Location 193rd Avenue and Zane Street, north of Deerfield 3rd Addition Zoning/Land Use Rle (Single Family Residential) /MR (Medium Density Residential) Attachments • Location map • Preliminary plat • Minutes from Park and Recreation Commission meeting • Memo from City Engineer Overview The proposed planned unit development and preliminary plat is an extension of the Hillside Estates development along 193rd. The proposed plan includes • plating 43 acres into 61 single family lots and the extension of 193rd to the eastern limits of the plat. 13065 Orono Parkway • P.O. Box 490 • Elk River, MN 55330 • TDD & Phone: (612) 441-7420 • Fax: (612) 441-7425 Memo to Planning Commission/P 98-5 February 23, 1999 Page 2 • Since the Commission reviewed this plat on January 26th the applicant has submitted revised grading, drainage and utility plans which the City Engineer is currently reviewing. The layout of the plat has not been changed. Wetlands The applicant is working with the City on resolving wetland issues. There is a wetland that will impact the development of Lots 17 and 18, Block 4. Options to address that issue include adjusting the lot lines or filling the wetland. There is also a wetland located in the proposed right-of-way for 193rd Avenue that will have to be filled. Streets At the last meeting the Commission discussed the proposed median on 193rd and the islands in the eyebrow cul de sac. The applicant will be working with staff on appropriate landscaping. At the public hearing residents on Auburn Street expressed concerns about existing traffic on Auburn Street and increases generated by this proposed development. Increases in traffic on Auburn Street generated by this development is likely to be minimal. Most traffic generated by this plat would go directly to 193rd . Some traffic generated by the lots on the northern cul de sac may go out to Auburn. Lots The lots in this plat range in size from about 14,000 square feet to 49,000 square feet with an average lot size of 20,779 square feet. Some of the lot lines should be adjusted so they better line up and eliminate odd corners. The property within the NSP easement will be platted as outlots and will contain a drainage pond and trail corridor. Most of the gas line easement on the east boundary of the plat will also be an outlot and will contain a trail corridor. Three of the lots fronting 193rd will actually have direct access from 193rd. The remaining 7 lots will have access from the eyebrow cul de sacs. Lot 11, Block 1 should be oriented so that access is from the side street and not 193rd. Lot 5, Block 1 will need it's west lot line adjusted so it can have access from the cul de sac. 1.,1ere are 6 lots with double frontage and 3 lots with triple frontage. A landscaped easement on 193rd should be provided for those double and triple frontage lots. It appears from the grading plan that a 50' to 120' wide strip of existing trees will be maintained along the north side of 193rd except for a • small area at the northeast corner of the cul de sac and 193rd. Park and Recreation Corridors for trails be maintained within the within the NSP easement and the Northern Natural Gas easement on the east boundary of the plat. The applicant will be responsible for construction of the trails. A sidewalk is proposed for the north side of 193rd Grading, Drainage and Utilities The City Engineer will address grading, drainage and utility issues in his memo. I would like to point out the developer is proposing an unusual location for a drainage pond; he is proposing to construct a drainage pond in the right-of-way for 193rd at the east boundary of the plat. It might become an issue when the time comes to put in a street and the residents loose what they thought was a pond. An alternative, as presented by Commissioner Kuester, would be to locate the pond in a place where future lots are proposed. When the pond is no longer needed it could be filled and houses constructed. • Rezoning For this project to proceed as proposed, the applicant is also requesting a rezoning from Rle (Single Family Residential) to a PUD (Planned Unit Development). The PUD allows for more flexibility is design of streets and lots. All the lots will meet the minimum dimensional requirements of the original zoning district (R1e). The PUD also allows for a comprehensive review of the project. Recommendation It is recommended the Planning Commission recommend approval of the rezoning request from Rle (Single Family Residential) to a PUD (Planned Unit Development) based on the following findings: 1. A PLANNED UNIT DEVELOPMENT ALLOWS A COMPREHENSIVE REVIEW OF DEVELOPING THE PROPERTY. 