SPECIAL SCHEDULED MEETING OF THE
ELK RIVER CITY COUNCIL
HELD AT THE ELK RIVER CITY HALL
THURSDAY, NOVEMBER 15, 1984
Members Present:
Mayor Hinkle, Councilmembers Engstrom, Duitsman, Schuldt and Gunkel
Members Absent:
None
1. The meeting was called to order at 7:00 p.m. by Mayor Hinkle.
2. Dennis Anderson/Brentwood Roads
Mayor Hinkle indicated that Mr. Dennis Anderson was present to request the City
Council to reconsider the $9,400 that the City Council requested to be placed in
escrow for future sealcoating of the roads in the Brentwood Addition. Mr. Dennis
Anderson indicated that the developer's agreement did not specify the type of bitu-
minous mix that should be placed upon roads in a development. Mr. Anderson indicated
that the developer's agreement only requested a 2-inch mat for a seven ton road.
Mr. Anderson further indicated that the State requires a 23-31 mix and therefore,
he felt the City's requirements would be the same as the State's.
Discussion was carried on regarding the first mile of bituminous road in the Brent-
wood Addition placed in 1983 with the 23-41 mix and the completion of the roads
in the Brentwood Addition in 1984 completed with a 23-31 mix.
The City Administrator indicated that the developer's agreement does not specify
the type of mix to be used but does specify that the developer will provide the
City with specifications for the roads to be constructed in a development. The
City Administrator indicated that the City did not receive a contract between the
developer, Dennis Anderson, and Bauerly Brothers, the contractor for the road im-
provements in the Brentwood Addition.
General discussion was carried on regarding the contract between Bauerly Brothers
and the developer, Mr. Dennis Anderson.
Mr. Phil Hals, Street Superintendent, indicated that he received a copy of the
contract between Bauerly Brothers and the developer, Dennis Anderson from Gerry
Bauerly on September 4th. Mr. Hals indicated that the mile of paving that was done
in 1983 met specifications, therefore, there was no reason to question the contract
in 1984. Mr. Hals indicated that when the City's engineer obtained samples of the
paving done in 1984, the test showed a 23-31 mix rather than the 23-41 mix required
by the City.
Mayor Hinkle indicated that it is projected that the roads will need a seal coat
sooner than if the mix were a 23-41 mix. Therefore, the City has requested an
amount to be placed in escrow equal to ten percent of the contract which equals
$9,400.00.
General discussion was carried on regarding the difference between the composition
of the 31 mix and the 41 mix. Mr. Phil Hals indicated that the 31 mix deteriorates
faster than the 41 mix.

Discussion was carried on regarding the communication problems between the City
and the developer. Mayor Hinkle indicated that the City Council must solve the
problem at hand regarding the required $9:,400 escrow amount. Councilmember Duitsman
suggested the City Council reduce the required $9,400 amount by 50 percent, therefore,
requiring $4,700 to be placed in escrow.
Councilmember Schuldt indicated that the City has standards that the City Council
should support and further indicated that developers should obtain those specifica-
tions prior to contracting for road improvements.

DUITSMAN SECONDED THE MOTION. THE MOTION. THE MOTION PASSED 3-1. COUNCILMEMBER
SCHULDT OPPOSED.
There being no further business, the City Council adjourned into a budget committee
session discussion 1985 salaries.
Discussion was carried on regarding public works salaiies, clerical salaries and
department head salaries.
COUNCILMEMBER GUNKEL MOVED TO AUTHORIZE A 5.4 PERCENT INCREASE TO THE CITY CLERK, THE
CITY ADMINISTRATOR, THE POLICE CHIEF, THE STREET SUPERINTENDENT, THE SEWER SUPER-
INTENDENT, THE BUILDING AND ZONING ADMINISTRATOR, THE PART-TIME BUILDING DEPARTMENT
SECRETARY, AND THE ACCOUNTING CLERK. MAYOR HINKLE SECONDED THE MOTION. THE MOTION
FAILED 1-3. COUNCILMEMBERS SCHULDT, DUITSMAN AND ENGSTROM OPPOSED.
Further discussion was carried on reg~rding salaries for department heads and part-
time employees.
COUNCILMEMBER GUNKEL MOVED TO AUTHORIZE A 5.4 PERCENT INCREASE FOR 1985 SALARIES FOR
THE POSITIONS OF CITY ADMINISTRATOR, CHIEF OF POLICE, POLICE SERGEANT, STREET SUPER-
INTENDENT, SEWER SUPERINTENDENT, BUILDING AND ZONING ADMINISTRATOR, AND CITY CLERK.
COUNCILMEMBER DUITSMAN SECONDED THE MOTION. THE MOTION FAILED 1-3. COUNCILMEMBERS
SCHULDT, DUITSMAN AND ENGSTROM OPPOSED.
COUNCILMEMBER DUITSMAN MOVED TO AUTHORIZE A 4 PERCENT SALARY INCREASE FOR 1985 FOR
THE POSITIONS OF CITY ADMINISTRATOR, CHIEF OF POLICE, POLICE SERGEANT, STREET
SUPERINTENDENT, SEWER SUPERINTENDENT, BUILDING AND ZONING ADMINISTRATOR AND CITY
CLERK. COUNCILMEMBER ENGSTROM SECONDED THE MOTION. THE MOTION PASSED 3-1. COUNCIL-
MEMBER GUNKEL OPPOSED.
COUNCILMEMBER ENGSTROM MOVED TO REMOVE THE POLICE SERGEANT FROM THE 4 PERCENT SALARY
INCREASE MOTION AND AUTHORIZE THE POLICE SERGEANT SALARY TO BE TEN PERCENT OVER THE
INVESTIGATOR, SCHOOL LIAISON OFFICER AND CORPORAL 1985 SALARY. COUNCILMEMBER GUNKEL
SECONDED THE MOTION. THE MOTION PASSED 4-0.
