Overview
• Sands Companies is proposing to construct a 78 unit Country Inn and Suites
on property just north of the Perkins located at Elk Hills Drive and Highway
169. The project is located in the Elk River Retail Center Planned Unit
Development. The project also includes an amendment to the PUD to allow a
hotel as a conditional use and a replatting of the plat for Elk River Retail
Center.
The Elk River Retail Center was approved in 1994. The original plans
showed a class I restaurant (Perkins), 18,800 square feet of retail space and a
3,900 square foot automotive center.
PUD Amendment
The existing PUD agreement does not include hotel/motels as an allowed use.
Uses currently allowed are those listed as permitted, conditional and
accessory in the C2 (Office District) and as conditional uses retail shops and
stores, motor vehicle specialty shop, and class I restaurant.
The proposed hotel will have less of an impact on the neighborhood than the
• originally approved retail and automotive center regarding traffic. Traffic
generated by the retail use would be almost twice as much, 91 vs 55 peak
hour trips, than a motel. The 55 trips generated by the motel is based on full
occupancy. When the traffic generated by the automotive center is included,
the uses in the original plan generated more than twice as many peak hour
trips.
Preliminary plat
The preliminary plat for Elk River Retail Center No. 2 involves replatting 3
lots from Elk River Retail Center into two lots. The largest lot (133,818
square feet) is located on the north end of the site and will accommodate the
hotel. The smaller lot (61,617) is located between Perkins and the motel site
and is likely to accommodate an office use.
There is an existing drainage and utility easement from the original plat that
crosses through the middle of proposed lot 2. This easement will need to be
vacated. This item is scheduled to be considered by the City Council when
they review this preliminary plat application.
Access to the plat is provided by two driveways off of Dodge Street. One
. driveway has been constructed and is currently used by Perkins. The second

driveway will be located at the north end of the site. Both driveways are in
• the same location as shown on the approved concept plans.
Typically, even though there are usually cross access easements for projects
such as this, each lot has to provide enough parking to meet the parking
requirements for the use located on that lot. In this case the overall parking
requirements for the motel and a possible office are met. However, the
parking for the motel actually extends on to the lot for the office. It is
suggested the lot lines be adjusted so the parking required for the hotel is
actually located on that lot.
In the attached memo from the City Engineer are comment regarding
easements, the grading and drainage and utility plan.
Site Plan
The proposed site plan includes a 78 unit hotel located in the northwest
corner of the site, adjacent to Highway 169. A building pad for a 10,000
square foot office building is also shown. The office building is not included as
part of this application; however, the parking for both buildings will be
installed as part this project.
• The hotel location in the northwest corner of the site is in the least obtrusive
location for the residences on the east side of Dodge. It is in the same
approximate location as the retail strip center included in the original plans.
The hotel will be three stories high with the entrance facing south. Because
of the way the building is oriented, the sides facing Highway 169 and Dodge
Street are blank walls. To give some relief from the blank walls windows
should be included on the east and west ends of the building. The hotel's
exterior will be light brown steel siding with a dark green roof and red
shutters around the windows.
The site plan shows area for a possible 30 unit expansion. This will require
additional parking. All additional parking needed for the proposed expansion
will have to comply with setback requirements in effect at the time the
expansion is constructed.
Parking and Access
The parking requirements for the hotel and the office is 118 spaces. The
proposed plan has 133 parking spaces. Additional parking will have to be
installed to meet the parking requirement for the proposed hotel expansion.
The site has 2 internal connections to the Perkins lot, one behind the office
building and one along Highway 169. Access from Dodge will be provided

with two driveways, one is a shared driveway with Perkins and the other is
• at the north end, just east of the hotel. Both driveways are in the same
location as shown on the original development plans. Lighting will be
provided with poles similar to those on the Perkins site. They will be 30 feet
tall with downward throwing lights.
Landscaping
The lot perimeter of the Country Inn and Suites is 1,396 feet. City Zoning
Ordinance requires 35 trees; 18 overstory, 9 coniferous and 9 ornamental.
The existing trees on the berm shall not count towards the tree requirement.
The site plan is deficient 3 overstory, 1 ornamental and 4 evergreens.
Because of work being done on the berm, the developer plans on removing 7
existing trees and replace them with 15 new trees. The site plan shows 14
new trees on the berm; 3 overstory, 2 ornamental and 9 evergreen.
Of the species of trees listed in the landscape key Sugar Maples generally do
not do well in urban situations with heat, drought and compaction.
Another concern with the landscape plan is the location of ornamentals in the
parking lot. Overstory trees would provide better shade on the parking lot

than ornamentals. Similarly, 2 ornamentals located on the Northwest of the
building and the 2 ornamentals located to the East of the future addition
should be overstory trees to break up the view of the blank walls of the
building and provide shade.
The remainder of the trees appear to be located with a 20 foot area North of
the building to be used for a future City pedestrian access. The trees should
be located to the South of that zone. Trees in this area could also impact the
water main and sanitary sewer.
Signage
The applicant is proposing a 30 foot high pylon sign along Highway 169. The
PUD agreement allowed a 20 foot high monument sign for the development.
The hotel sign would be considered the development sign. The grade at the
base of the sign is approximately 14 feet above the grade of Highway 169. A
30 foot high pylon sign would place the sign 44 feet above the road. For a
comparison:
• Elk Park Center is 30 feet high, 17feet wide and advertises the center and
2 major tenants;