2. THE PROPOSED REZONING WILL BE CONSISTENT WITH THE CITY'S COMPREHENSIVE PLAN. • 3. A PLANNED UNIT DEVELOPMENT ALLOWS FOR FLEXIBILITY IN SUBDIVISION DESIGN. s:\planning\scott\p98-5fpc.doc Memo to Planning Commission/P 98-5 February 23, 1999 Page 4 Staff has unresolved issues relating to grading, drainage and utilities. Should S the Commission recommend approval of the conditional use permit and the preliminary plat, the following conditions are suggested: 1. A DEVELOPERS AGREEMENT BE PREPARED OUTLINING THE TERMS AND CONDITIONS OF THE PLAT APPROVAL AND INSTALLATION OF IMPROVEMENTS BE PREPARED AND EXECUTERD PRIOR TO RELEASING THE PLAT FOR RECORDING. 2. A PLANNED UNIT DEVELOPMENT AGREEMENT IS PREPARED AND EXECUTED PRIOR TO RELEASING THE PLAT FOR RECORDING. 3. A LETTER OF CREDIT BE PROVIDED TO THE CITY IN THE AMOUNT OF 100% OF THE COSTS OF PUBLIC IMPROVEMENTS. 4. UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING THEM ACCEPTED BY THE CITY, A WARRANTY BOND IN THE AMOUNT OF 25% OF THE IMPROVEMENT COSTS SHALL BE SUBMITTED TO THE CITY FOR A ONE YEAR PERIOD. 5. SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY THE CITY AT THE TIME OF FINAL PLAT BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING WITH SHERBURNE COUNTY. 6. A SEALCOAT FEE IN THE AMOUNT TO BE DETERMINED BY THE CITY ENGINEER BE PAID TO THE CITY PRIOR TO RELEASING THE PLAT FOR RECORDING WITH SHERBURNE COUNTY. • 7. A GRADING AND EROSION CONTROL PLAN AND DEVELOPMENT PLAN BE SUBMITTED AND APPROVED BY THE CITY ENGINEER PRIOR TO THE ISSUANCE OF BUILDING PERMITS. 8. ALL GRADING WILL NEED TO BE CERTIFIED PRIOR TO ISSUANCE OF BUILDING PERMITS. 9. STREET LIGHTS SHALL BE INSTALLED AS RECOMMENDED BY ELK RIVER MUNICIPAL UTILITIES. 10. A LANDSCAPE PLAN, CLEARING AND TREE PROTECTION PLAN SHALL BE PROVIDED PRIOR TO FINAL PLAT. THE LANDSCAPE PLAN WILL INCLUDE LANDSCAPING ON THE CUL DE SAC ISLANDS AND THE MEDIAN ON 193RD AND REFORESTATION ALONG 193RD WHERE NEEDED. 11. AN EASEMENT BE DEDICATED FOR THE TEMPORARY CUL DE SAC. 12. ALL WETLANDS ON THE SITE SHALL BE IDENTIFIED AND DELINEATED AND ALL WETLAND PERMITS SHALL BE RECEIVED PRIOR TO COMMENCING ANY WORK IN A WETLAND. Neighborhood Meeting to Discuss Meadow Park-7:00-7:30 p.m. Steve Wensman reviewed the concept plan endorsed by the Park & Recreation Commission for Meadow Park which is located on 2^d Street, east of Evans Avenue. The plan includes a sliding hill,swing set, area for skating, planting of overstory frees on the boulevard, and ornamental trees and shrubs within the park. The residents to the south of the park expressed concern that the play structure would be too close to their home and asked if the property line could be fenced. They also expressed concern that the trees be saved. Steve indicated that tight hedging has been proposed as a natural buffer. It was the consensus of the Commissioners that if the play area became heavily used and created a problem, fencing could be considered. The residents in attendance expressed their support for the concept. Chair Anderson noted that there are no funds to develop the park at this time. "--?*. 7.b. Hillside Estates 8th and 9th Addition Park Dedication Steve Wensman indicated that he and Scott Harlicker met with Rick Foster regarding the park dedication requirements recommended by the Commission for Hillside Estates 8th and 9th Additions. He stated that Mr. Foster's revised plans for Hillside 9th have included the recommendations, but he was not able to • incorporate a flat, 4-5 acre park site in the Hillside 8th plans requested by the • Commission. Rick Foster, developer, indicated that when he purchased the property 7 years ago, the Master Park Plan did not identify any large parks for this areo. When the plan was updated, there were no changes for the area. A year ago when he began moving forward with his plans, Steve Ach asked him to meet with the Park & Rec Commission,which he did. At that time, the Commission recommended a park area the size of 1-2 lots, a trail corridor to go through the NSP power line, extending to the north side of Menards and over to the south side of 197th and tie into the sidewalk. At that time, he stated he would provide whatever easements were needed to weave the trail through the trees so it would not be necessary to cut down any trees. Mr. Foster stated that it is not possible to meet Commission's recent request for a 4-5 acre flat piece of property for park adjacent to the powerline and c road because the property is densely wooded and hilly. Mr. Foster