Item# 6. 1. ety of � MEMORANDUM Elk • River TO: Planning Commission FROM: Scott Harlicker, Planning Assistan DATE: September 30, 1997 SUBJECT: Request by Golden Eagle Motorsports for Conditional Use Permit, Public Hearing Case No. CU 97-25 Request Consider a request by Golden Eagle Motorsports for a conditional use permit for a recreational vehicle repair facility Location • 16501 Highway 10 Zoning/Land Use I1 (Light Industrial) / LI (Light Industrial) Attachments • Location map • Site plan existing conditions • Site plan suggested improvements Background The applicant is proposing to utilize part of the existing building for the repair of small personal recreational vehicles such as golf carts, snowmobiles and motorcycles. The building will be shared with a recycling center which also operates on this site. In May 1995 the owner of the property, Mr. Dick Hetland, was granted a conditional use permit for a recycling center. By October 31, 1997, trees are to be planted, security gate installed and the parking and drive areas defined. As of September 18, 1997 the improvements that were supposed to have been completed by 10/31/96 were incomplete and the improvements scheduled to be completed by 10/31/97 had not been completed. Staff is currently working with Mr. Hetland on meeting the conditions that were included as part of the conditional use permit for the recycling station. Compliance with the conditions of the approval for the recycling center should be made a condition of the approval for this application. • Overview The applicant is proposing to occupy a portion of the existing building and use it for his recreational vehicle repair business. He will be repairing small personal recreational vehicles such as snowmobiles, motorcycles and golf carts. This application does not involve any new construction, exterior modifications to the existing building or outdoor storage of vehicles or equipment. Parking and Access The zoning code requires 10 parking spaces for this type of facility. Ten spaces are provided on the east side of the building, facing 165th Avenue. Currently there are 2 accesses from 165th Avenue. One of the driveways is adjacent to the 165th Avenue and Highway 10 intersection, the other is located about 130 feet to the east on 165th. Because of its proximity to the Highway 10 intersection, staff is recommending that the driveway closest to Highway 10 be closed and landscaped. Currently the pavement between the building and 165th does not extend to the eastern boundary of the parking area and is in need of repair. Landscaping Currently there are 2 trees that were planted along 165th. Neither of the trees meets the minimum size requirements of the landscape ordinance. A landscaping plan the complies with the landscaping ordinance should be provided. The landscape plan could be used to fulfill the conditions of the conditional use permit for the recycling center as well as any landscape requirements for this application. With 1721 linear feet around the perimeter of the property, the landscape requirements include 43 trees of which 50% (22) have to be overstory trees, 25% (11) have to be conifers and 25% (10) have to be ornamental trees. Trees used to fulfill the landscape requirements also need to meet the minimum size requirements which are 2" diameter for overstory trees, 6 feet high for conifers and 1.5" diameter for ornamental trees. Signage III There is a freestanding sign on Highway 10 that is used by the recycling center. The maximum sign area allowed for the freestanding sign is 64 square feet. Because the property has more than 300 feet of frontage on Highway 10, a second freestanding sign would be allowed provided it is more than 150 feet away from the existing sign. The applicant would also be allowed a wall sign that does not exceed 2 square feet in area for every linear foot of building frontage. All signage will require a sign permit. Recommendation It is recommended that the Planning Commission recommend approval of this request with the following conditions: 1. THAT THE CONDITIONS INCLUDED AS PART OF THE APPROVAL FOR THE RECYCLING CENTER BE MET. 2. THE ACCESS FROM 165TH AVENUE CLOSEST TO THE HIGHWAY 10 INTERSECTION BE CLOSED AND LANDSCAPED. 3. A LANDSCAPE PLAN THAT FULFILLS THE REQUIREMENTS OF THE LANDSCAPE ORDINANCE BE SUBMITTED FOR STAFF REVIEW AND APPROVAL. 4. THE PARKING AND TRAVEL AREA BETWEEN THE BUILDING AND 165TH BE PAVED AND REPAIRED. A 10 FOOT LANDSCAPED SETBACK SHALL BE MAINTAINED ALONG THE RIGHT-OF WAY FOR 165TH AVENUE. 6.
