6.7 Item# 6.7. ity of1 Elk MEMORANDUM • River TO: Planning Commission FROM: Scott Harlicker, Planning Assistant DATE: August 26, 1997 SUBJECT: Request by City of Elk River for Zoning Ordinance Amendment Regarding Uses in Busienss Park Zoning District, Public Hearing Case No. OA 97-12 Request Discussion of an amendment to the zoning code to differentiate between the types of uses allowed in the Business Park district. • Overview At the July 22, 1997 Planning Commission meeting, the Commission discussed the need for an ordinance amendment to clarify the intent of the Business Park district. The district was intended to allow certain industrial, office and limited commercial uses based on the underlying land use classification. Office and industrial uses would be allowed when the underlying land use is light industrial and certain commercial uses would be allowed when the land use classification is highway business. The current ordinance does not reflect that intent. One option would be would be to list the uses allowed when the underlying land use is highway business as shown below: Permitted Uses i. Permitted uses allowed when the underlying land use is light industrial: 1. Light manufacturing 2. Research and development laboratories 3. Government, business and professional offices • 4. Permitted uses allowed when the underlying land use is highway business: 1. Health athletic clubs 2. Personal service establishments 3. Financial institutions Conditional Uses i. Conditional uses allowed when the underlying land use is light industrial: 1. Any permitted use which involves more than 30 % warehouse space 2. Vocational, technical, and trade schools 3. Multiple buildings on a lot 4. Multiple tenant buildings 5. Above ground storage tanks ii. Conditional uses allowed when the underlying land use is highway business: • 1. Hotels and motels 2. Licensed daycare facilities 3. Retail shops and stores which compliment and serve the Business Park subject to the standards set forth in 2(j) below 4. Motor vehicle specialty service stations 5. Multiple buildings on a lot 6. Multiple tenant buildings 7. Restaurants (Class I) The Statement of Purpose could also be amended to better reflect the original intent of the Business Park district. The following is a revised Statement of Purpose the accomplishes that: The Business Park district is established to encourage a planned, integrated environment for certain industrial, office and commercial uses which are compatible with and compliment each other as well as the surrounding land uses. The underlying land use designation will guide the type of uses allowed within the district. The underlying land use designation within the district may vary, either light industrial or highway business. It is the intent of this ordinance that development reflects common themes using compatible architectural design and consistency in signage, landscaping, and lighting. It is also the intent to encourage businesses which generate a high number of jobs per square foot rather that predominately warehouse types uses. Recommendation No action is required at this time. Motor vehicle specialty service stations vii . Multiple buildings on a lot viii. Above ground storage tanks STANDARDS: A. Minimum lot size - one and one-half (1 1/2) acres B. Building setbacks (minimum) i . Front Yard - Thirty-five (35) feet, or one-half (1/2) the total building height whichever is greater. ii. Side Yard - Twenty (20) feet, or one-half (1/2) the total building height, whichever is greater. iii . Rear yard - Twenty (20) feet, or one-half (1/2) the total building height, whichever is greater. iv. All setbacks shall be determined from the planned right-of-way (ROW) , as designated in the City, County, or State Transportation Plan, and normally defined in the subdivision regulations. C. Parking Lot Setbacks (minimum) • i. Front Yard - Twenty-five (25) feet . ii. Side Yard - Twenty (20) feet. 9.43