explained it would cost approximately$250,000 to cut down trees and level out a 4-5 acre park area. He reviewed the trail corridors, connections and areas where the ponds would impact the trail routes. Commissioner Huberty questioned whether or not the ponds would freeze over in the winter for skating. Mr. Foster stated that they would, but he felt the pond south of Menards parking lot would be better for skating. He noted that if it were used for skating, it should be included under the city's insurance liability. The Park & Recreation Commissioners concurred that size of the recommended • open space area is needed to serve the density of the Hillside Estates area. Chair Anderson reviewed the recommendations of the Commission for the 8th addition. Park & Recreation Commission Minutes September 9, 1998 Poge 3 Mr. Foster agreed to provide the power line easement for a trail but he • requested that he be allowed to infringe into the easement where necessary to obtain the required lot depths. Mr. Foster indiccted that he would provide the necessary easements to run the trail around the pond in the Zane Court area. Discussion followed regarding different areas within the 8th Addition plat where a 4-5 acre park site might be created. Commissioners Huberty and Kuester expressed suppc-� for obtaining a site, leaving it wooded for now, with it's future use to be determ d at a later date. Mr. Foster suggested that the Commission use the dark dedication fees to purchase property to the southeast for the type of park they are looking for. Discussion followed regarding a park site in the northwest portion of the plat (Lots 1-13, Block 3, and Lots 18 & 19, Block l area). Chair Anderson indicated that the goal is to serve the entire Hillside Estates area. Commissioner Kuester noted that they would like the 75' powerline corridor preserved. COMMISSIONER WESTRUM MOVED TO RECOMMEND THE FOLLOWING PARK DEDICATION REQUIREMENTS FOR HILLSIDE 8TH ADDITION: - THE DEVELOPER WORK WITH STAFF TO LOCATE A 4-5 ACRE PARK SITE IN THE NORTHWEST PORTION OF THE PLAT. - THE DEVELOPER ALLOW A MINIMUM 75' WIDE EASEMENT FOR A TRAIL (WITH AN 8 PERCENT MAXIMUM SLOPE) TO WIND THROUGH THE NSP POWERLINE CORRIDOR AND AROUND THE PONDS. COMMISSIONER ANDERSON SECONDED THE MOTION. Mountain Biking Trails Proaress a. Update on Trail Buildina Seminar- Steve Wensman Steve Wensman stated that the information he learned at the trail building seminar will be very helpful for mountain biking trails in Hillside Park. The three plan sheets consisted of a street and boulevard site grading • drainage plan, and preliminary utility plan. All three plans were prepared by Charles grading W. Plowe Consulting Engineer and were dated February 4, 1999. Based on our review, we would offer the following comments: A. GRADING PLAN • The developer indicated by submitting a street and boulevard-grading ran, that it would be his desire to only grade these areas an1/41 to leave the actual iot g-ading until the time of house construction to preserve trees on the lots. The dev.loper has indicated custom homes will be built in this area and it is difficult to anti:ipate the specific trees to be removed for each specific house. However, the overall-grading plan would indicate that nearly all of the lots would have grading through the house pad and some even beyond the house pad. This will not allow much opportunity, if any, to preserve trees from the street to the rear of the house pad. Because there is anticipated to be significant grading on many of the lots, we would recommend that the developer would be required to at least grade a small pad into each of he lots. It has been our experience that when the house pads require significant grading and the developer does not do this, it is very difficult to get the home builder :o do this work, Most homebuilders attempt to balance the dirt on the lot when constructing a home and do not want to export or import additional fill material. If the lots are not graded properly before the home construction, the builders typically want to adjust the development plan grades. This approach to home construction leads to many difficulties for the building department. • T.;ere are numerous homes along the northern tier of the development that :appear to • have garage elevations below the street grade. We would recommend that these be reviewed and either the street raised or the house pads lower to lessen the grade of the 7riveways. • There are a significant number of areas in this grading plan where drainage from one lot to another will not follow the