06-25-1984 CC MIN REGULAR SCHEDULED MEETING OF THE ELK RIVER CITY COUNCIL HELD AT THE ELK RIVER PUBLIC LIBRARY MONDAY, JUNE 25, 1984 Members Present: Mayor Hinkle, Councilmembers Schuldt, Engstrom, Duitsman and Gunkel Members Absent: None 1. The meeting was called to order at 7:30 p.m. by Mayor Hinkle. 2 . Agenda Item 9~ - Discussion of Municipal Facilities, Capital Improvement Program Meeting, Planning Commission Public Hearing Status, the Highway #169 Water Trunk Crossing Project, Tot Park, and the County Fair to be handled as discussion. COUNCILMEMBER GUNKEL. MOVED APPROVAL OF THE AGENDA AS AMENDED. COUNCILMEMBER DUITSMAN SECONDED THE MOTION. THE MOTION PASSED 4-0. 3. Bredeck Easement Vacation The City Administrator explained the request for easement vacation and reviewed the general area for the Council's benefit. The Administrator reviewed roads previously vacated in the area, topography of the Bredeck site and potential future access to areas affected by the easement in question. Mayor Hinkle declared the public hearing open. Bud Houlton was present to indicate his concern that plans to develop his farm- land are unknown at this point and vacation of the easement may cause him problems at some point in the future. Certain questions were raised regarding other street vacations and whether or not 2nd Street had actually been vacated. There being no further comment, the public hearing was closed. The City Administrator suggested that rather than vacate the entire right-of-way as requested by Mr. Bredeck, that the south half of the right-of-way be vacated so that Mr. Bredeck's concern of a through road could be addressed and yet Mr. Houlton would have access to his property off of the shortened right-of-way. COUNCILMEMBER DUITSMAN MOVED TO VACATE THE SOUTH 165 FEET OF XENIA STREET EXTENDED. COUNCILMEMBER ENGSTROM SECONDED THE MOTION. THE MOTION PASSED 5-0. 5. Kuhn Easement Vacation The City Administrator reviewed the request for easement and Mayor Hinkle declared the public hearing open. Mr. Harry Kreuser was present and indicated that he developed the property in the area and originally was told that he could not build on the lot in question. Mr. Kreuser indicated that there was a problem with sewer in the area and also a problem with storm water in the area. Mr. Jerry McChesney was also present and indicated his concerns regarding sewer and water in the area affected by the easement. City Council Minutes June 25, 1984 Page Two --, Mayor Hinkle closed the public hearing. The City Council discussed the item further and indicated their concerns re- garding sewer in the area and the possible need for a service road at a future date. There was a concern that Mn/DOT would close the Highway #10 access to Simonet Drive and as such; this right-of-way would be required for future service road construction to that area. COUNCILMEMBER SCHULDT MOVED TO DENY THE EASEMENT VACATION REQUEST. COUNCILMEMBER ENGSTROM SECONDED THE MOTION. THE MOTION PASSED 4-0. 5. Prairie House Administrative Subdivision The City Administrator reviewed the Prairie House Administrative Subdivision re- quest. Mayor Hinkle declared the public hearing open. Gary Santwire was present and asked about documentation for the administrative subdivision for the real estate transaction. The City Administrator indicated that sufficient documentation would be provided to satisfy the owners of the Prairie House. Mayor Hinkle closed the public hearing. COUNCILMEMBER DUITSMAN MOVED TO APPROVE THE ADMINISTRATIVE SUBDIVISION AS RECOM~ MENDED BY THE CITY ADMINISTRATOR. COUNCILMEMBER ENGSTROM SECONDED THE MOTION. THE MOTION PASSED 4-0. 6. Ridgewood Estates Road Repair/Resurfacing The City Administrator reviewed the Capital Improvement Program as it relates to the Ridgewood Estates road rebuilding and indicated that the plan was to take action on the roads at a future date and not in calendar year 1984. Mr. John Gilbertson of Consulting Engineers Diversified explained a soils test- ing report recently received by the City on the area, and indicated that an over- lay of various thicknesses could probably be utilized in the majority of the Ridgewood Estates area. Tony Rudy, Jim Pellicciotti, and Gene Zappa were present to represent the Ridge- wood Estates homeowners. The homeowners indicated that they were pleased to see the revised information which would then lower the cost to rebuild the roads and indicated that they felt something needed to be done about the roads and very soon. Tony Rudy indicated that they City should be responsible for the repairs, inasmuch as the residents were promised that the roads would be taken care of as part of the consolidation effort. The City Administrator reviewed budget constraints, the City's street maintenance policies and other financial considerations for the benefit of the homeowners. City Council Minutes June 25, 1984 Page Three ---, Cotincilmember Duitsman indicated that a 30/70% split for assessments, with 30% assumed by the City was discussed by the Council and indicated that 30% was the most which Ridgewood Estates residents could expect the City to assume. Councilmember Schuldt indicated that there may be greater need for other roads to be addressed by the City Council before the Ridgewood Estates roads. Mr. Pellicciotti and Mr. Zappa indicated that dollars spent now would save dollars in the future and that they were very concerned that something be done immediately. Mayor Hinkle indicated that the City should look to the 1984 budget to see what had been planned and to have the City take a look and doing the roads as soon as possible inasmuch as the residents had petitioned for the work. No action was taken on the item but further information was to be developed for the Monday, July 2nd City Council meeting. 7. Barthel Planned Unit Development No discussion on this item took place as Mr. Barthel was unable to be present for the meeting. 8. Provision of Consulting Engineering Services for Houlton Property Development COUNCILMEMBER ENGSTROM MOVED TO APPROVE THE CITY'S PROVISION OF CONSULTING ENGINEERS DIVERSIFIED'S SERVICES AT THE CITY'S COST TO BUD HOULTON FOR DEVELOP- MENT HE WAS ANTICIPATING ON JACKSON AVENUE. COUNCILMEMBER GUNKEL SECONDED THE MOTION. THE MOTION PASSED 4-0.. 9. Establishment of Lead Worker Classification in Street Department The Street Superintendent, Mr. Phil Hals, explained his desire to have a lead worker classification in the City's Street Department. Mr. Hals explained that the position would pay an additional 50~ per hour and that the person designated to be lead worker would have certain supervisory responsibilities primarily in the summertime. COUNCILMEMBER ENGSTROM MOVED TO APPROVE THE LEAD WORKER CONCEPT AS DESCRIBED BY STREET SUPERINTENDENT PHIL HALS. COUNCILMEMBER GUNKEL SECONDED THE MOTION. THE MOTION PASSED 4-0. 9~. Discussion Items A. A meeting date for municipal facilities review was established for July 12th. B. A Capital Improvement Program meeting was established for July 17th. C. Planning Commission - Holding Public Hearings The Council was brought up to date on the status of the ordinance adoption. ~ City Council Minutes June 25. 1984 Page Four D. County Fair Councilmember Gunkel asked if there was City support to have a booth at the County Fair on behalf of the City of Elk River. The general consensus of the City Council was that there was no interest. E. Highway #169 Water Crossing The itssessment of the George Dietz property immediately north of the McDonald's restaurant was addressed and determined not to be appropriate. F. Tot Park The Friendshuh's were awarded a contract for the Tot Park maintenance and $50.00 was to be deducted from the contract because of the timing.