• Hillside Crossing Retail Center is 25 feet high, 16 feet wide and advertises
• the center and 2 major tenants;
• Hillside Crossing is 24 feet high14.5 feet wide and advertises the major
tenant 2 other tenants;
• Hillside Crossing II is 27 feet high, the Menards sign is 34 feet wide and
the remainder of the sign is 16 feet wide, advertises the major tenant and
has room for 3 other tenants.
Staff is recommending the proposed freestanding sign comply with the
original PUD agreement which allowed a monument sign 20 feet high and 15
feet wide.
Wall signage is also proposed and will consist of 2 wall signs, one on the
south side and one on the west side. The PUD agreement allows one wall sign
for each freestanding site and limits size to 10 % of the wall face. The
proposed sign facing Highway 169 is approximately 129 square feet and the
sign facing south is 70 square feet. All signs will require a sign permit. Staff
can support the proposed wall signs
Recommendation
PUD Amendment
IIIIt is recommended the Planning Commission recommend approval of the
proposed PUD amendment to allow hotel/motels as a conditional use in the
Elk River Retail Center.
Preliminary Plat
It is recommended the Planning Commission recommend approval of the
preliminary plat request for Elk River Retail Center No. 2 with the following
conditions:
1. The lot lines be adjusted so the parking needed for the motel is
constructed on Lot 1.
2. A 20 foot easement along the north property line of Lot 1 be dedicated to
allow construction of a pedestrian pathway.
3. An amended Planned Unit Development agreement be signed and
recorded prior to recording the plat
4. All comments in the City Engineer's memo dated 7/22/98 be incorporated
• into the plat.

• 5. Cross access parking agreement be prepared and reviewed by the city
prior to releasing the plat for recording.
6. The drainage and utility easement extending through lot 2 be vacated
prior to recording the plat.
Conditional Use Permit
It is recommended the Planning Commission recommend approval of the
conditional use permit for County Inn and Suites for a 78 unit hotel with the
following conditions:
1. Windows be included on the west and east building elevations.
2. The freestanding sign comply with the original PUD agreement which
allowed a 20 foot high monument sign with a width of 15 feet. All signs
will require sign permits.
3. The landscape plan be revised to address the comments outlined in the
City Engineer's memo and the staff report.
• 4. All comments of the City Engineer's memo dated 7/22/98 be incorporated
into the plans.
5. All improvements to the parking lot for both the hotel and the office
building shall be constructed as part of this project.
6. All additional parking needed for the proposed expansion will have to
comply with setback requirements in effect at the time the expansion is
constructed

SITE PLAN REVIEW
Dear Mr. Harlicker:
As requested, we have reviewed the Country Inn and Suites submittal. The information
submitted consisted of a certificate of survey, a preliminary plat, a preliminary utilities
• plan, and a preliminary grading, drainage and erosion control plan. These were all
prepared by Otto and Associates, and dated June 29, 1998. The submittal also
contained a site/landscaping plan prepared by Hagemeister and Mack Architects, inc.
Based on our review, comments received at the staff review meeting, and a meeting
held with the developers, we offer the following comments.
A. Preliminary Plat
• The preliminary plat for Elk River Retail Center no. 2 consists of replatting three
lots from Elk River Retail Center into two lots. The largest of these, at the north
end of the site, is proposed to accommodate the Country Inn and Suites, and the
smaller of the two, just north of Perkins and south of the proposed Country Inn
and Suites, is proposed for office-type use.
• There is an existing drainage and utility easement from the original plat that will
need to be vacated, since it now crosses the middle of the proposed Lot 2.
There were no negative comments regarding the vacating of this easement at the
staff review meeting
• At the north end of Lot 1, there is an existing 40-foot wide drainage and utility
easement that runs from east to west. Currently there are sanitary sewer, water
main, and overhead electric contained within this easement. As you are aware,
the City is pursuing a pedestrian bridge crossing Trunk Highway 169 that will
land somewhere in the southwest corner of the Mn/DOT maintenance facility. It
would be appropriate to have the northern 20 feet of this 40-foot easement
•

rededicated on this plat to allow for the construction of the pedestrian pathway to
follow pedestrian traffic from the pedestrian bridge to Dodge Street.
■ The pond at the south side of Perkins that was built with the original development
of the plat will be part of Lot 1 for ownership purposes. Apparently there will be
an agreement where all three lots will participate in the cost of maintaining the
pond. Having Lot 1 owning the pond will ensure that the City does not end up
owning the pond and be responsible for routine maintenance such as grass
cutting and litter pick up. Currently, there is a drainage and utility easement over
the pond area, however the proposed plat of the Elk River Retail Center no. 2
does not clearly show this easement.
■ The site plan for lots 1 and 2 shows parking needed for the proposed motel on
Lot 1 being constructed on Lot 2, and the amount of parking on Lot 2 is well in
excess of what the proposed building would require. We question as to whether
or not it would be better to move the lot line between Lots 1 and 2 further to the
south so that more of the parking that's needed for the motel actually falls on the
lot that the motel is being constructed on. Typically, these types of developments
will have cross parking and access agreements, so that traffic can traverse any
of the lots and park where needed.
• B. Preliminary Utility Plan
■ The site is surrounded on three sides by sanitary sewer and water mains,
therefore there will be no sanitary sewer and water constructed to serve either of
the two lots. The layout is indicating an additional hydrant to be installed in the
southwest corner of the motel site. We will verify this location with fire chief,
since he was unavailable the day of the staff review meeting.
C. Preliminary Grading, Drainage, and Erosion Control Plan
• The grading plan indicates the lowering of the berm along the east side of Lots 1
and 2 by approximately 2 feet. As you will recall, this berm was established there
with the original plat as a means to screen the residential homes east of Dodge
Street from the development. We believe that it is unacceptable to lower the
height of this berm. If it is necessary to grade into the berm on the west side for
the development of these two lots, perhaps a retaining wall could be utilized to
maintain the overall height of the berm.
• At the southwest corner of Lot 2, a portion of the storm drainage will not be
picked up in the proposed catch basin, but rather will flow overland through the
Perkins site. Either an agreement should be obtained from the owner of the
Perkins site to allow this overland drainage or the grading plan should be
changed to pick up all of the overland drainage from Lots 1 and 2 prior to flowing
onto the Perkins site.

• There is an existing sidewalk at the very south end of Lot 2. This was a
requirement of the Perkins development, so that pedestrians walking to Perkins
would not have to walk in the driveway. The proposed grading plan for Lot 2
shows grades that would be incompatible with the existing sidewalk. The grading
plan should be revised in this area to accommodate the sidewalk after the
grading is completed.
• The grading plan shows in one location approximately 2 feet of fill at the property
line with Mn/DOT Trunk Highway 169 right-of-way. As you are aware, a fence
was recently installed along this right-of-way line. The developers will need to
obtain a Mn/DOT permit for any grading within the Mn/DOT right-of-way, and
they will also have to remove and reinstall the fence where their grading
operations disturb it.
• No drainage calculations have been supplied at this time. Drainage calculations
indicating how the storm water will be picked up from the site and conveyed to
the pond at the south end of the plat will need to be submitted, reviewed, and
approved.
D. Site Plan/ Landscape Plan
•
• ■ There is a significant amount of new landscaping shown along the north
boundary of the site in the existing drainage and utility easement. This will be
incompatible with the pedestrian trail that will need to be installed there, and
there is also question of whether or not this type of landscaping should be
allowed over the top of water main and sanitary sewer.
• The trash enclosure is also located within this drainage and utility easement. On
previous sites, this has been allowed if the owners are willing to provide the City
with a letter indicating that they will be responsible for removing the trash
enclosure, should work within the drainage and utility easement be necessary.
• There is a 30-foot high pilon sign shown along the Trunk Highway 169 corridor.
This sign is also located within the drainage and utility easement. It is unclear
where it is, relevant to the location of water main and sanitary sewer. If this sign
is to be allowed within the drainage and utility easement, it should be situated
such that the utilities within the easement can be excavated without disrupting
the sign.
• It appears that a portion of the building may fall within the drainage and utility
easement in the southwest corner. From the site plan, it is very close and the
overhangs of the building may actually encroach into the easement. If this is
true, the building will have to be slid slightly to the east.

the Subdivision as provided by this PUD Agreement:

3.) Uses - The uses allowed as permitted, conditional and accessory uses in the C-2,
Office District at the time of approval of the PUD (as shown on Exhibit H to this PUD
Agreement) shall be allowed as permitted, conditional and accessory uses within the Project.
The following uses shall also be allowed as conditional uses in the Project:
• Retail shops and stores
• Motor vehicle specialty shop
• Class I Restaurant
•
4.) Approval by City- City hereby approves the Project as shown in the attached
exhibits provided, however, that insofar as the exhibits vary from the written terms of this PUD
Agreement, the written terms shall govern. This approval is subject to individual site and
building plan review and approval as follows:
(a) Prior to the issuance of a building permit for any lot within the Project, both for
initial construction and for any subsequent expansion, exterior remodeling of a structure
or substantial revision of an approved site plan,the site plan for the proposed
development shall be reviewed and approved by the City through the Conditional Use
Permit process.
(b) Each site plan approval request shall be accompanied by such plans and
supporting materials as City staff shall require, and shall be reviewed by the Planning
Commission and City Council in a public hearing held thereon before approval.
(c) Site plan approval shall be granted only if the City Council finds that the proposed
site plan is consistent with the terms and conditions of the Conditional Use Permit for the
Project, this PUD Agreement, applicable City Ordinance requirements and all other legal
requirements. City reserves the right to refuse approval of an individual site plan if, in
the City Council's judgment, this condition is not met.