lot lines and it will, therefore, not be within the normal drainage and utility easements. This is often the case where trees are to be saved and existing topography is not to be disturbed. We would recommend, however, wherever there is proposed grading, attempts be made to keep rear anc side yard drainage within the described easements. Where this is not possible, additional drainage and utility easements will be necessary to provide for drainage not along lot lines. • Along the south plat line, there are a couple of low areas and additional drainage issues that need to have more information provided to determine the effects on Deerfield Third Addition located immediately to the south. • A number of the intersecting streets and cul-de-sacs along 193td Avenuewhich is the southerly east-west street, have relatively steep approach grades with little or no landing area provided. Ultimately, 193`d Avenue will carry a significant amount of traffic. All intersecting streets should be provided with some type of landing for vehicles coming to a stop condition. DRAINAGE ISSUES • • The drainage calculations that were submitted seem to be somewhat in adequate. The drainage area that flows to the northeast pond in Outlot C needs to be modeled as if there is no outlet. There is a 12-inch pipe shown as an outlet to the north but that leads to another land locked pond. it is unclear whether or not there is an opportunity for water to flow from the north to the south. This drainage area and pond need to be modeled based on 100-year 24-hour storm verses a 10-day snow melt. The pond in the southeast corner of the plat is shown to be constructed within the City right-of-way. The first question here is this allowable? The reason the developer has shown it this way is it is a temporary pond and the only other option would be to dedicate two or three lots for a temporary pond and make them buildible when the pond can be eliminated. This, however, would require the clearing of all trees on those lots. The thought being that building the pond in the right-of-way does no damage to trees that could be saved because the right-of-way will need to be cleared anyhow. This pond also needs to modeled as a no outlet pond. There is a 10-inch outlet shown heading to the east. It is unclear where this flow would go to and how frequently this pond would discharge. We believe the pond should be modeled with no outlet. The drainage in the southwest corner of the plat flows to an existing wetlanc. partially on this property, but the majority falls within the Deerfield Third Additi:n. The Deer-field Third Addition constructed over 10 years ago discharges directly to this wetland, however, wetland laws have changed since that time. Hillside Es'ates 9th • -award R. The grading elan should be modified to show provisions that will be utilized during the grading and turf establishment phases of the project to prevent erosion. C. UTILITIES • The utility plan does not show looping of the water main in the cul-de-sac areas. According to Elk River Municipal Utility policy, all cul-de-sac water mains need to be looped. It appears that it will be relatively easy to loop the cul-de-sac in Phase Four to the street in Phase One along the storm sewer alignment and to loop the cul-de- sac in Phase Two with the easterly cul-de-sac in Phase Four, again, along the storm sewer alignment and through Outlet C where the pond is proposed. The cul-de-sac in the southeast corner in Phase Three could also be looped along the storm sewer alignment to 193'd Avenue. Using the same route as the proposed stern sewer for looping will minimize, if not totally eliminate, any tree removal due to water main looping. • Each of the sanitary sewer manholes in the cul-de-sacs could be pulled back slightly and terminated much closer to the center of the cul-de-sac. • The street design on 193`d Avenue proposes a median down the center of the street, We have discussed this issue with Phil Hals, Street Superintendent, arid he has indicated a willingness to be responsible for maintenance of these island areas. The City would not maintain the two island areas in the "eyebrow" cul-de-sacs along 193rd Avenue, The design of these should consider low maintenance type of construction. • The developer should be made to escrow monies for the utility extensions ;and street construction at the east end of 193`d Avenue where the temporary pending area is proposed. in the future, this pond can be eliminated and the storm sewer -un to the east ultimately outletting to the ditch system located east of the plat.
