Request
To amend the Elk River City Ordinance, Section 900.32, Requirements For
Vehicular and Pedestrian Circulation by deleting the requirement for
minimum distance between driveways.

Overview
The city ordinance requires a minimum driveway setback of 5 feet from a
side property line. This is in conflict with the regulations for a minimum
distance between driveways of 20 feet. The 5 foot setback is the more
sensible minimum as it more closely matches the driveway configuration
when a cul-de-sac is created.
Ordinance Amendment
The amendment will delete the words:
Minimum Distance Between Driveways. Twenty (20) feet, between
roadway edges measured along street curb line.
Recommendation
Staff recommends that the Planning Commission recommend approval of
Ordinance 99-4 to amend the Elk River Ordinance, section 900.32, deleting
IIIthe minimum distance between driveways.

900.32 - REQUIREMENTS FOR VEHICULAR AND PEDESTRIAN CIRCULATION
1. Traffic and Circulation. All commercial and industrial
buildings or structures and their accessory uses shall be
accessible to and from nearby public streets and sidewalks by
driveways and walkways properly drained and paved with a hard,
all-weather, durable, dust-free material.
Vehicular traffic generated by commercial and industrial uses
shall be channeled and controlled in a manner that will avoid
congestion on the public streets, traffic hazards, and excessive
traffic through residential areas, particularly truck traffic.
The adequacy of any proposed traffic circulation system to
accomplish these objectives shall be determined by the City
Administrator who may require such additional measures for
traffic control as he may deem necessary, including but not
limited to the following: directional signalization,
channelization, standby turn lanes, illumination, and storage
area and distribution facilities within the commercial site to
prevent backup of vehicles on public streets.
2. No area used by motor vehicles other than driveways serving
• as ingress and egress to a commercial or industrial site shall be
located within the public street right-of-way.

AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING
SECTION 900.32 OF THE CITY CODE OF ORDINANCES
CASE NO. OA 99-
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. Section 900.32(1) of the City of Elk River Code of Ordinances
shall be amended to read as follows:
