The meeting was called to order at 7:30 p.m. by Mayor Hinkle. 2. Agenda Item 4~ - The East Main Street Project, Item 9~ - The Watermain Feasibility Study, Item 11 - Administrator's Update (C) Planning Commission Public Hearings, (D) Barthel Planned Unit Development, (E) The Audit Report, and (F) Prairie House; were items added to the June 18, 1984 City Council agenda. COUNCILMEMBER GUNKEL MOVED TO APPROVE THE JUNE 18, 1984 CITY COUNCIL AGENDA AS AMENDED. COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION PASSED 3-0. 3. Minutes of May 14 and June 4 City Council Meetings COUNCILMEMBER SCHULDT MOVED TO APPROVE THE MINUTES OF', THE MAY 14, 1984 CITY COUNCIL MEETING. COUNCILMEMBER GUNKEL SECONDED THE MOnON. THE MOTION PASSED 3,...0. COUNCILMEMBER GUNKEL MOVED TO APPROVE THE MINUTES OF THE JUNE 4, 1984 CITY COUNCIL MEETING. COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION PASSED 3,...0, 4. Open Mike Mr. Phil Hals, Street Superintenderit, presented the City Council with souvenirs from the old 101 brigde and indiqated to the City Council that he has taken delivery on the pickup truck from Cloverleaf Motors. 4~. Ron Black ,... Piwowar Property Mr. Ron Black indicated that at the April 23td City Council Meeting, the City Council authorized him to prepare an order for removal of the burned out house on Tipton Avenue owned by Mr. Piwowar. Mr. Black indicated that Mr. Piwowar did not respond to the action and therefore, it was placed on the court default calendar for consideration. Mr. Black indicated that Mr. Piwowar has now contacted Mr. Ron Black and they have worked out an agreement whereby Mr. Piwowar will have the building torn down by June 30 or the City Council can order the demolition of the building and bill the cost to Mr. Piwowar. Mr. Black indicated that Mr. Piwowar has agreed to pay the City $650.00 for costs incurred by the City in the process. Mr. Black indicated that Mr. Piwowar wants to salvage some of the lumber for use in a new building and for burning for heat. Mr. Ron Black indicated that the agreement states that the property should be kept neat and organized regarding the stored lumber and wood. Councilmember Schuldt indicated that more work has been done in the last week than the last year and wants the City to be sure that the building is down by June 30. Councilmember Engstrom indicated that he was glad the City Council took the action they did in purs~ing the demolition of the building. I r . City Council Minutes June 18, 1984 Page Two COUNCILMEMBER ENGSTROM MOVED TO AUTHORIZE THE CITY TO ENTER INTO THE AGREEMENT WITH MR. PIWOWAR REGARDING THE DEMoLITION OF THE BUILDING ON TIPTON AVENUE. COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION PASSED 3-0. 4~. Main Street Project The City Administrator indicated that the cost of the sidewalk would be the same whether it was placed on the north side of East Main Street or the south side of East Main Street. The City Administrator further indicated that Ms. Dee Kratzke, representative of the Guardian Angels Nursing Home, indicated that the Board did not have strong feelings either way with regard to the placement of the ./ sidewalk on the /~.orth side or the south side of East Main Street. The City Administrator indicated that if the sidewalk were placed on the north side of East Main Street, it would not allow for a sidewalk on the south side at any point in the future, whereby if it was placed on the south side, at SOme ppint in the future if necessary, a sidewalk could be placed on the north side by the removal of the utility poles. COUNCILMEMBER ENGSTROM MOVED TO AUTHORIZE THE SIDEWALK TO BE PLACED ON THE SOUTH SIDE OF EAST MAIN STREET. COUNCILMEMBER GUNKEL SECONDED THE MOTION, THE MOTION PASSED 4-0. 5. Dietz Zone Change and Conditional Use Permit - Public Hearing Councilmember Gunkel indicated that Mr. George Dietz is requesting a zone change and conditional use permit to allow him to construct a combination food and fuel convenience store, laundromat and four-stall car wash on his property located on Dodge Avenue. Councilmember Gunkel indicated that the Planning Commission reviewed Mr. Dietz's request for the zone change and conditional use permit and further indicated that at that meeting, there were three members absent and the Planning Commission did not hold a public hearing. The City Administrator indicated that the City Council had granted Mr. Dietz an administrative subdivision and that Mr. Dietz was requesting a zone change for Parcel A of that administrative stibdivision~ Mayor Hinkle opened the public hearing. Mr. Arlon Fuchs, a resident of Elk Hills, indicated that he was representing the residents of Elk Hills and submitted a petition in opposition of the zone change to the City Council. Mr. Fuchs indicated that the residents of the Elk Hills Addition wanted the property to remain residential for the following reasons: 1) The property serves as a buffer zone for the Elk Hills residents and therefore, it is required to maintain the present valuation of the homes in the Elk Hills area. 2) The traffic into and out of ELk RilLs Addition is controLled by Elk Hills Drive and the busine$ses along the service road are already creating a traffic problem in the area and should the parcel be rezoned commercial, it would create an even larger traffic problem. 3) The noise pollution with the elimination of the present buffer zone and the addition of a commercial business would be a detriment to the residents in Elk Hills. "..- . . City Council Minutes June 18, 1984 Page Three Mr. Fuchs further indicated that he felt the proposed use of the property would be the worst type of commercial use for the area. The City Administrator indicated that the request and proposed use of the property is consistent with the City's land use map. The City Administrator indicated that the property is 200 feet away from a residence and would be buffered by the condition of the conditional use from the residential property. The City Administrator further indicated that the proposed use would not affect the valuation of the property in Elk Hills any more than any other use. The City Administrator indicated that single family residential will .not work next to v the MaDonalds Restaurant and further indicated that commercial zoning would be highest and best use of the property. Mr. Arlon Fuchs indicated that he felt the property could be used for a duplex. The City Administrator indicated that the topography of the land would not lend itself well to any use other than a use that would have highway frontage. Mr. Larry Tothindicated that there is other connnercial. property available in the area, specifically, the Barrington planned unit development and also within the City, therefore, felt the City should not rezone additional property to C-3. Various residents of the Elk Hills Addition expressed their opposition to the proposed zone change and conditional use ~ Discussion was carried on regarding the Planning Commission and their qualifications for serving on that commission. Discussion was also carried on regarding traffic control and traffic problems in the area of Dodge Avenue and Elk Hills Drive. Further discussion was carried on regarding the. Planning Commission'sreconnnendation. Mr. Cliff Lundberg expressed his concern about the buffering and indicated that he felt the City Council should be concerned that a buffer be required between the connnercial property and the Elk Hills residential area. Mr. Jim Neilson, attorney and representative for Mr. George Dietz, indicated that the City Council was ina difficult position as they must make a decision that would best serve the City. of Elk River. Mr. Neilson indicated that the proposed use of the property on Highway 4f169 would create more taxes for the City of Elk River and would help pay for aw~ter trunk line which is necessary to serve the area. Mr . Neilson indicated that Parcel C of the administrative sub- division was sold to Mr. Milo Henneman to allow more land to be used as a buffer, and further indicated that Parcel B would be a buffer to the Elk Hills residents. Mr. Neilson indicated that Mr. Earl Hetrick's house is 232 feet from the north line of Parcel A. Mr. Neilson indicated that as proposed on the site plan, the two large oak trees on Parcel A would not be removed. Mr. Neilson indicated that Mr.>Dietz offered the property for sale to the residents and specifically Parcel B, to Mr. Earl Hetrick at a very reasonable cost. Mr. Neilson indicated that Highway 4f169 in itself will create traffic which will affect the Elk Hills residents and further indicated that property fronting on Highway #169 could best be used as commercial property. Mr. Neilson further indicated that the proposed zone change and conditional use is con$istentwith. the City J s land use. City Council Minutes June 18, 1984 Page Four Ms. Julie Kastendick indicated that Minnesota has four seal)OnS,i therefore, there are times when the trees do not provide a buffer and further indicated that she felt a duplex would be the proper use for the property which is located next to the McDonalds Restaurant. Discussion was carried on regarding the topography of the property and the fact that the Elk Hills r~sidents are higher than the property in question. Mr. Neilson indicated that the topography map shows a difference of approximately 18 feet / in height and that the tree~ clearly would be a buffer for Parcel.A. Mr. Neilson j further indicated that Mr. (K.:i.etz could remove all of the trees from the property should he choose, as he is the owner. Mr. Craig Loebig indicated that he felt the proposed use was a very poor choice and further suggested that the commercial use should be an office building. Discussion was carried on regarding the traffic problems and the possibility of the proposed use being a twenty-four hour service. The City Administrator indicated that the City Council could set the hours of the proposed business through the conditional use permit. Mr. Jerry Bird questioned the need of rezoning another commercial area. indicated that he felt the City Council should be concerned with what is the residents of the City of Elk River and not the monetary gain for one or outside people traveling on Highway #169. Discussion was carried on regarding the specific property.1ine of Earl Hetrick's property. Mayor Hinkle indicated that he would be hard-pressed to change the zone as requested by Mr. Dietz. Mayor Hinkle indicated that the property does J serve as a buffer between Highway :/H69 and the Elk Hills Addition. Mayor Hinkle further indicated that the City Council required the Barthel planned unit develop- ment to include a buffer between the commercial and single family residential area, as the City Council also required a buffer zone in the. Barrington planned unit development. Mayor Hinkle indicated that Mr. Dietz does have a right to develop the property and further indicated that he felt the people do not have to buy their buffer zone between commercial and residential property property. Mayor Hinkle further indicated that he felt there should be a buffer zone between the Elk Hills Addition and the commercial property. Councilmember Gunkel indicated that the City Council must consider all of Elk River in its decision-making process. Councllmember Gunkel lndlcated that there are forty acres west of Highway #169 ready for commercial development and further indicated that she felt Mr. Dietz's property, Parcels A and B, should be combined into one parcel for multi-family development. Councilmember Engstrom indicated that he felt by rezoning the Dietz property for commercial development, it would slow down commercial development in other areas City Council Minutes June 18, 1984 Page Five of the City. Councilmember Engstrom indicated that he felt the City has more than enough commercial zoned area at the present. Councilmember Schuldt indicated that it was obvious that the zone change request would not be approved and further indicated that it could come back to the City Council again at a different time, perhaps with a new City Council and a different proposal. Councilmember Schuldt further indicated that he felt the property would not remain zoned residential. Councilmember Schuldt indicated that he felt that some time in the future, the property would be zoned commercial and the City Council should consider what would be the most tolerable use of a mommercial zone. Councilmember Schuldt indicated that he did have reservations regarding the proposed use as a car wash and .further indicated that he felt there were some better options for the property. COUNCILMEMBER GUNKEL MOVED TO DENY THE ZONE CHANGE REQUEST BY MR. GEORGE DIETZ FOR HIS PROPERTY ON HIGHWAY #169 AND ELK HILLS DRIVE. COUNCILMEMBER ENGSTROM SECONDED Mr. Jim Neilson requested that the City Council consider tabling the zone change request until such time as the full Council was present. Councilmember Schuldt indicated that the City Council has considered carrying over other issues which required a four-fifths vote until such time as the full Council was present and therefore, felt the City Council should consider tabling this request. The residents of Elk Hills Addition in attendance at the City Council meeting expressed their opposition of the suggestion to table the consideration of the zone change request. THE MOTION PASSED 4-0. Mayor Hinkle requested that the City Administrator start proceedings with the Minnesota Department of Transportation for installation of a traffic signal light at Highway #169 and School Street. 6. Assembly of God Conditional Use Permit Request - Public Hearing Mayor Hinkle indicated that the Elk River Assembly of God Church has requested a conditional use permit to allow them to construct a church within the Brentwood Subdivision. Mayor Hinkle indicated that the zoning ordinance requires that a conditional use permit be issued for churches constructed in residential zones. Mayor Hinkle indicated that the Planning Commission reviewed the Assembly of God's request for a conditional use and recommended that the City Council grant the conditional use permit with a number of conditions as stated in the City Administrator's memorandum to the Mayor and City Council dated June 12, 1984. The Assembly of God's engineer reviewed the proposed building plans for the City Council. The engineer indicated that the building will be constructed in two phases to allow for a total of 1,200 people with 297 parking spaces. Discussion was carried on regarding the design of the building and the fact that a concrete building is proposed because of the number of people it is proposed to serve. Discussion was also carried on regarding the use of the building during phase one and phase two. r- . City Council Minutes June 18, 1984 Page six Mr. Dexter Mapson, representative of the Assembly of God Church indicated that when phase two was completed, the phase one portion of the building would be used as classroom and gym. Mr . Roy Wallace of 196th Circle, indicated that he felt the proposed building design looked like an industrial building rather than a building that was