SUBJECT: Consider Premises Permit Renewal for Fraternal Order of
Eagles Aerie #3264
REQUEST
Due to the Fraternal Order of Eagles Aerie #3264 moving to a new location they are
requesting a change to their premises permit to conduct charitable gambling at the Eagles
Club. The permit will still run for the two years from June 1, 2004 until May 31, 2006.
ACTION REQUESTED
A motion adopting the attached resolution approving a premises permit for the Fraternal
Order of Eagles Aerie #3264 to conduct lawful charitable gambling at the new Eagles Club
location, 17323 Highway 10.

A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION APPROVING PREMISES PERMIT FOR THE FRATERNAL
ORfER OF EAGLES AERIE #3264
WHEREAS,

The Fraternal Order of Eagles Aerie #3264 has made application to the
State Gambling Control Board for a Premises Permit Renewal; and
Currently a Premises Permit allows charitable gambling on the premises
of the Fraternal Order of Eagles Aerie #3264 located at 824 Railroad
Drive in the City of Elk River for the period of June 1,2004 to May 31,
2006; and
Once the Eagles Club has relocated the Premises Permit at 824 Railroad
Drive will cease to exist; and
The Fraternal Order of Eagles Aerie #3264 has met the city's
requirement of spending 75 percent of its lawful expenditures within the
city's trade area during the past two years; and
A new Premises Permit is needed to allow charitable gambling at the new
location of the Eagles Club, 17323 Highway 10, for the period of May 1,
2005 to May 31, 2006;
NOW, THEREFORE, BE IT ~ESOLVED by the City Council of the City of Elk River,
Minnesota that a Premises Permit be granted to the Fraternal Order of Eagles Aerie #3264
to allow charitable gambling operations at the Eagles Club located at 17323 Highway 10 in
the City of Elk River, Minnesota.
Passed and adopted this 18th day of April 2005.
