Brook Road and County Road No. 33. The County
Engineer expressed no concern regarding the proposed location because the
building is temporary and the road being a only a long term possibility.
Building Department
The Building Department has concerns with the building proposal in regards
to ventilation, irrigation, restrooms and septic, and access to the building.
Approval will be contingent on the building meeting the Uniform Building
Code and the concerns of the Building Department (See attached letter from
Cliff Skogstad).
Architectural Standards
The Elk River City Ordinance requires 25% of the exterior building be
finished with approved or comparable exterior building finishes. The
proposed pole building would be an exception to the rule due to its temporary
nature and proposed location.

• Recommendation
Staff recommends that the Planning Commission recommend approval of a
conditional use permit amendment to allow a temporary storage building
with the following conditions:
1. THAT THE BUILDING CONFORM TO THE UNIFORM BUILDING CODE AND
THE CONCERNS OF THE ELK RIVER BUILDING AND ZONING
DEPARTMENT.
2. THAT THE BUILDING BE ACCESSIBLE BY EMERGENCY VEHICLES AND
CONSTRUCTED TO SPECIFICATIONS RECOMMENDED BY THE CITY
ENGINEER.ALSO,THAT THE ACCESS BE SHOWN ON THE SITE PLAN
3. THAT THE BUILDING BE LIMITED TO THE PROCESSING AND STORAGE OF
SOILS AND VEHICLE STORAGE.
4. THAT THE BUILDING BE CONSIDERED TEMPORARY AND CAN BE
REMOVED FOR RECLAMATION OR ROAD CONSTRUCTION PURPOSES
ONCE THE MINERAL EXCAVATION HAS CEASED.

Dear Mr. Weicht:
As per the review of the plans you submitted to me, my concerns that will need to be
addressed prior to submittal of the final plans are as follows:
1. State plumbing code does not allow the floor drain in a commercial establishment
to be run to daylight and because of equipment being stored in this building, all
floor drains shall go to a flammable waste trap.
2. Mechanicals will be a concern since we will be dealing with a combustible
product and because this product is a dry substance airborne combustibles will be
a concern as to how they will be eliminated, such as a bagger or exhausting, etc.
3. Heating will also be a concern because of the airborne product.
4. Even through this building will be there for a minimum of 20 years, a unisex
bathroom should be installed because of employees working there for bagging the
product.
5. Provide information as to the storage of all products in this building. If this peat
will be stored outside or inside bagged or stockpiled.
6. A structural engineer will be required to sign off on this building.
7. A mechanical engineer will be required for all mechanics.

• 8. If a bathroom is required, a septic system and design will be required with the
plans submitted.