suitable to a residential area~ Ms. Teresa Russell of 11930 196th Circle, indicated that she was not aware of the fact that a portion of the building would be used for a school and gym. Therefore, she was very concerned about the traffic through the residential area. Ms. Russell indicated that the possibility of a church and therefore, excess traffic one day a week was a lot different than seven days use of the building. Discussion was also carried on regarding the proposed size of the building. Discussion was carried on regarding the present parsonage . and fellowship hall. Mr. Jeff Pelter indicated that when he bought his lot in the Brentwood Addition, there were certain covenants that were included in the agreement. Mr. Pelter further indicated that in the purchase of his property, it was indicated by 1. Mr. Den4y)Anderson, developer of the Brentwood Addition, that the development was platted for all single-family residential lots. Discussion was carried on regarding the convenants as proposed by the developer, Mr. Denny) Anderson. ,-.J The City Admininstrator indicated that the City cannot enforce convenants and that it would be a civil matter between the purchaser and the develqper. Discussion was carried on regarding the conditions of the conditional use as recommended by the Planning Commission. Discussion was also carried on regarding the phasing of the building and the possibility of phase two never happening. Further discussion was carried on regarding the financing of the proposed church, and the construction and design of the church. The City Administrator indicated that the City Council could require a letter of credit or an escrow account for the alteration of phase one to make it more compatible with the neighborhood , should phase two not happen. Councilmember Gunkel suggested that the City Council consider five years from the initial start of phase 1 ,that if phase two is not completed, the church would be required to do a face lift of phase one. Request - Public Hearing Councilmember Engstrom indicated that Paul and Donna Busch of 620 7th Street have requested a conditonal use permit to allow them to place a mobile home on ten City Council Minutes June 18, 1984 Page Seven acres of property in an A-I Agricultural zone that 1S in condition with the family. farm operation. Mayor Hinkle opened the public hearing. Mr. Paul Busch indicated that a two-year permit would be sufficient time, as he currently has plans for the construction of a house on the property. Councilmember Schuldt questioned the extent of Mr. Paul iBusch 's involvement in the family farm operation, as the zoning ordinance states that the mobile home occupants must derive their principal income from the farm operation. Mr. Busch indicated that he does work outside of the family farm operation. General discussion was carried on regarding the City's zoning ordinance and the conditions that are required to allow for a mobile home as a temporary residence. COUNCILMEMBER ENGSTROM MOVED TO APPROVE THE CONDITIONAL USE PERMIT REQUESTEDiBY PAUL AND DONNA BUSCH TO PLACE A MOBILE HOME ON TEN ACRES OF PROPERTY ZONED A-I AGRICULTURAL. COUNCILMEMBER GUNKEL SECONDED THE MOTION. THE MOTION FAILED 1-2. The City Administrator indicated that the City Council could consider a conditional use permit for the mobile home for a six-month period as allowed in the City's Zoning Ordinance. Wuorio Conditional Use Permit/Variance Request - Public Hearing The City Administrator indicated that Mr. Peter Wuorio of Wuorio Sales at 9619 Highway #10 in Elk River, has requested an ordinance amendment to allow car and truck sales in a C-3B Highway Commercial zone and has requested a variance from the rear yard setback to allow for the construction of abuilding on the property. The City Administrator indicated that during the Planning Commission's discussion of Mr. Wuorio's request, it was determined that the Planning Commission was opposed to any zoning ordinance amendment to permit the use as requested by Mr. Wuorio and further, suggested that Mr. Wuorio remain a nonconforming use and make use of the Zoning Ordinance that permits alterations in nonconforming uses under certain standards. The City Administrator indicated that the Planning Commission unanimous ly recommended that Mr. Wuorio be permitted to make the alterations as requested and recommended that the City Council grant a one-foot setback variance on the rear property line. The City Administrator indicated that the City of Ramsey has submitted a.letter for the file indicating that it is an appropriate use in their City. Councilmember Gunkel questioned the variance standards and whether they could be met. Mr. Rick Breezee, Building and Zoning Administrator, indicated that the City in their rezoning process, made Wuorio Sales a nonconforming use. COUNCILMEMBER ENGSTROM MOVED TO APPROVE A ONE-FOOT REAR YARD SETBACK VARIANCE FOR THE PROPERTY AT 9619 HIGHWAY tHo AND TO GRANT A VARIANCE TO MR.WUORIO TO ENABLE HIM TO EXPAND HIS NONCONFORMING USE. Zoning Ordinance Amendment Regarding