The intent of the district was to allow certain commercial uses in areas with the underlying land use of highway business and certain industrial uses were the underlying land use is light industrial. Attached is the report to the Planning Commission dated August 26, 1997. The Commission directed staff to draft an ordinance amendment that specifically lists what uses are allowed when the underlying land use is highway business and light industrial. The Statement of Purpose was also amended to better reflect the original intent of the Business Park district. These changes are reflected in the attached ordinance. 13065 Orono Parkway • P.O. OA 97-12 The City Council of the City of Elk River does hereby ordain as follows: Section 1. Section 900.12 (16) of the City of Elk River Code of Ordinance titled "Permitted, Accessory, and Conditional Uses" is hereby amended to delete the Statement of Purpose and replace it with the following: Statement of Purpose: The Business Park district is established to encourage a planned, integrated environment for certain industrial, office and commercial uses which are compatible with and compliment each other as well as the surrounding land uses. The underlying land use designation will guide the type of uses allowed within the district. The underlying land use designation within the district may vary, either light industrial or highway business. Development within the Business Park district will correspond with the land use designation, industrial and office uses allowed where the land use III designation is light industrial and commercial uses allowed where the land use designation is highway business. It is the intent of this ordinance that development reflects common themes using compatible architectural design and consistency in signage, landscaping, and lighting. It is also the intent to encourage businesses which generate a high number of jobs per square foot rather that predominately warehouse types uses. Section 2. Section 900.12 (16) of the City of Elk River Code of Ordinance titled "Permitted, Accessory, and Conditional Uses" is hereby amended to delete the following: Section 900.12 (16) A. Any permitted use which involves more than 30 % warehouse space 2. Vocational, technical, and trade schools 3. Multiple buildings on a lot 4. Multiple tenant buildings 5. Above ground storage tanks ii. Conditional uses allowed when the underlying land use is highway business: 1. Hotels and motels 2. Licensed daycare facilities • 3. Retail shops and stores which compliment and serve the Business Park subject to the standards set forth in 2(j) below 4. Motor vehicle specialty service stations 5. Multiple buildings on a lot 6. The district was intended to allow certain industrial, office and limited commercial uses based on the underlying land use classification. Office and industrial uses would be allowed when the underlying land use is light industrial and certain commercial uses would be allowed when the land use classification is highway business. The current ordinance does not reflect that intent. One option would be would be to list the uses allowed when the underlying land use is highway business as shown below: Permitted Uses i. Side Yard - Twenty (20) feet, or one-half (1/2) the total building height, owhichever is greater. iii. Rear yard - Twenty (20) feet, or one-half (1/2) the total building height, whichever is greater. iv. All setbacks shall be determined from the planned right-of-way (ROW) , as designated in the City, County, or State Transportation Plan, and normally defined in the subdivision regulations. C.
