Location 13324 Ranch Road IIZoning/Land Use Rla(Single Family Residential)/LR(Low Density Residential) Attachments • Location map • Site plan • Letter from applicant • Survey of property Overview The applicant is requesting a conditional use permit to operate his landscaping business from his home. The property is located on the south side of County Road 1,just west of the intersection of County Roads 1 and 33. The site is 2.67 acres and contains the applicant's house and a 40' X 50' pole building. The house and pole building are located near the rear of the lot. Approximately half of the lot is encumbered with a 240 foot wide NSP easement across the center portion of the lot. There is a neighbor directly adjacent to the east and a house located across County Road 33 that will have a clear view of the IDproperty and the area to be utilized for the landscaping business. There is an existing row of evergreens planted along the east property line. The pole building will be used for storage of equipment. An outdoor storage area is proposed along the east side of the pole building. Any outdoor storage of materials would have to be completely screen from adjacent properties and the street. A stockade fence, along with landscaping, could be use to screen the proposed storage area. All equipment will have to be stored within the pole building. All outdoor storage should comply with the setback requirements for accessory structures. The area between the house and the street is proposed to be used as growing area for ornamental and shade trees. The applicant should check with NSP to see what type of restrictions are involved with planting trees within their easement. The applicant has indicated that some of the trees planted in the growing areas will be left to mature and provide a screen. The applicant has also indicated he would like to conduct retail sales from May 1st to July 1st. Retail sales are not usually associated with home occupations unless they are clearly incidental to the services provided in the dwelling. An example of typical retail sales is the sale of a line of shampoo and hair treatments incidental to a home hair salon. • The applicant is also proposing an 16 square foot freestanding sign. The ordinance allows only a 2 square foot wall sign. The proposed freestanding will not be allowed. Recommendation The Rla zoning district is intended to be primarily a rural residential district but may also include agricultural related uses. A landscaping business as a home occupation could be considered an agricultural related use, especially if most of the site will be used for the growing of nursery stock. Staff has some concern with allowing retail sales. Any outdoor storage of materials and supplies will have to be in an enclosed area and no outdoor storage of equipment should be allowed. Staff is recommending the Planning Commission recommend approval of the request for a conditional use permit to allow a landscaping business as a home occupation with the following conditions: 1. All outdoor storage of materials and supplies shall be within an enclosed area so that it is not visible from the street or adjacent properties. 2. The enclosure shall consist of a stockade fence and shall also include landscaping as approved by staff. 3. No retail sales shall be allowed. 5. Signage shall be limited to a wall sign no larger than 2 square feet. 6. All equipment shall be stored within the pole building. 7.
