III Overview The applicant has submitted revised grading plans which address the City Engineer's comments. Also attached for your reference is the staff report from the February Planning Commission meeting. Most of the comments voiced at the February public hearing were regarding the traffic situation on Auburn Street. There were also several comments on the need to preserve trees. The application was postponed at last months meeting to allow the applicant an opportunity to address issues raised at that meeting and to allow time to send out public hearing notices. The County supplied an updated property owners list and notices were sent out to all the names on that list. Recommendation It is recommended the Planning Commission recommend approval of the rezoning request from Rle (Single Family Residential) to a PUD (Planned Unit Development) based on the following findings: III 1. It is recommended the Commission recommend approval of the conditional use permit and the preliminary plat with the following conditions: 1. A DEVELOPERS AGREEMENT BE PREPARED OUTLINING THE TERMS AND CONDITIONS OF THE PLAT APPROVAL AND INSTALLATION OF IMPROVEMENTS BE PREPARED AND EXECUTERD PRIOR TO RELEASING THE PLAT FOR RECORDING. 2. A PLANNED UNIT DEVELOPMENT AGREEMENT IS PREPARED AND EXECUTED PRIOR TO RELEASING THE PLAT FOR RECORDING. 3. A LETTER OF CREDIT BE PROVIDED TO THE CITY IN THE AMOUNT OF 100% OF THE COSTS OF PUBLIC IMPROVEMENTS. 4. UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING THEM ACCEPTED BY THE CITY, A WARRANTY BOND IN THE AMOUNT OF 25% OF THE IMPROVEMENT COSTS SHALL BE SUBMITTED TO THE CITY FOR A ONE YEAR PERIOD. 5. Box 490 13065 Orono Parkway Elk River, MN 55330 RE: HILLSIDE ESTATES NINTH ADDITION Dear Planning Commission Members: Since last month's Planning Commission meeting when the commission reviewed the HillSide Ninth Addition, we have had a chance to meet with the developer and his engineer to discuss IDchanges to the grading plan. The revised grading plan is included in this month's planning commission packet. It reflects a much more realistic plan of what needs to be graded initially and what grading can be left to the discretion of the homebuilder, depending upon the size and style of home to be constructed on the lot. Most of the deficiencies that we noted with the grading plan presented at last month's meeting have been changed. Most notably, the house pads at the north end of the plat that were below grade have been raised and the house pads in the southeast corner of the plat that appeared to be too high and have steep driveways have been adjusted. The developer has also adjusted the grade on 193rd Avenue providing for landing areas for the intersecting street. The current grading plan shows a heavy line indicating the approximate mass grading limits. We would suggest that in four areas these be expanded to a somewhat larger area. We make this suggestion because in these areas there is cross lot drainage that needs to be established prior to any homes being constructed. The areas in question would be in phase 2 Lot 16 and 17, phase 3 Lots 3 and 4 and phase 4 Lots 25 and 26 and 29 through 33. With those minor adjustments to the mass grading limits, we would recommend approval of the revised grading plan. Because of the effort to minimize the removal of vegetation, there are still a number of areas where cross lot drainage does not specifically follow lot lines, therefore, would not be within normal drainage and utility easements required on the plat. As of this date, we have not seen any revised drainage calculation. The one change that has been made is the water main is now shown to looped between phases 1 and 4. However, the other cul-de-sacs referenced in our previous letter are not shown to be looped at this time.