Produce Markets in a C~3A Highway Commercial Zone The City Administrator indicated that Mr. Larry Wolner has requested that a produce market be a permitted use in a C-3A Highway Commercial zone. The City Administrator indicated that the Planning Commission in reviewing Mr. Wolner's request agreed that a produce market or stand was an appropriate use in a C-3A Highway Commercial District, but felt that the produce market or stand should be a conditional use. The City Administrator indicated that the Planning Commission felt by making produce markets a conditional use, the City would be able to exercise greater control over traffic and appearance of a produce market or stand. The City Administrator indicated that the Planning Commission voted to recommend that the City Council amend the Zoning Ordinance to permit as a conditional use, produce markets in a C~3A Highway Commercial zone. Mayor Hinkle opened the public hearing. No one appeared for or in opposition of the zoning ordinance amendment. Mr. Wolner indicated that it is proposed to build a 40 by 80 foot building on the property next to Broadway Bar and Pizza. COUNCILMEMBER ENGSTROM MOVED TO ADOPT ORDINANCE 84-6, AN ORDINANCE AMENDING SECTION 900.16 - OF THE.CITY'S ZONING ORDINANCE TO ADD PRODUCE MARKET AS A CONDITIONAL USE INC..,.3A. HIGHWAY COMMERCIAL ZONES. COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION PASSED 4-0. 9~. Watermain Feasibility Study Mr. Jeff Roos of Consulting Engineers Diversified, presented and discussed a feasibil- ity study for the trunk watermain improvements that would extend from the Elk River Plaza Planned Unit Development to the Barrington Place Planned Unit Development. Mr. Roos indicated that the proposed improvement would consist of a 16-inch watermain extending from Freeport Avenue through the Elk River Plaza Planned Unit Development. Mr.. Roos indicated that the estimated project cost of $76,000. Mr. Roos indicated that the project could be paid for through special assessments and monies from the water utility fund. Discussion was carried on regarding the easements necessary and the assessing of costs to benefited properties. The'City Administrator indicated that should the City CounciL have approved the zone change for the Dietz property. the owners would have wiaved their rights for objection to assessments. The City Administrator indicated that the City Council will now have to hold a public hearing before ordering the watermain improvement project. The City Administrator indicated that the City's engineers will request Northdale Construction to submit a bid on the watermain project as a change order to the East Main Street project. Employee Health Insurance Renewal The City Administrator indicated that the City has received its renewal rates for the health plan currently utilized by all City employees. The City Adminis- trator indicated that the current carrier, HMO Minnesota, has proposed a rate increase of 10.2 percent. The City Administrator indicated that the City's employ~es have been satisfied with the HMO Minnesota plan and request continued coverage under HMO Minnesota. COUNCILMEMBER GUNKEL MOVED TO APPROVE THE HMO MINNESOTA HEALTH INS URAtirC IS CONTRACT EFFECTIVE JULY 1, 1984. COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION PASSED 3-0. 11. Administrator's Update A. League of Minnesota Cities Conference Discussion of the League Conference was postponed until the next City Council meeting. B. East Main Street Improvement Project This item was discussed as Item 4~ - The East Main Street project. C. Barthel Planned Unit Development Councilmember Gunkel indicated that at a tax increment workshop at the Duluth Conference, it was recommended that there be a time limit in which developers must respond to the City with regard to taxing and financing. Councilmember Gunkel requested that the City Administrator contact the developers of the Barthel planned unit development regarding their time schedule. The City Administrator indicated that the time table as discussed in the tax increment financing workshop was' relative to actual construction and the developers construction time schedule. It was the consensus of the City Council that the City Council meet with the developers of the Barthel planned unit development at their next City Council meeting to discuss the time sche~ule of the development. D. Audit Report Councilmember Gunkel requested that the City auditors meet with the City Council to discuss the City's audit report. E. Prairie House Restaurant Councilmember Gunkel indicated that she was aware of a public hearing scheduled for the Prairie House restaurant. The City Administrator indicated that the public hearing is scheduled for an administrative subdivision for the construction of the Prairie House Restaurant. The City Administrator indicated that at the First National Bank community room. June 27th at 2:00 p.m., MnlDot would be meeting with the retailers regarding the detour plans for the Highway #10 project. City Council Minutes June 18, 1984 Page Ten 12.
